Ben Simon practices primarily in the Office's Tort and Medical Malpractice section, and also handles matters relating to the Miami-Dade Police Department and Corrections and Rehabilitation Department.

As a litigator, Ben has handled cases at both trial and appellate levels defending the Public Health Trust in personal injury and medical malpractice actions, as well as defending Miami-Dade County in personal injury, false arrest, replevin, malicious prosecution, property damage, and excessive force cases.

Ben previously worked in the State Attorney's Office and litigated and tried numerous criminal cases as a prosecutor, involving a wide range of offenses including DUI, reckless driving, burglary, sexual battery, trafficking in controlled substances, grand theft, domestic violence, aggravated battery, and attempted murder.

Prior Experience

Assistant State Attorney, Office of the Miami-Dade County State Attorney, 2003-2006, where he served as a supervisor in the misdemeanor criminal traffic and DUI unit as well as a division prosecutor in the felony unit.
