  REPORT: Prior to the roll call, Clerk of the Board Director, Melissa Adames, announced that Commissioner Heyman submitted written notice of her absence from today�s (7/8) Board of County Commissioners (Board/BCC) meeting.
Following the posting of the colors by the United States Army Reserves, 810th Military Police Company, Detachment 2; Chairman Diaz convened the Board of County Commissioners (Board/BCC) meeting at 9:34 a.m.; followed by a moment of prayer led by Vice Chairman Gilbert, III and the Pledge of Allegiance.
The following Board members were present at roll call: Chairman Diaz, Vice Chairman Gilbert III, Commissioners Cohen Higgins, Garcia, Higgins, Monestime, Regalado, and Sosa.
In addition to the members of the Board, the following staff members were also present:

1G REASONABLE OPPORTUNITY FOR THE PUBLIC TO BE HEARD AS PROVIDED IN RULE 6.06  
  REPORT: County Attorney Geri Bonzon-Keenan announced in accordance with Rule 6.06 of the Board�s Rules of Procedure, members of the public would now have the reasonable opportunity to be heard regarding non-public hearing propositions before the Commission which had not been subject to a previous opportunity to be heard. She noted that members of the public would be given an opportunity to speak on public hearing items under Section 5 of the Agenda when the item was called.

Chairman Diaz opened the reasonable opportunity for the public to be heard, and the following persons appeared before the Board:

1. Truly Burton, Executive Vice President for Builders Association of South Florida (BASF), 111 NW 183rd Street, Miami Gardens, Florida, spoke regarding the Surfside building collapse. She extended her condolences to the victims� families and recognized the efforts of the first responders, Miami-Dade County Mayor Levine Cava and the Board. Ms. Burton noted the BASF had assembled a working group of high rise builders, architects, engineers and condominium attorneys to participate in any task force assembled by the administration, Board, or State legislature and offered BASF�s expertise and help moving forward.

2. Ms. Kathleen Maiuri, Owner, Matrix 2 Advertising (M2A), 1903 NW 97th Avenue, Doral, Florida, appeared alongside Ms. Kimberly Haber, Vice President of Account Services M2A regarding Agenda Item 8F10.

3. Mr. Steven Williamson, Village Manager, Village of Key Biscayne, 3920 Palmarito Street, Coral Gables, Florida, appeared in support of Agenda Item 8H2.

4. Village of Key Biscayne Mayor Michael Davey, 50 Ocean Lane Drive, Key Biscayne, Florida, spoke in support of Agenda Item 8H2. He requested the Request for Proposal (RFP) allow bidders to provide alternative improvements to the bridges and roadways along Rickenbacker Causeway and requested the Village of Key Biscayne be involved in the selection and design process. Mayor Davey also contended the Rickenbacker and Venetian Way Causeway projects should be separated due to funding concerns.

5. Mr. Robert Herrada, Assistant City Manager, City of Sweetwater, 500 SW 109th Avenue, Sweetwater, Florida, spoke in support of Agenda Item 8M1.

6. Ms. Tanya Wilson, Planning, Zoning and Development Director, City of North Miami, 776 NE 125th Street, North Miami, Florida, appeared in support of Agenda Item 11A10.

7. Mr. Wisler Pierre-Louis, Public Work Director, City of North Miami, 776 NE 125th Street, North Miami, Florida, spoke in support of Agenda Item 11A10 and requested the City be included as a member of the Septic System Taskforce. He voiced his objections to Agenda Item 4E and stated more information was needed regarding the impacted roads.

8. Ms. Joan Rutherford, 1250 NW 64th Street, Miami, Florida, voiced her concerns regarding Agenda Item 7D and the rising cost of affordable housing units. She noted that while the cost of affordable housing units continued to rise, the median income remained the same and there had been a consistent decline in building quality and standards.

9. Ms. Christine Olivo, 6640 McCullen Street, Hollywood, Florida, echoed the concerns voiced by Ms. Rutherford regarding Agenda Item 7D and the proposed increase to the maximum sales price for affordable housing units.

10. Reverend W.J. Carpenter, Emmanuel Missionary Baptist Church, 1230 NW 79th Street, Miami, Florida, requested clarification regarding a notice he received to appear today at 9:30 a.m.

11. Ms. Gloria Pacheco, 1191 NW 8th Street Road, Miami, Florida, complained about the lack of maintenance at her rental residence and noted the building was overrun with rodents and insects.

12. Ms. Sharon Frazier-Stephens, 6324 NE 1st Place, Miami, Florida, spoke in opposition of Agenda Item 7D.

There being no other persons wishing to speak, Chairman Diaz closed the reasonable opportunity to be heard.
 
1H MOTION TO SET THE AGENDA AND "PULL LIST"  
  REPORT: County Attorney Geri Bonzon-Keenan advised in addition to Chairman Diaz�s Memorandum entitled �Changes Sheet�, the following changes to the agenda/and or requests were made:

~ Commissioner Cohen Higgins requested she be added to the pull list for Agenda Items 8F10 and 8O1;
~ Commissioner Sosa asked to be added to the pull list for Agenda Item 8H2;
~ Commissioner Regalado released her pull on Agenda Item 8I1 and requested she be added to the pull list for Agenda Item 11A11;
~ Commissioner Martinez asked to be added to the pull list for Agenda Item 11A16; and
~ Commissioner Higgins requested she be listed as the prime sponsor for Agenda Item 14A3.

County Attorney Bonzon-Keenan stated the items to be considered at today�s (7/8) Board meeting would be those listed in the printed final Agenda, with the additions, deferrals, withdrawals, and scrivener�s errors noted in Chairman Diaz�s Changes Memorandum, and the aforementioned items. She added that the Commission would approve all of those items by single vote; setting the agenda, except for the Chairman�s order of the day which provided for the Board to consider Discussion Item 6B1 at 11 a.m.; Discussion Item 6B2; ordinances for first reading; public hearing items; ordinances for second recording; commercial service airport contracts Agenda Items 8A1, 8A2, 8F6, 8F8 and 8F11; items subject to the 4-Day Rule under Section 14 and the following Pull List Items: 1I1, 8F1, 8F4, 8F10, 8F13, 8G1, 8H2, 8O1, 8O3, 11A2, 11A3, 11A6, 11A8, 11A11, 11A15, 11A16, 13A1, 15C2 and 15C2 Supplement, 14A1, 14A2 and 14A3.

Commissioner Martinez invoked the 4-Day Rule on Agenda Item 14A3.

Commissioner Sosa requested Agenda Item 11A15 be deferred on behalf of Commissioner Heyman.

Commissioner Higgins pointed out that Agenda Item 11A15 must be adopted by the Board in order to defer Agenda Items 5E and 5F.

Chairman Diaz moved to adopt Agenda Item 11A15 with the setting of the agenda.

Vice Chairman Gilbert, III objected to Agenda Item 11A15 being adopted with the setting of the agenda and requested he be added to the pull list for Agenda Item 8F10.

Commissioner Hardeman asked to be added to the pull list for Agenda Items 7A, 7D and 7F.

It was moved by Commissioner Sosa that the Board approve the July 8, 2021, meeting agenda with the changes listed in the Chairman�s memorandum and the additional changes and requests mentioned above. This motion was seconded by Commissioner Martinez and upon being put to a vote, passed by a vote of 11-0 (Commissioners Heyman and McGhee were absent.)

Commissioner Monestime read a statement regarding the recent assassination of Haiti�s President, Jovenel Moise, into the record, and noted the assassination resulted in violence and civil unrest in Haiti. He expressed concerns about the impact of the Coronavirus Disease 2019 (COVID-19) on the population and advised his colleagues that no vaccines had been administered to date. Commissioner Monestime indicated his intent to proffer an urging the President of the United States of America Joe Biden and the United States Congress to allocate funds to help cover the filing costs for Haitian and Venezuelan nationals seeking Temporary Protected Status (TPS); and also to urge the County to identify any available funds to help Community-Based Organizations (CBO) with TPS filings. He thanked his colleagues and the public for their support during this difficult time. (See Agenda Item 14A4 � Add-on)

Chairman Diaz observed a moment of silence in honor of late Haitian President Jovenel Moise.

  REPORT: Chairman Diaz announced the Board of County Commissioners would consider Discussion Item 6B1 at 11 a.m.

Chairman Diaz provided a prepared statement for the Surfside Tragedy on behalf of the victims, survivors, and first responders and he observed a moment of silence.

County Attorney Geri Bonzon-Keenan advised an active investigation was in progress for the Surfside Tragedy matter. She noted in some instances during the discussion representatives from different government agencies and departments, may not be able to comment on a particular issue.

Miami-Dade County Mayor Daniella Levine Cava thanked the first responders, Commissioners, Federal Emergency Management Agency (FEMA), and other governmental agencies. Mayor Levine Cava provided a PowerPoint presentation and statement of the Surfside Tragedy. She noted total information would be provided to the public to offer insight pertaining to the response and efforts accomplished by Miami-Dade County (MDC). Mayor Levine Cava presented the PowerPoint as follows:

Miami-Dade Police Director Freddy Ramirez

Mr. Freddy Ramirez, Miami-Dade Police Director thanked the men and women of the Miami-Dade Police and Fire Departments, Miami Beach, State of Florida Officials, and those who supported these efforts. He also acknowledged volunteers who provided meals to the first responders.

Mr. Ramirez indicated the primary scope was to support and assist the men and women of the Miami-Dade Fire-Rescue department (MDFR). He informed the Board three critical components for the Miami-Dade Police Department (MDPD) including the following:

~Building the Village with the command post and traffic pole led by Assistant Director Pat Handling.

~Assistant Director Stephanie Daniels created a family Assistant Center for the families.

~Ground zero homicide detectives, crime scene personnel, working with the fire rescue working to bring closure to the families. Rabbi, chaplains, and clergies brought comfort to the families.

Mr. Ramirez stated the evidence collection sites department would be working with the State Attorney�s Office and noted during victim recovery the focus would shift to a death investigation. He stressed the first goal was to locate the families, and the next goal was to find out why this tragedy occurred.

Community Action & Human Services Interim Director, Annika Holder

Ms. Annika Holder, Community Action & Human Services Interim Director, commented on the work-taking place at the Family Assistance Center. She noted Support Surfside was launched June 28 , 2021, four days after the tragic event. She noted staff has intently served families that included survivors and displaced families who were waiting to be notified. Ms. Holder stated the center met with people who may have worked in the building that was part of the unaccounted. She pointed out that everyone was extremely compassionate and the center had 12 navigators from the Florida Crisis Response Team, sitting with families to assess their needs and provide services. Ms. Holder noted there were providers set up to help families with driver-license replacement, copy of registration, Federal Emergency Management Agency (FEMA) lodging, or grief counseling, etc. She stated staff worked relentlessly, and stressed that mental health was a major component for families and many employees working ground zero. She emphasized that staff would ensure the families received structure and up to date long term support.

Chief Operations Officer, Jimmy Morales

Mr. Jimmy Morales, Chief Operations Officer, Office of the Mayor, noted his role was to provide and coordinate with the police and fire department for logistical support of the men and women engaged in the search and rescue effort, as well as the death investigation. He noted part of the requirements were to provide the moving machinery equipment to move the debris. Mr. Morales stated a procurement contract was developed for debris removal and pointed out the debris removal would make room for the rescue team to keep working, while for the crime scene investigators to examined the debris off site to find material evidence. . He noted the Florida Department of Transportation (FDOT) provided yearly hauling of the debris, and worked closely with Federal Emergency Management Agency (FEMA). Lastly, he assured that all expenses were eligible for reimbursement.

Mayor Levine Cava provided closing remarks regarding building audits being conducted across Miami-Dade County. She noted swift action needed to be taken on buildings that have not completed the forty year recertification. Mayor Levine Cava encouraged local cities to conduct their own building audits, and acknowledged the Cities of North Miami Beach and Miami Beach for conducting building audits. She indicated she was working with the Office of Emergency Management and the Red Cross to create a process for any future evacuations. Mayor Levine Cava also announced that she would be meeting with subjects from expert fields such as engineering, legal, construction, development, etc. to review building safety and to set recommendations for building changes. She announced she was co-chairing a group of leaders with Miami-Dade Board of County Commissioners� Chairman Jose �Pepe� Diaz using a unified intergovernmental approach on any reforms to come from this tragedy.

Florida Department of Emergency Management, Steve Hynes

Mr. Steve Hynes, Florida Department of Emergency Management, informed the Board the department of emergency management supported the local efforts on life safety and civilization. He noted the plan was to maintain presence at ground zero until it was closed out. Mr. Hynes stated so far the projected cost to support this endeavor was around $75 million of State resources, to which the State of Florida Governor, Ronald DeSantis was committed to support. He noted all State of Florida departments would continue to support Surfside and he added that FDEM would max out all opportunities for the cost of the recovery phase.

Federal Emergency Management Agency, Coordinating Officer, Tom McCool

Mr. Tom McCool, Federal Emergency Management Agency, Coordinating Officer, stated his job was to coordinate with all federal agencies to provide resources to the ongoing search and rescue to now search and recovery efforts. He provided his condolences to the victims and survivors of this surfside tragedy. Mr. McCool indicated he worked with Mayor Levine Cava and her exceptional team, Surfside Mayor Charles Burkett, Governor DeSantis, along with the Florida Department of Emergency Management. He stated all efforts were executed at the local and federal level with resources to support the search and recovery. Mr. McCool noted individual assistance was authorized by President Joe Biden as an emergency declaration, as well as working closely with the State, County, and City to manage that program. He also stated his agency was working closely with the residents for $100,000.00 in funding that was obligated to the survivors. Mr. McCool stated the Red Cross provided immediate mass care services, Federal Emergency Management Agency (FEMA) provided assistance to the families, and Small Business Administration (SBA) would provide low interest personal and business loans. He reported public assistance would also be provided for the debris removal.

Small Business Administration (SBA), Roberto Baltodano

Mr. Roberto Baltodano, Small Business Administration (SBA), provided his condolences to the Surfside community. He noted SBA had been on the ground since June 30th at the Family Assistance Center meeting with families in need. Mr. Baltodano stated he and staff met with 60 families and business. He noted from the 60 families and businesses 31 home loan applications were processed, 21 business loans were processed, and 17 applied for economic injury loans. Mr. Baltodano informed the Board that SBA was operating out of a business recovery center effective July 9, 2021. He encouraged the business community and individuals who were homeowners or renters affected by this disaster to reach out to SBA for assistance in obtaining affordable low interest long term federal disaster loans.

National Institute of Standards and Technology (NIST), Judith Mitrani-Reiser

Ms. Judith Mitrani-Reiser, National Institute of Standards and Technology (NIST) announced that NIST would be conducting a full technical investigation into the cause of the June 24, 2021partial collapse of the Champlain Towers South Condominium. She noted the investigation would be a fact finding and not fault finding ongoing investigation. Ms. Mitrani-Reiser indicated the investigation would take time and possibly several years to determine the cause of Champlain Tower partial collapse. She assured the Board NIST would not stop until a determination was found for the cause of the collapse. Ms. Mitrani-Reiser informed the Board NIST investigated numerous tragedies and learned from these events to better building codes, emergency response, and emergency communication efforts. She noted based on the information collected, it was recommended that a full technical investigation be conducted under the National Construction Safety Team Act. Additionally, she thanked all the agencies for their compassion, collaboration, and coordination during the Surfside tragedy.

Commissioners Gilbert III, Sosa, Garcia, Cohen-Higgins, Regalado, Souto, and Monestime thanked Mayor Levine Cava for her leadership, Miami-Dade Police and Fire Departments, Miami-Dade County Staff, Governor Ronald DeSantis and President Joe Biden for the unification of the state, local, and federal government. The Board offered their condolences and support to the families, as well as support to fire fighters in need of emotional counseling for post-traumatic stress disorder (PTSD). Also, the Commission cautioned there was an ongoing investigation and viewpoints should be delayed until after the investigation concluded.

Followed by the Commission comments, Chairman Diaz concluded by thanking Miami-Dade County Attorneys for their participation during the Surfside tragedy.

Chairman Diaz noted that this Board of County Commissioners would recess for lunch until 1:44 p.m.

  DISCUSSION ITEM REGARDING THE DIRECT PAYMENT PROGRAM Presented
  REPORT: Commissioner Garcia reviewed the importance and benefits of the Direct Payment Program (DDP).

Mr. Gino Santorio, Chief Executive Officer for Mt. Sinai Medical Center, noted Miami-Dade County represented 17 percent (17%) of all Medicaid enrollees. He explained the Medicaid system did not cover all medical costs and estimated the unpaid Medicaid shortfall amounted to $524 million annually. Mr. Santorio stated the DDP provided an opportunity to access approximately $300 million in federal funds which could be used by hospitals, employers and the County to offset the shortfall.

Dr. Sanjay Shetty, President of Steward Health Care North America (SHCNA), provided a brief overview of SHCNA and noted the company recently acquired four (4) hospitals in Miami-Dade County. He emphasized the importance of the DDP to providing healthcare to underserved communities particularly now during the Coronavirus 2019 (COVID-19) pandemic.

Ms. Dawn White, Vice President of Government and Community Relations for Baptist Health South Florida, welcomed the opportunity to work alongside the Board to finalize the program.

Ms. Dawn Javersack, Senior Vice President and Chief Financial Officer for Nicklaus Children�s Health System, spoke about the benefits of the DDP in recouping Medicaid shortfall expenses and the impact on services provided to patients.

County Attorney Geri Bonzon-Keenan provided a brief progress report on the status of the DDP.

Commissioner Garcia reiterated the importance of the program and the need to expedite and prioritize the item.

Commissioner Sosa indicated her support for the program and indicated her interest in being a co-sponsor for the legislative item.

Commissioner Regalado voiced her concerns about expediting the item and urged her colleagues to allow the matter to follow the legislative process. She also stated her interest in being a co-prime sponsor for the legislative item.

Vice Chairman Gilbert, III indicated his support for expediting the item and being listed as a co-prime sponsor for the legislative item.

Discussion ensued between Chairman Diaz and Commissioner Garcia regarding the various sponsorship requests.

County Attorney Bonzon-Keenan clarified that special taxing districts and assessments did not require a committee review.

Chairman Diaz and Commissioner Martinez requested they be added as co-sponsors on the legislative item.

~ To allow such additional distribution vehicles, excluding truck tractors and semitrailers, at a rate of 1 per 5 acres or fractional portion thereof, meaning that you round up to the next 5-acre increment and thereby allow one additional such vehicle per parcel;

~ To clarify the language excluding truck tractors and semitrailers from the additional distribution vehicle allowance;

  REPORT: Assistant County Attorney Leigh C Kobrinski noted the proposed lease agreement between the County and the Miami-Dade School Board (MDSB) (See Handwritten Page 153, Attachment 4, Appendix C of the Mayor�s Memorandum), inadvertently excluded a County facility where the MDSB had been providing Head Start and Early Head Start services since 2012, and announced the foregoing proposed resolution should be revised to amend the lease agreement to include the County�s Chapman Center South property located at 28205 S.W. 124 Court, Buildings K, L & M, Miami, Florida, Folio #30-7901-001-0010, and to allow the School Board to continue to occupy the property for this purpose.

  REPORT: Commissioner Martinez questioned the necessity of the contract given the specifications which did not include advertising costs.

Commissioner Cohen Higgins voiced her concerns regarding the cost of the proposed contract, noting a substantial increase from the previous contract amount. She inquired about the work done to date by The Weinbach Group (TWG), Inc. and whether advertising costs were included.

Ms. Marialaura Leslie, Deputy Director, Miami-Dade Cultural Affairs (CUA) Department, clarified that the proposed contract would allow TWG to assist the CUA to promote and disseminate information through marketing, advertising, media and public relations services; and confirmed advertising costs were not included in the contract.

Ms. Leslie explained the increased contract cost could be attributed to the reopening of the Joseph Caleb Auditorium which was currently under renovations. She noted the contract funded marketing and public relations services for events hosted at cultural facilities throughout the County including �All Kids Included�, Arts Resilient 305 and the Golden Ticket Arts Guide.

Commissioner Cohen Higgins voiced her concerns about outsourcing marketing and public relations services, particularly given the cost of the contract; and therefore did not support the item.

Ms. Leslie clarified that CUA worked closely with the County�s Communications Office and utilized in house services. She noted the foregoing contract provided supplemental support and resources for time sensitive events and performances.

Vice Chairman Gilbert, III concurred with Commissioner Cohen Higgins� reservations regarding the cost of the proposed contract and questioned the representation that the return of programming at the Joseph Caleb Auditorium would double the department�s monthly marketing budget. He expressed concerns regarding the effectiveness of the current marketing campaign and spoke about the need to diversify the message.

Commissioner Sosa echoed the concerns voiced by Vice Chairman Gilbert, III and Commissioner Cohen Higgins regarding the increased cost of the contract. She noted there were several municipalities that did not contribute to the Tourist Development Tax (TDT) and questioned whether these cities should benefit from the County�s marketing of events and programs in their area. Commissioner Sosa suggested deferring the item to further review the proposed contract.

Commissioner Souto concurred that County resources should not be used to promote programs and events in municipalities not contributing to the TDT.

  REPORT: Commissioner Regalado spoke to the importance of the foregoing item and requested a public meeting be scheduled before the Request for Proposal (RFP) was issued.

Commissioner Martinez voiced his concerns regarding the lack of information surrounding the unsolicited proposal.

Responding to Chairman Diaz�s question as to the type of project and proposal, Assistant County Attorney Monica Rizo explained that a request had been made for the unsolicited proposal to be advertised as a non-P3 (public-private partnership) qualifying project pursuant to the County�s P3 ordinance.

Chairman Diaz reasoned the proposal�s ambiguity was part of the unsolicited firms� efforts to protect proprietary information during the RFP process.

Discussion ensued between Chairman Diaz and Assistant County Attorney Rizo regarding the RFP process for unsolicited P3 projects.

Chairman Diaz reviewed the County�s P3 solicitation process and requested the RFP be brought before the Board before being published/advertised.

Commissioner Regalado inquired about the RFP solicitation timeframe and stated it was her intent to engage the community during the public hearing for input on what should be included in the RFP.

Assistant County Attorney Rizo explained under the State of Florida statute, the County was required to issue a solicitation within 180 days of receipt of an unsolicited proposal to maintain confidentiality throughout the process. She noted the 180 days in this case was set to expire at the end of August, therefore the RFP solicitation needed to be published before then. Assistant County Attorney pointed out the issuance of a RFP solicitation extended the confidentiality term until the administration made a recommendation regarding the award.

Chairman Diaz indicated his intent to amend the County�s existing P3 solicitation policy to address confidentiality concerns and require the RFP to be brought before the Board before publication.

Commissioner Garcia argued that everyone using the Rickenbacker Causeway, including pedestrians and bicyclists, should be required to invest into the infrastructural improvements/project.

Responding to Commissioner Sosa�s questions, Ms. Maria Nardi, Director, Miami-Dade Parks, Recreation and Open Spaces (PROS) advised the Board members that the Rickenbacker Causeway was situated on County-owned land and noted that tolls could not be increased or imposed without Board approval.

Commissioner Hardemon read a portion of the foregoing proposed resolution into the record and contended discussions regarding funding and implementation of tolls were premature given the scope of the item.

Commissioner Regalado spoke to the safety and infrastructural issues affecting Rickenbacker Causeway and Bear Cut Bridge. She stated her primary concern was the safety of residents and emphasized the importance of exploring the unsolicited proposal.

Vice Chairman Gilbert, III indicated his support for the item and argued the bridges� infrastructural problems were a County-wide issue. He commented on the Board�s role to serve the Miami-Dade community and not just individual commission districts.

Discussion ensued between Commissioners Cohen Higgins and Regalado about the public hearing to seek community input prior to the issuance of the RFP.

Chairman Diaz commented on the P3 solicitation process.

Discussion ensued among the Board members and Assistant County Attorney Rizo regarding the motion before Board.

There being no other comments or objections, the Board members proceeded to on the foregoing resolution, as presented.
Commissioner Souto argued maintenance and operation of the Rickenbacker Causeway should be transferred to the State of Florida given the proximity to Bill Baggs Cape Florida State Park. He also contended that all County public parks should be free to Miami-Dade residents.

  REPORT: Commissioner Garcia commented on the number of items coming before the Board requesting term extensions or change orders for additional funds. He questioned whether there was a problem with the original scope of such items and what could be done to improve the process.

Commissioner Cohen Higgins asked whether the Board would make the final determination as to whether the foregoing contract should be cancelled for cause, versus cancelled for convenience.

Mr. Roy Coley, Director, Miami-Dade Water and Sewer Department (WASD), explained in the event the cancellation involved a settlement for time and money, the matter would be brought before the Board for consideration. He noted a change of cancellation from cause to convenience, remained under the purview of the department director.

Discussion ensued between Commissioner Cohen Higgins and Mr. Coley regarding the timeframe for the cancellation.

Commissioner Sosa voiced her concerns regarding the delay in the project and the lack of communication and information provided to the public and herself, as the District Commissioner.

Chairman Diaz urged Mr. Coley to meet with District Commissioner Sosa regarding the status of the project.

There being no further comments or questions, the Board members proceeded to vote on the foregoing resolution, as presented.

  REPORT: Commissioner Sosa stated she could not support the foregoing item and emphasized the importance of local preference, particularly now as the County continued to recover from the fiscal impact of the Coronavirus Disease 2019 (COVID-19) pandemic.

Commissioner Hardemon reviewed the intent of the foregoing item and stated that while he recognized the merits of the proposed resolution, he concurred with the concerns raised by Commissioner Sosa regarding the lack of reciprocity from other jurisdictions.

Commissioner Regalado suggested the foregoing resolution include a memorandum of understanding (MOU) component to help establish goals on reciprocity.

Chairman Diaz indicated his support for the foregoing item but cautioned his colleagues that the local preference reciprocity idea had been unsuccessfully considered by the Board in the past.

Vice Chairman Gilbert, III voiced his support for the item and suggested the foregoing item include a review of the benefits of the combined purchasing power among the counties.

Commissioner Garcia acknowledged the concerns and comments made by his colleagues.

It was moved by Commissioner Garcia that the foregoing proposed resolution be adopted as amended to review regionalized purchasing power between Dade County, Broward County, Monroe County, and Palm Beach County. This motion was seconded by Commissioner Gilbert III, and upon being put to a vote, the vote passed by a vote of 9-0 (Commissioners Heyman, Martinez, McGhee and Higgins were absent)

  REPORT: Vice Chairman Gilbert, III expressed his reservations about the need for a Community Redevelopment Agency (CRA) to develop North Miami Beach and pointed out the City of Miami Beach (CMB) did not participate in the County�s Homeless Trust program.

Chairman Diaz commented on the importance of the extensions.

Commissioner Higgins noted that she requested the CMB to include dedicated funding for affordable housing and moved to defer the foregoing item.

Commissioner Higgins clarified her intent was to adopt the foregoing resolution.

Commissioner Sosa indicated her support for the item and read into the record various homeless programs funded by the CMB.

Vice Chairman Gilbert III stated that while he recognized the various voluntary donations made by the City of Miami Beach to homeless programs, he believed the CMB should be active participants in the County�s Homeless Trust program.

Responding to Commissioner Monestime�s request for clarification regarding the need for the extension, Mr. Jorge Fernandez, Deputy Director, Office of Management and Budget (OMB), explained Resolution No. R-619-20 was adopted by the Board of County Commissioners (Board) on July 8, 2020, and created the North Beach Community Redevelopment Agency (Agency) which provided a sunset period of one (1) year in the event the City had not approved a redevelopment plan and interlocal agreement acceptable to the County; and the County had not approved said plan. He noted that while the plans and interlocal agreements had been completed by the CMB (See Agenda Items 5E and 5F), Commissioner Heyman requested the items be deferred to the July 20, 2021 Board of County Commissioners (Board) meeting, therefore the extension was needed.

Chairman Diaz noted Agenda Item 11A8 was also requesting an extension for similar reasons.

Vice Chairman Gilbert, III concurred with Commissioner Martinez�s comments regarding the ambiguity of the Mayor�s memorandum, and voiced his concerns about expanding the existing employment screening exemptions lists to include Miami-Dade Fire Rescue Dispatchers.

Commissioner Regalado contended there were certain types of arrests which should be excluded from the screening process.

County Attorney Geri Bonzon-Keenan noted the foregoing proposed resolution was an �add-on� item and could be consider along with other items on the pull list.

Commissioner Regalado moved that the foregoing proposed resolution be added to today�s (7/8) BCC Agenda for consideration. This motion was seconded by Chairman Diaz upon being put to a vote, passed by a vote of 7-0 (Vice Chairman Gilbert III, Commissioners Hardemon, Heyman, Higgins, McGhee and Souto were absent).

Commissioner Monestime reviewed the intent of the foregoing item.

Chairman Diaz opened the reasonable opportunity for the public to be heard on the foregoing item, and seeing no one come forward, he closed the reasonable opportunity to speak.

Discussion ensued among Chairman Diaz, Vice Chairman Gilbert, III and Commissioner Monestime regarding possible funding sources for the item.

Commissioner Hardemon spoke about the importance of advocating for simplifying the Temporary Protected Status (TPS) process and fee waivers for applicants.

Commissioner Monestime noted the lack of funding and resources severely limited Community Based Organizations (CBOs) and emphasized the need for identifying alternative funding sources.

  REPORT: Commissioner Regalado read into the record a motion (See attached Exhibit) to authorize the Miami-Dade County Attorney�s Office to join in and support the City of Coral Gables� decision to appeal a �spot zoning issue� decision which may impact future Board of County Commissioners (Board/BCC) zoning matters.

Assistant County Attorney Dennis Kerbel reviewed the elements of the pending appeal and explained the City of Coral Gables requested the County�s Attorney�s Office (CAO) to appear in an amicus capacity to support the argument that a variance should not be considered �spot� zoning.

Vice Chairman Gilbert, III stated he would support the item in this instance given the time sensitivity of the matter, but voiced his concerns about the County being a party to a litigation with limited information. He requested the Board be provided information regarding such matters prior to the item being presented for consideration on the dais.

Discussion ensued between Vice Chairman Gilbert, III and Commissioner Regalado regarding the County�s appearance as an amicus.

Commissioner Hardemon indicated his limited support for the item and echoed Vice Chairman Gilbert, III concerns regarding the lack of background information on the issue.

Commissioner Cohen Higgins voiced her concerns regarding the availability of County resources to prepare the amicus brief and inquired about the timeframe for completing the brief.

Assistant County Attorney Kerbel assured the Board members that the CAO�s was available to file the brief and noted the deadline for filing the brief was July 12, 2021.

Commissioner Regalado explained the importance of the County�s involvement at this time given the Appellate Court�s �spot� zoning finding without proper due process.

There being no further comments or questions, the Board members proceeded to vote on the foregoing resolution, as presented.
