Commissioner Martinez introduced the foregoing item.
Mr. Chad LaBree, Bangor, Maine, stated Carbyne Ltd was located in New York City.
Mr. Chris Caroll, Denver, Colorado introduced himself.
Mr. LaBree made a Powerpoint presentation on Carbyne�s national real-time communication platform for emergency call centers.
Commissioner Martinez stated Carbyne�s system provided real time video of activities occurring on the ground, and was a free pilot project.
In response to questions from the Board of County Commissioners� (Board) members, Mr. LaBree stated Carbyne did not answer 911 calls from Miami-Dade County; 38 agencies nationwide were utilizing the technology, including Clearwater, Florida as well as Largo Florida, and six other agencies were currently reviewing the technology. He advised the data was stored on a secured encrypted system that only County administrators for 911 would have access to, and the data was stored based on record retention policies.
Commissioner Regalado stated she wished to incorporate Carbyne�s pilot project into the Domestic Violence Task Force report, which would be coming before the Board. She commented on the �chat� component of the technology which allowed victims to communicate safely with the police, and which could be used as an evidentiary tool. Commissioner Regalado noted she was hopeful the pilot would be used specifically relating to domestic violence and for evictions.
Commissioner Martinez opined this was a good program for Miami-Dade Police officers and for the community; and it could be used in any situation.
Commissioners Heyman and Gilbert, III requested to be added as co-sponsors to Item 14A6, the companion item.

REPORT:
County Attorney Geri Bonzon-Keenan announced that in accordance with Rule 6.06 of the Board�s Rules of Procedure, members of the public would now have the reasonable opportunity to be heard regarding non-public hearing propositions before the Commission, which had not been subject to a previous opportunity to be heard. She noted that members of the public would be given an opportunity to speak on public hearing items under Section 5 of the Agenda when the item was called.
Chairman Diaz opened the reasonable opportunity for the public to be heard and the following individuals appeared before the Board:
1. Mayor Dan Gelber, City of Miami Beach, introduced Ms. Rickelle Williams, Director, Economic Development. He spoke in support of Item 4C, and the North Beach Community Redevelopment Area�s potential.
2. Ms. Alina Hudak, City Manager, City of Miami Beach, spoke in support of Item 4C and noted she would be scheduling meetings with each commissioner to discuss the challenges and redevelopment plans for North Beach.
3. Mr. David Doebler, 800 West Avenue, Miami Beach, representing the Biscayne Bay Marine Health Coalition, spoke in support of Item 2B9.
4. Ms. Isabella Jaramillo, 9880 W. Bay Harbor Drive, representing the Everglades Coalition/Izaak Walton League, spoke in support of Item 2B9.
5. Mr. Nicholas Duran, 9860 SW 14th Street, representing Hold the Line Coalition, spoke in support of Item 2B9.

Discussion ensued between Chairman Diaz and Ms. Margaret Brisbane, Director, Information Technology Department (ITD), regarding the foregoing report.
Concerning the availability of Internet access to all Miami-Dade County residents, Ms. Brisbane advised ITD was reviewing programs that were available through its network providers. She mentioned a federal program for broadband access, which ITD would be promoting to citizens; however, she noted citizens must apply for the program, which provided Wi-Fi access and a contribution to purchasing hardware. Ms. Brisbane stated additional information would be provided to Chairman Diaz.
Chairman Diaz asked Ms. Brisbane to provide the information regarding availability to each commissioner and to meet with him.
Commissioner Regalado stated the School District provided designated low-income students with Wi-Fi access cards, and suggested Ms. Brisbane discuss this process with the School Board. She also suggested providing Wi-Fi access within community centers.
Ms. Brisbane stated ITD would continue working with the Housing Director on this project.
Chairman Diaz asked Ms. Brisbane to add the information and meet with him.
Commissioner Sosa stated the foregoing report was in response to Resolution No. R-876-20 sponsored by her and approved by the Board of County Commissioners (Board) on August 31, 2020. She noted she had been working with ITD on an item, which would be brought before the Board, and asked Ms. Brisbane to obtain feedback from everyone.

In response to Commissioner Garcia�s inquiry regarding the rationale for a 48-hour bulky waste pickup and the impact to the budget, Mr. Achaya Kelapanda, Assistant Director, Technical Services, Department of Solid Waste Management (DSWM), stated staff was proposing to conduct bulky waste pickups through an appointment system by January 2022, and no cost was associated with the change in process.
The foregoing report was moved by Commissioner Garcia and seconded by Commissioner Gilbert, III.
Chairman Diaz indicated he would be meeting with DSWM to discuss this issue further.
Discussion ensued among the Board members regarding an appointment-based bulky waste pickup system versus a sweep system.
Commissioner Regalado suggested a hybrid of the appointment and sweep systems particularly during hurricane season.
Commissioner Monestime asked whether there would be an enforcement policy for setting out bulky waste piles in less than 24 hours, and Mr. Kelapanda replied DSWM would provide an educational component regarding this issue.
Commissioner Heyman offered to inform her constituents of bulky pickup sweeps; however, Mr. Kelapanda stated the sweep system could not be implemented at this time.
Commissioner Martinez stated the department needed to address situations in which items were placed on existing bulky waste piles that were already scheduled for pickup, which resulted in the entire pile not being picked up because of its size.
Mr. Kelapanda stated the Director had made some changes to address some of those concerns and he would report to Commissioner Martinez.
Commissioner Hardemon asked Mr. Kelapanda to follow up on Commissioner Martinez�s comments, and noted he was unaware DSWM only picked up a certain amount of bulky waste. He stated it was important that bulky waste be picked up in order to have a clean community.
Commissioner Souto suggested using pickup trucks with nets to remove bulky waste piles and cameras to identify individuals who were dumping items to bulky waste piles scheduled for pickup.
Following questions from Chairman Diaz regarding bulky waste items that were picked up, Mr. Michael Ruiz, Assistant Director of Administration, DSWM, clarified that all items were picked up provided they were not hazardous. He stated in instances where piles exceeded 50 cubic yards, everything could be taken and the homeowners could be charged; or the department would take a portion and the rest would remain followed by a code enforcement process. Mr. Ruiz noted DSWM tried to work with the neighborhood to find a solution but there were occasions where only a partial pile was picked up. He advised staff was working with the Information Technology Department to allow homeowners to take pictures and the department would have an image of the pile when it was recorded, along with the dimensions that could be inputted into the 311 system.
Commissioner Regalado concurred with utilizing technology and cameras to determine the bulky waste pile size, and to identify individuals who were adding items to these piles. She suggested DSWM educate residents about the Nextdoor application where the majority of discussion related to trash and dumping.
Commissioner Sosa commented on residents sharing piles and noted this would be more costly. She noted if the entire garbage was not picked up this would force people into doing illegal dumping and she asked Chairman Diaz to consider this issue in his proposed legislation.

Commissioner Cohen Higgins requested an update on the negotiations regarding the airport contracts.
In response to Commissioner Sosa�s inquiry, Mr. Lester Sola, Miami-Dade Aviation Department (MDAD) Director, commented on passenger traffic at Miami International Airport in 2019 versus 2021.
Commissioner Regalado stated the Board was discussing proprietary funding and the Airport received federal funding assistance. She expressed concern that if a resolution was not reached with concessionaires at Miami International Airport (MIA), they may sue the County for misappropriating federal funding, and not providing them with assistance. Commissioner Regalado noted the concessionaires stated the County was imposing the living wage and had not resolved the insurance issues.
Mr. Sola stated staff had been negotiating with the concessionaires and had provided feedback to their recommendations. He noted the issue related to what was economically prudent for the Airport and for the concessionaires.
In response to Commissioner Regalado�s inquiry whether a resolution could be prepared before the Board of County Commissioner�s (Board) meeting in July 2021, Mr. Jimmy Morales, Office of the Mayor, Chief Operations Officer, stated the Administration was negotiating with the concessionaires; however, pursuant to the Board�s requirement, an extension or renewal of concession agreements must impose a living wage.
Commissioner Regalado stated the Affordable Care Act and the changes it brought to the market were not reflected in the original Living Wage ordinance. She noted her concern about implementing the Living Wage ordinance as it was approved by the prior Board, and expressed her hope that Mr. Morales was considering this issue in his negotiations. Commissioner Regalado indicated the Board would be willing to amend the ordinance if it had the opportunity adopted by the prior board.
Commissioner Regalado asked if Mr. Morales could reach a resolution with the parties before the Board�s July 2021 meeting and he stated the Administration would make every effort to do so as Mayor Levine Cava wanted the concessionaires to begin collecting the Living Wage.
In response to Commissioner Heyman�s inquiry whether the negotiations could be broken up into different categories and expedited, Mr. Sola acknowledged that could be done. He noted MDAD was reviewing concessionaires who were currently under contract versus those who were not.
Commissioner Garcia asked Chief Morales to consider the Board members� comments and stated he was hopeful there could be a timetable possibly by the end of this month to ensure stability at MIA. He noted the contracts should not be on a month-to-month basis.
Commissioner Souto commented on domestic and international flights at MIA.
Commissioner Gilbert, III stated he was an advocate for the living wage; however, he was hesitant about approving a seven-year time extension to concessionaires. He requested the living wage and health care benefits be addressed in negotiations, the improvements to the common areas of the Airport, and how minority concessionaires in the airport would be addressed.
Chairman Diaz stated he was the prime sponsor on this legislation relating to this issue and he added Commissioner Hardemon as a co-prime sponsor. He noted he would be meeting with the concessionaires and wanted to ensure the Board worked with the Administration to identify a solution. Chairman Diaz emphasis this issue needed to be addressed timely; and he looked forward to meeting with the County Mayor.

Commissioner Regalado asked that when staff reviewed the agricultural designation in the foregoing report, they consider some of the innovations that were occurring in other counties and other states in order to maximize agriculture, and tie it to the pandemic and what happened with the supply chain. She requested staff incorporate the Environmentally Endangered Lands (EEL) Program in the report and discuss Retreat as part of the Comprehensive Development Master Plan (CDMP).
Commissioner Sosa gave historical background information relating to the CDMP.
It was moved by Commissioner Sosa that the Administration update the 2002 study of the agricultural industry (Recommendation No. 8); and requested County attorneys prepare the appropriate legislation. This motion was seconded by Commissioner Martinez, and upon being put to a vote, passed by a vote of 12-0 (Commissioner McGhee was absent).
It was then moved by Commissioner Sosa that the Board defer the foregoing report pending the appropriate legislation. Commissioner Martinez seconded this motion.
Chairman Diaz requested, and Commissioner Sosa accepted his proposed amendment, to include the C-9 basin in the study.
Commissioner Sosa said she welcomed any co-sponsors to the requested legislation.
Commissioner Regalado requested the Administration look at innovation and utilization of lands in the study; and suggested adding the concept of Retreat.
Commissioner Sosa stated she would request sunshine meetings on this issue.
Chairman Diaz mentioned Ms. Lourdes Gomez, Director, Department of Regulatory and Economic Resources, had shown him an area for expansion between his district and Commissioner Martinez� district and noted he agreed with this expansion.

REPORT:
First Assistant County Attorney Gerald Sanchez read into the record the title of the foregoing proposed ordinance.
Chairman Diaz opened the public hearing on the proposed ordinance, and seeing no one come forward, the public hearing was closed.
Discussion ensued between Chairman Diaz, Commissioner Heyman and Ms. Ms. Yvonne Villar (phonetic), Miami-Dade Police Legal Bureau, regarding the issuance of civil citations and payment.
Commissioner Heyman stated the civil citation program related to non-arrest for non-violent misdemeanors at the police officers� discretion. She noted six entities were not part of this uniform countywide program that included the municipalities. Commissioner Heyman stated payment was shifted from the Clerk�s Office to a stakeholder and they were pursuing those who had not remitted money; however, they were given the option of community service. She clarified that police departments, including municipal departments, had the discretion of taking or not taking action.
Ms. Yvonne Villar (phonetic), Miami-Dade Police Legal Bureau, concurred with Commissioner Heyman�s explanation, and commented on the Miami-Dade Police Department�s policy for the issuance of civil citations.
In response to Chairman Diaz�s inquiry whether there was an opt-out provision, Assistant County Attorney Anita Viciana Zapata stated the civil citation program was countywide but for the municipal law enforcement agencies to participate, the Code provides for them to do so by interlocal agreement.
In response to Commissioner Sosa�s inquiries, Mr. J. D. Patterson, Chief Public Safety Officer, stated this was a diversionary program to provide an option for police officers; however, the laws remained the same and the opportunity to arrest still existed.
Commissioner Sosa voiced her concern that the civil penalty for violation of the Florida Pawnbroking Act was only $500.00; however, Commissioner Heyman stated that category was not part of this diversion effort.
Commissioner Cohen Higgins stated the civil penalties needed to be significantly increased in order to create a sufficient diversion and deterrents.
Commissioner Heyman noted the diversion section was working; however, the arrest section was not.
In response to Commissioner Higgins� inquiry, Mr. J. D. Patterson, Chief Public Safety Officer, stated the Peace and Prosperity plan would include review of the civil citation program for expansion.
Commissioner Regalado spoke in support of the foregoing proposed resolution and commented on the fines. She noted police officers would be aware of individuals who were abusing the system.
Commissioner Gilbert, III spoke in support of the foregoing proposed resolution.
Chairman Diaz opined the civil citation program should be uniformed and countywide.
Commissioner Heyman offered to give the cities of Cutler Bay, Homestead, Miami Gardens, Palmetto Bay and West Miami a package and the data of what was required for their cities to arrest someone and bring them to Turner Gilford Knight Correctional Center, and the cost.
Hearing no further comments or objections, the members of the Board proceeded to take a roll call vote on the foregoing proposed ordinance, as presented.

REPORT:
Following Commissioner McGhee�s explanation of the intent of the foregoing proposed ordinance, Commissioner Martinez stated he would support the item.
Commissioner Regalado asked whether the Board could receive information if there were a certain number of complaints.
Mr. Jimmy Morales, Chief Operations Officer, Officer of the Mayor, stated staff conducted a thorough review of the applications.
Mr. Ivan Cotayo, Passenger Transportation Regulatory Division Enforcement Officer, Department of Transportation and Public Work, stated the department received very little complaints regarding the non-emergency providers.
Commissioner Higgins spoke in support of the foregoing proposed resolution and asked Mr. Cotayo to provide the Board with a report on complaints received in the past three years.
Commissioner Sosa reminded the Administration about legislation she sponsored which required the Administration or the department to provide a report to the Board on any problems with companies and the action to be taken.
There being no further questions or comments, the Board then proceeded to take a roll call vote on the foregoing proposed ordinance, as presented.

In response to Commissioner Garcia�s inquiry, Office of the Mayor, Chief Financial Officer, Edward Marquez stated the total outstanding County debt was approximately $17.4 billion and was comprised of various debt.
Commissioner Garcia asked Mr. Marquez to provide the Board with the cost of the $17.4 billion debt to the County.
Chairman Diaz stated he would meet with Mr. Marquez to discuss questions relating to the bonds.
Hearing no further comments or objections, the members of the Board proceeded to take a roll call vote on the foregoing proposed ordinance, as presented.

REPORT:
Mr. William J. Heffernan, Chairman, Public Health Trust (PHT) Board of Trustees, Jackson Health System (Jackson) presented the PHT�s annual report about the progress at Jackson Health System (JHS). He commented on Jackson�s accomplishments over the past 15 months and on the tenth anniversary of Mr. Carlos Migoya�s tenure as Chief Executive Officer. Mr. Heffernan stated Mr. Migoya had delivered on the promise of a new, improved and stronger Jackson; and had been a leading, trusted, consistent voice throughout the Coronavirus Disease 2019 (COVID-19) pandemic. He noted Mr. Migoya would discuss Jackson�s vision for the future, the obstacles they overcame and the issues they were facing. He thanked the Board of County Commissioners (Board) for supporting Jackson every year, especially within the last year.
Mr. Carlos Migoya commented on the $830 million Jackson Miracle Building Program approved by Miami-Dade voters in 2013, along with Jackson�s reinvestments allowed them to move forward with an $1.8 billion capital plan to renovate aging facilities, build new ones and make smart investments into the latest technology and equipment. He noted since then Jackson had completed a number of projects throughout its system including the Christine E. Lynn Rehabilitation Center and a network of UHealth Jackson Urgent Care centers geographically located across Miami-Dade County.
Mr. Migoya gave a slide presentation on the progress of Jackson�s other signature projects, noting the most recent completed project was the UHealth Jackson Critical Care Pavilion, a three-story tower built above the existing diagnostic treatment center at Jackson Memorial Hospital which would bring Jackson Memorial to a total of 146 operational, intensive care unit beds. He stated the Jackson Health Foundation received a $10 million gift from an anonymous donor to name the building the UHealth Jackson Critical Care Pavilion to emphasize the link between the institutions.
Mr. Migoya commented on Jackson West Medical Center in Doral, which would be opened later this summer. He stated this campus was the largest and most complex in their capital plan and would be a game changer for Doral, Miami Springs, Hialeah and Sweetwater residents. Mr. Migoya noted the campus would offer emergency services for adults and children, a full range of diagnostic and imaging suites and physician clinics for adults and pediatric specialties. He stated the clinical services that would be offered were tailored to fit the needs of people in nearby communities, and he looked forward to celebrating the grand opening of Jackson West Medical Center with the Board members.
Mr. Migoya commented on the services offered at Jackson North Medical Center which he noted were wide-ranging, with a focus on delivering quality and expertise to residents in North Dade and South Broward. He stated Jackson had invested approximately $100 million at Jackson North to renovate and expand the adult emergency department, build a pediatric emergency department, upgrade patient units, rebuild operating rooms and surgical suites, modernize the front entrance, repaint the building exterior, purchase one the industry�s most sophisticated robots and much more.
Mr. Migoya stated extensive investments were made at Jackson South Medical Center. He noted last year a completely renovated labor delivery recovery postpartum unit was opened as well as a new C-section suite; renovated the inpatient behavioral health unit with new patient rooms and replaced the hospital�s roof. He advised that work continued on a new medical office building located west of Jackson South and Jackson planned to lease space in this building for physician�s offices.
Mr. Migoya spoke of the time, energy and dollars invested over the last seven years to upgrade the Holtz Children�s Hospital and the Women�s Hospital at Jackson Memorial. He noted the labor and delivery suites were recently renovated and updated the entrance portico to the Children�s Hospital.
Mr. Migoya discussed the construction of a freestanding emergency department and multi-specialty physician office building on the corner of Galliano (phonetic) Street and SW 8th Street, west of 37th Avenue. He expressed appreciation to Commissioner Sosa who was partially funding this project through dollars earmarked for her district in Item 11A3 on today�s (6/15) agenda. Mr. Migoya said demolition on the existing building was expected to begin soon, and construction was expected to begin in approximately 12 months.
Mr. Migoya stated Jackson had kept its promise to build a better Jackson with a larger footprint and in record time, project spending across the system had touched every Jackson location. He noted the new and improved facilities helped Jackson to attract new patients and brought in additional revenues, which would be reinvested into unfunded capital needs. Mr. Migoya added that Jackson was a major economic engine in Miami-Dade County and by 2022; these projects would have added nearly an additional 700 new jobs to the workforce. He noted this year�s spending schedule accounted for approximately 16 percent of the $1.8 billion capital plan, and a huge share of Jackson�s bond dollars were reviewed and approved by an independent Citizens Advisory Committee, which Chairman Diaz was a member, on the PHT�s board. Mr. Migoya advised that by the end of the next fiscal year, Jackson would have exhausted the $830 million bond and spent the majority of the $1.8 billion dollars. He stated the progress that was made on the construction projects was impressive and he was proud of the teamwork and the responsible fiscal oversight that had helped Jackson meet its goals.
Mr. Migoya discussed Jackson�s COVID-19 journey over the past 15 months, noting Jackson distinguished itself as a beacon of safety and hope during the pandemic crisis. He commented on the COVID-19 vaccination program and stated Jackson was between the first and the fastest to bring immunization to South Florida once the vaccines became available. Mr. Migoya said from mid-December through today, approximately 175,000 individuals had received shots from Jackson facilities, and as Jackson moved away from vaccines at the end of April 2021, it transitioned its allocation to the County. He noted despite its battle against COVID-19, Jackson had continued treating the community�s sickest and neediest patients, including adults and children who needed life-saving organ transplants, and the Miami Transplant Institute performed 721 transplants in 2020, maintaining the nation�s number one status for the second year in a row.
Mr. Migoya stated that beyond the toll COVID-19 had taken on Jackson employees, it had left Jackson with a financial strain. He noted the CARES Act dollars that were received from the Federal government had been a huge help through the pandemic but the remainder would be exhausted by the end of this month and there would be no more cushion as Jackson entered the last quarter of the fiscal year. Mr. Migoya advised inpatient and emergency department volumes were slowly increasing and the cash selections had been strong, and he was optimistic Jackson could end the year with a break-even budget. He commented on the impact of COVID-19 on employees and noted Jackson continued to provide a number of resources to assist employees with mental health issues, self-care and spiritual support. Mr. Migoya mentioned that as a small token of appreciation, Jackson gave eligible employees hazard pay supplements, thanks to the County and Jackson teeming up together. He noted during this crisis, Jackson had leaned on the strong partnership it had built with the labor unions to provide the necessary and appropriate support for all employees. Mr. Migoya further noted the pandemic would have long lasting repercussions in the health care industry and to maintain care standards, Jackson was paying costly overtime and using agency nurses temporarily. He noted the recruitment team was hosting hiring events where jobs and incentives were offered on the spot with the goal of onboarding new employees to help stabilize staffing levels.
Mr. Migoya advised Jackson�s operating budget for the next fiscal year (FY) was based on the assumption that its patient and surgical volumes would return to normal, and that the County sales tax would normalize. He stated FY 2022 would bring the last huge spikes in capital spending associated with the Jackson Miracle Building Program to their budget. Mr. Migoya noted the events of the past year had proven why Jackson Health System was not just the best in South Florida but one of the best in the nation and expressed appreciation to the Board for its unwavering support.
Chairman Diaz thanked Mr. Migoya and PHT Board of Trustees Chairman Heffernan for the outstanding work performed by Jackson.
Commissioner Sosa commended Mr. Migoya for his leadership and his staff on their response to the COVID-19 pandemic. She referred to Item 11A3 under her sponsorship, which was adopted earlier in today�s (6/15) meeting relating to a Stand-alone Emergency Center in Commission District 6.
It was moved by Commissioner Sosa that Jackson be fully reimbursed for its expenses related to the administration of the COVID-19 vaccine from any legally available source of funds, including without limitation Cares Act or American Rescue Plan Act funds. The County Mayor or County Mayor�s designee was directed and authorized to take any action, including without limitation the reservation or payment of such funds, or execute any necessary documents to accomplish the purpose of the motion. This motion was seconded by Commissioner Regalado, and upon being put to a vote, passed by a vote of 13-0.
Commissioner Regalado offered an amendment for the Administration to set in reserve or pay, which Commissioner Sosa accepted.
Mayor Levine Cava clarified that Cares Act funding was available and would be directed.
Commissioner Regalado seconded the motion and upon being put to a vote, passed by a vote of 13-0.
Commissioner Souto thanked Mr. Migoya and his staff for the outstanding work being done at Jackson Health System.
Commissioner Garcia thanked Mr. Migoya, the Jackson board and staff for the work done during the pandemic and the work to ensure care was provided to the minority communities. He asked the Administration to ensure monies were placed appropriately to cover the cost that Jackson had with the vaccinations.
In response to Commissioner Garcia�s request, Mr. Migoya provided an update on the Direct Payment Program (DPP) approved by the Legislature and the Centers for Medicare & Medicaid Services (CMS). He noted the group that was working on the DPP was also working with the County Attorney�s Office on legally sufficiency so it could be brought to the Board before October 1, 2021. Mr. Migoya stated this could potentially bring in minimally $200 million to Miami-Dade County.
Commissioner Garcia stated it was important to obtain these funds for Miami-Dade County, not only to help Jackson but also the underserved population.
Chairman Diaz asked Commissioner Garcia to take the lead on this issue.
Commissioner Cohen Higgins thanked Mr. Migoya for everything he had done and suggested a healthcare heroes ticker tape parade be held honoring Jackson healthcare heroes.
Commissioner Regalado congratulated Mr. Migoya and Jackson staff. She inquired who had the direct pay item and Mr. Migoya said it was discussed at the Health, Emergency Management and Intergovernmental Affairs Committee and the county attorneys were currently working on it.
First Assistant County Attorney Gerald Sanchez stated Commissioner McGhee had the item and the county attorneys were researching the options as quickly as possible.
Commissioner Regalado offered to discuss this item in a Sunshine meeting with Commissioner McGhee, and to be a co-sponsor or co-prime sponsor. She requested the Administration provide a timeline on this item.
Commissioner Garcia concurred with holding a Sunshine meeting regarding this issue but noted there was a time constraint and this needed to be done by the end of July 2021.
Commissioner McGhee suggested holding a Sunshine meeting on Friday.
Mayor Levine Cava stated the Administration was supportive of the direct pay item and had reviewed it and there was no delay on the Administrative side. She noted this had been a partnership with Jackson and the PHT and she looked forward to continuing the strong partnership going forward.
Chairman Diaz asked the PHT Board members to stand and be recognized.

The foregoing proposed resolution before the Board was amended as outlined in Item 8F1 Supplement, Legislative File Number 211529, which provides that in lieu of a rent reduction, the Community Action and Human Services Department (CAHSD) will reinvest fifty percent of the funds received from this Lease Agreement back into the community as direct services. This will allow CAHSD to extend a variety of benefits to ARC clients including but not limited to ADA home enhancements, rental assistance, and food vouchers. All costs associated with the services rendered would be funded from the rent collected from the ARC starting in the second year of the Lease Agreement.

REPORT:
Commissioner Martinez questioned the need for a Construction, Engineering and Inspection (CEI) Consultant for the Infrastructure Renewal Projects (IRP) projects, and the Metrorail Acoustical Barrier Replacement Project.
Mr. Jimmy Morales, Chief Operations Officer, Officer of the Mayor, stated he was informed the DTPW did not have the capacity to do the projects in-house.
Mr. Frank Aira, Division Chief, Department of Transportation and Public Works (DTPW), explained the CEI was necessary as the work was accelerated.
Ms. Namita Uppal, Chief Procurement Officer, Internal Services Department, commented on the proposed resolution and stated 16 different types of classification were included in the proposed Professional Services Agreement.
Commissioner Martinez indicated he would not support the proposed resolution.
Chairman Diaz stated the Board needed clarification on the requirements based on Federal and State guidelines. He referred to pending legislation under his sponsorship regarding these kinds of projects and commented that projects appeared to be taking longer as consultants were being paid hourly. Chairman Diaz asked the Administration to review how consultants could be paid in a lump sum rather than hourly.
Mr. Aira stated DTPW was seeking permission from the Department of Transportation (DOT) to perform some of the smaller work in-house. He noted the Federal Transit Administration (FTA) would allow DTPW to perform the work provided a plan was submitted on how it would be accomplished. Mr. Aira stated negotiating a lump sum for small roadway projects could be done, but would be difficult for larger projects and large design build projects.
Commissioner Higgins stated it was critical that the acoustical panels be installed along the Metrorail system in order to have a quieter system; and proper inspection and oversight was needed. She noted there was a right time to hire consultants because it was less expensive than hiring a full-time employee.
There being no further questions or comments, the Board then proceeded to vote on the foregoing proposed resolution, as presented.

REPORT:
Commissioner Cohen Higgins requested confirmation whether the South Florida Workforce Investment Board (SFWIB) was a County board; and if it was not, why was the Board of County Commissioners� approval required for the fourth Amendment to the Interlocal Agreement. She inquired whether speakers appearing for public comment at the SFWIB meetings could appear via telecommunications.
Assistant County Attorney Shanika Graves advised the SFWIB was a State Board that was created pursuant to State and Federal law. She noted the State law that authorizes the SFWIB, provides for meetings to be held using telecommunications, and members of the public who were provided a reasonable opportunity to speak at the meeting, if telecommunications were used, they would also be provided that opportunity. Assistant County Attorney Graves advised at this point, there had not been any meetings outside of the meetings that were authorized pursuant to the Governor�s Executive Orders for telecommunications.
A representative of the SFWIB, stated the intent was to provide any SFWIB member who did not have the opportunity to participate, the flexibility to participate; however, the meetings continued to be in-person.
There being no further questions or comments, the Board then proceeded to vote on the foregoing proposed resolution, as presented.

REPORT:
In response to Commissioner Martinez� concerns that a traffic study was not conducted, Chairman Diaz, sponsor, advised that a traffic study would be forthcoming once the project was implemented. He stated that he would not allow the project to be done without the proper streets and widening.
Mr. Jimmy Morales, Chief Operations Officer, Officer of the Mayor, commented on the processes that were involved with the development project, including a site plan approval. He noted a traffic impact analysis would be done during the site plan approval.
Commissioner Sosa stated she was pleased that this was a competitive selection process.
Chairman Diaz stated this would be a legacy project and would include a certain amount of housing units for military personnel.
There being no further discussion, the Board proceeded to vote on the foregoing proposed resolution, as presented.
