  REPORT: Chairman Diaz convened the meeting at 9:30 a.m. and the Board of County Commissioners (hereafter refered to as the Board) observed a moment of silence.

  REPORT: In addition to the members of the Board and the Honorable Miami-Dade County Mayor Daniella Levine Cava, the following staff persons were present: Chief Operations Officer Jimmy Morales; Chief Public Safety Officer J.D.   SPECIAL PRESENTATION OF COMMISSION DISTRICT 6 VILOMAH AWARD TO MR. OSCAR P. ORTIZ AND MRS. ROSA ORTIZ Presented
  REPORT: Commissioner Sosa commemorated the life of Sebastian Ortiz, a County youth, who battled cancer and passed away on December 29, 2016. After her presentation, she announced that a portion of Curtiss Parkway in Miami Springs, was renamed Sebastian Ortiz Way.

Commissioner Sosa also presented on behalf of County Commission District 6 a Vilomah Award to Sebastian�s parents, Mr. Oscar Ortiz and Mrs. Rosa Ortiz. The award honored Sebastian and the work his parents continued in the fight against cancer through the Sebastian Strong Foundation.

Miami-Dade County Mayor Daniella Levine Cava also commemorated the Ortiz family for their fight against cancer.

Mr. Ortiz accepted the award and thanked the County Mayor and the Board for the honor. He also called for more awareness about pediatric cancer and improved medical treatments for the disease.

  PRESENTATION OF A PROCLAMATION DECLARING OCTOBER 21, 2021 AS �IMAGINE A DAY WITHOUT WATER�(Mayor) Presented
  REPORT: Commissioner Regalado spoke about the national education campaign �Imagine a Day Without Water� and the need to invest in the County�s water infrastructure system.

Mr. Roy Coley, Director of the Miami-Dade Water and Sewer Department (WASD), thanked Miami-Dade County Mayor Daniella Levine Cava and the Board members for raising awareness and the work done by the WASD.

Mr. Lee Hefty, Director of the Miami-Dade Department of Environmental Resources Management (DERM), said it was important to protect the water in the County for the good of all.
Ms. Carmen Baker, Deputy Director of WASD, voiced the importance of preserving the County�s natural water sources.

Chairman Diaz thanked Commissioner Regalado and WASD�s and DERM�s employees for their work to preserve and protect the County�s water.
Commissioner Regalado presented to Messrs. Coley and Hefty a proclamation which declared October 21, 2021, as �Imagine a Day Without Water�.

  SPECIAL PRESENTATION IN RECOGNITION OF THE 10TH ANNIVERSARY OF URBAN HEALTH PARTNERSHIPS(Mayor) Presented
  REPORT: Miami-Dade County Mayor Daniella Levine Cava recognized the tenth anniversary of the Urban Health Partnerships (UHP) and its accomplishments. Among the UHP�s achievements were community-led projects in the County�s neighborhoods, increased United States Census participation, expanded healthcare services for residents during the coronavirus disease 2019 (COVID-19) pandemic, and their work in the �I Did It!� campaign, which encouraged people to get COVID-19 vaccinations.

Ms. Andrea Iglesias, Chief Executive Officer and Executive Director of UHP, and Ms. Ana Maria Ferreira, Co-Founder of UHP, accepted a proclamation presented by Mayor Levine Cava in recognition of the organization�s service. Ms. Iglesias thanked the County Mayor and the Board members for the recognition.

  CITIZEN'S PRESENTATION BY THE MIAMI-DADE FIRE RESCUE K-9 PEER RESPONSE UNIT AND FOUNDATION Presented
  REPORT: Commissioner Heyman gave a presentation about Miami-Dade County Fire Rescue Department�s (MDFR) K-9 Peer Response Unit. She provided information about the K-9 Unit, which was a pilot program that offered emotional support for firefighters and first responders. Commissioner Heyman stressed that firefighters dealt with high occupational stress, and the K-9 Unit alleviated these mental health issues and reduced the suicide rate.

Commissioner Heyman reported that a foundation was created to raise funds for the K-9 Unit and to increase awareness throughout other fire departments.

MDFR Division Chief Willie Williams, Emergency Medical Services (EMS), thanked the MDFR employees and praised MDFR Captain Shawn Campana, who helped create the pilot program.

Captain Campana recalled how she and Charlie, a K-9 Unit therapy dog that attended the presentation had responded to the building collapse of Surfside�s Champlain Towers South on June 24, 2021. She reported that the need for the K-9 Unit�s services increased at the site as the dogs provided emotional support to firefighters, other personnel, and families affected by the disaster. Captain Campana thanked Commissioner Heyman and MDFR�s employees, especially the K-9 Unit.

Commissioner Heyman thanked the County Mayor, her colleagues, MDFR�s personnel involved with the K-9 Unit, the Miami-Dade Animal Services Department and the Humane Society. Commissioner Heyman also mentioned that the K-9 Unit inspired the fire department of Eugene, Oregon, to create a similar program.

Chairman Diaz commended Commissioner Heyman and acknowledged the value of the K-9 Unit.
 
1F REPORTS OF OFFICIAL BOARDS  
1G REASONABLE OPPORTUNITY FOR THE PUBLIC TO BE HEARD AS PROVIDED IN RULE 6.06  
  REPORT: County Attorney Geri Bonzon-Keenan announced that, in accordance with Rule 6.06 of the Board�s Rules of Procedure, members of the public would now have the reasonable opportunity to be heard regarding non-public hearing propositions before the County Commission not subject to a previous opportunity to be heard. She noted that members of the public would be given an opportunity to speak on public hearing items under Section 5 of the agenda when the item was called.

Chairman Diaz opened the reasonable opportunity for the public to be heard, and the following individuals appeared before the Board to speak:

1. Ms. Marcela Perez, 150 SE 25 Road, Miami, Florida 33129, voiced concerns about a deteriorating seawall structure in her neighborhood. She faulted the City of Miami for not repairing the structure and asked the County to resolve the issue.

2. Ms. Dolores Gutierez, 150 SE 25 Road, Miami, Florida 33129, also spoke about the need to repair the seawall structure in her neighborhood.

3. Mr. Sherman Rattner, 1809 Brickell Avenue, Miami, Florida 33129, President of the 1809 Tenants Association, advocated for affordable housing for seniors.

4. Mr. Stanley Young, 1180 NW 99 Street, Miami, Florida 33150, a minister and advocate for the homeless who spoke against evictions in the County.

5. Mr. Robert Blake, 3182 NW 59 Street, Miami, Florida 33142

6. Ms. Charlotte Blake, 3182 NW 59 Street, Miami, Florida 33142

7. Ms. Stacey Glassman Mizener, 4529 Royal Palm Avenue, Miami Beach, Florida 33140, Executive Director of the Sabrina Cohen Foundation, spoke in support of Agenda Item 11A3, which supported the construction of the Sabrina Cohen Adaptive Recreation Center in Miami Beach. She read a statement from Ms. Cohen who thanked the County and also supported the item.

8. Mr. Jose Gonzalez, 700 NW First Avenue, Miami, Florida 33136, supported Agenda Item 11A6

9. Ms. Magdalena Rodriguez, 230 Sunrise Drive, Key Biscayne, Florida 33149, a former veterinarian at the Miami Seaquarium, spoke in support of Agenda Item 8H1.

The following individuals appeared before the Board to speak against Agenda Item 8H1, the animals� plight at the Miami Seaquarium, and request the lease agreement be terminated:

1. Mr. Jared Goodman, 2154 West Sunset Boulevard, Los Angeles, California 90026, represented People for the Ethical Treatment of Animals (PETA)

2. Ms. Melanie Johnson, 801 21 Street South, Arlington, Virginia 22202, represented PETA

3. Ms. Pamela Loureiro, 1618 Michigan Avenue, Miami Beach, Florida 33139, represented PETA

4. Ms. Yennifer Martinez, 1618 North Michigan Avenue, Miami Beach, Florida 33139, represented PETA

5. Ms. Yarixel Vivanco, 814 NW 36 Avenue, Miami, Florida 33125, represented PETA

6. Ms. Patricia Leon, 495 Brickell Avenue, Miami, Florida 33131

7. Mr. Richard Winograd, 495 Brickell Avenue, Miami, Florida 33131

8. Ms. Xiomara Mordcovich, 9420 West Flagler Street, Miami, Florida 33174

9. Ms. Lilliana Torreh-Bayouth, 2543 Lincoln Avenue, Coconut Grove, Florida 33133

10. Ms. Sylvia Grimaldi Gomez, 9920 North Kendall Drive, Miami, Florida 33176, read a statement from the Lummi Nation which requested that Lolita, the killer whale at the Miami Seaquarium be released into the wild.

There being no other persons wishing to speak, Chairman Diaz closed the reasonable opportunity to speak.
 
1H MOTION TO SET THE AGENDA AND "PULL LIST"  
  REPORT: County Attorney Geri Bonzon-Keenan stated that, in addition to Chairman Diaz�s memorandum entitled �Changes Sheet,� Agenda Items 14A5 and 15C1 were on the �Pull List� and both had supplements, which were also added to the �Pull List.� County Attorney Bonzon-Keenan announced the following requests were made:

� Commissioner Gilbert requested Agenda Item 11A4 be pulled;

� Chairman Diaz, Commissioners Martinez, Regalado, and Garcia requested Agenda Item 11A9 be pulled;

� Commissioner Hardemon requested Agenda Item 11A5 be pulled; and

� Commissioner Heyman requested to be a co-sponsor of Agenda Item 11A3.

County Attorney Bonzon-Keenan stated the items to be considered at today�s (10/19) meeting would be those listed in the printed final agenda with the additions, deferrals, withdrawals, and scrivener�s errors noted in Chairman Diaz�s memorandum and the aforementioned requests. She noted the Board would set the agenda by approving all of the items by a single vote, ordinances for first reading, public hearing items, items subject to the Four-Day Rule under section 14 of the agenda, and the following �Pull List� items: Agenda Items 8F1, 8H1, 11A1, 11A4, 11A9, 14A1, 14A2, 14A3, 14A4, 14A5 and its supplement, 15B1, 15C1 and its supplement.

Commissioner Higgins moved that Agenda Items 14A1, 14A2, 14A3, 14A4, 14A5 and 14A5 Supplement be adopted; Commissioner Sosa seconded the motion, and there being no further questions or comments, the motion was put to a vote and passed by a vote of 13-0.

It was moved by Commissioner Sosa that the Board approve today�s (10/19) agenda with the changes listed in the Chairman�s memorandum and the additional changes mentioned above. This motion was seconded by Commissioner Heyman, and upon being put to a vote, passed by a vote of 13-0.

  REPORT: Commissioner Monestime addressed concerns expressed by the Board members during the October 5, 2021, Board meeting regarding the impact of lowering the parking requirements for certain developments providing workforce housing developments adjacent to single-family residences.

Commissioner Monestime noted that in the amended item parking reductions were limited to ten percent of multi-family developments with fifty or more workforce housing units in areas located within 500 feet of single-family neighborhoods. He also said the reductions applied to workforce housing units located within 660 feet of transit corridors. Additionally, workforce-housing units not located near single-family residences would be subjected to reduced parking by twenty five percent as per Miami-Dade County Code.

It was moved by Commissioner Monestime that the foregoing proposed ordinance be adopted, as amended, and outlined in Agenda Item 7A Supplement. This motion was seconded by Chairman Diaz, and upon being put to a vote, passed by a vote of 11-2 (Commissioners Garcia and Martinez voted no).

  REPORT: Commissioner Heyman sought clarification about the foregoing proposed resolution�s authorization to provide additional expenditure authority to public-private partnership (P3) infrastructure and advisory services for the departments listed in the item. She voiced concerns that the County increasingly used P3 services; and this contractually involved the County with several vendors for financial services, which could be provided by Miami-Dade County Attorney�s Office, the Miami-Dade Finance Department (MDFD), the Miami-Dade Audit and Management Services, and the Miami-Dade Office of Management and Budget. She questioned the justification for the expanded use of P3s.

Mr. Alex Munoz, Director of the Miami-Dade Internal Services Department (ISD), explained the item added funding for an existing pool of services for the Miami-Dade Parks, Recreation and Open Spaces Department, PortMiami, and the Miami-Dade Department of Transportation & Public Works (DTPW). He added the use of the P3 model provided expertise for project analysis for third-parties, objectivity, and alternate delivery methods.

Miami-Dade Chief Financial Officer Edward Marquez confirmed P3s provided expertise and detailed analyses that the MDFD could not provide due to limited staffing and the lack of expertise in certain areas like bond transactions.

Commissioner Heyman acknowledged the complexity of the projects and the need for outside expertise. She also suggested the P3s should incur some of the costs since the County used their services frequently. She voiced her support for the item, and noted a clear explanation of the item�s complexity needed to be included as part of the item and discussed before it was presented before the Board.

Miami-Dade County Mayor Daniella Levine Cava said that P3 services were used by the County because of the need for consultants for complex transactions. She noted the County preferred to use the consulting services of an external party to provide objective reviews for complex financial arrangements.

Commissioner Martinez opined the MDFD should be able to perform these tasks, such as evaluating the Miami Beach Corridor project, and questioned the need for the use of P3 consultant services. He asked about the number of years the County contracted a consultant for a project.

Mr. Munoz replied that a consultant for the Miami Beach Corridor project was hired in 2019.

Mr. Eulois Cleckley, Director of DTPW, said the consultant hired for the Miami Beach Corridor project had worked on Phase I of the procurement process by submitting financial analysis and proposal reviews.

Commissioner Martinez would not support the item.

Mr. Marquez explained the rating process mandated the use of third-party consultants for bond transactions. He added the work done by the consultants was usually less than one percent of the transactional costs.

Mr. Munoz told Commissioner Monestime that the work done by the P3 consultants were work-order based for specific projects.

Commissioner Sosa spoke of the importance of the item in regards to a Miami Seaport fumigation project and asked about the amount of the grant it had received.

Miami Seaport Deputy Director Hydi Webb said Miami Seaport was awarded a $33.5 million grant for the project.

Commissioner Higgins commented that the P3 consultant services enabled the County to quickly work on its large amount of projects.

Chairman Diaz noted that any issues with the item should have been addressed before it came to the Board, including verification of the proposal�s details. He added that the intellectual information of projects should be protected within the County�s departments. He concluded that projects requiring third-party verification needed errors and omissions insurance.

There being no other comments, the Board proceeded to vote on the foregoing proposed resolution as presented.

  REPORT: Miami-Dade County Mayor Daniella Levine Cava presented the foregoing proposed resolution relating to the assignment of lease from Festival Fun Parks, LLC, to MS Leisure Company, Inc., through its parent The Dolphin Company, for the premises known as Miami Seaquarium. She stated this lease assignment would provide better scrutiny and oversight over the park�s operations, which had fallen into disrepair.

Mayor Levine Cava expressed her concerns over the welfare of the animals at the park, including Lolita the killer whale. She stated the animals� health and safety were the County�s top priority and acknowledged the park�s infrastructure needed immediate repairs. Mayor Levine Cava noted an inspection from the United States Department of Agriculture (USDA) revealed violations that needed to be addressed and assured the Board that the County would expand its oversight role by increasing the amount of inspections.

Mayor Levine Cava said The Dolphin Company would be able to make the needed infrastructure improvements to the Miami Seaquarium and held the animals� welfare in high regard. Mayor Levine Cava summarized the company would be transparent, make necessary changes in the facility, and aggressively monitor the animals.

Mr. Will Elgar, Director of Zoo Miami, stated The Dolphin Company had extensive expertise in the operation of zoos� and aquariums� facilities throughout the world and were accredited by several agencies, including the Association of Zoos & Aquariums (AZA). He added that the Dolphin Company was committed to securing accreditation from AZA for the Miami Seaquarium and noted the company was focused on animal welfare and conservation. Mr. Elgar also stated the Dolphin Company had the resources to care for Lolita and the park�s other animals.

Mr. Elgar concluded that the company was dedicated to future lease amendments which included continued compliance to all applicable federal laws such as the Animal Welfare Act, acquiring and maintaining applicable certifications, implementing and participating in conservation awareness initiatives and programs, and providing annual updates on animal welfare management and infrastructure improvements.

Commissioner Regalado commented on the poor conditions at the Miami Seaquarium that severely affected the animals, and the USDA released a report in that regard. She voiced her support for the item and satisfaction with the company.

As requested by Commissioner Regalado, Assistant County Attorney Melanie Spencer announced the foregoing item should be amended as follows:

1. �to amend the amended and restated lease documents for the Miami Seaquarium to include language to require the following and to authorize the Mayor or designee to take on necessary steps to effectuate such amendment, including but not limited to the execution of the lease amendment;

2. to add language to say that the lessee shall comply with the Animal Welfare Act and would maintain an active USDA Class C Exhibitor license. All certifications including, but not limited to certification from the American Humane, shall be maintained and the lessee shall commit to seeking Association of Zoos & Aquariums accreditation. The lessee shall implement a conservation, education, and awareness campaign program for the community, including the incorporation of environmental protection, science conservation, and other educational programs into a classroom curriculum; and

3. the lessee shall be required to provide an updated animal welfare plan for the marine mammals, infrastructure maintenance, and improvement plans to the County on a quarterly basis. The lessee shall be required to provide copies of any reports, letters, or correspondence from or to any state or federal agency related to the management and operation of the leased premises to the County immediately upon receipt of such by the leasee, and finally the leasee would be obligated to create a program for neurodivergent children and adults."

Commissioner Regalado stated that the County was unaware of the severity of the problems at the Miami Seaquarium and the proffered amendments were intended to address the park�s issues and document how the park should be operated by the company. She added the amendments ensured the lease would be honored and enabled the County to take immediate action if needed.

Commissioners Sosa and Martinez voiced their support for the item and The Dolphin Company.

Mr. George Navarro, a representative of The Dolphin Company, said the company looked forward to working with the County. He also confirmed The Dolphin Company accepted the proposed amendments.

It was moved by Commissioner Regalado that the foregoing porposed resolution be adopted as amended. This motion was seconded by Commissioner Sosa, and upon being put to a vote, passed by a vote of 13-0.

The amended version of this Resolution has been assigned R-991-21.

  REPORT: Commissioner Gilbert, III, opined the item�s language was not clear regarding persons who faced misdemeanor charges if they approached and indirectly harassed police officers while they conducted arrests. He added the item prevented persons from observing and filming police officers making arrests, which they had the right to do.
Following a discussion among the Board members regarding the item�s intent; Commissioner Martinez said the item did not prevent people from filming police officers.

Commissioner Cohen Higgins raised concerns about the thirty-foot distance individuals had to maintain from police officers at arrest sites as required by State of Florida�s House Bill 11, which was supported by the item. She opined the distance was too long for someone to be subjected to arrest over vague harassment allegations by the police.

Commissioner Martinez stated the distance allowed police officers enough time to react to potential danger from observers. He police officers had the right not to be harassed or hindered by witnesses and observers; and to support his viewpoint, Commissioner Martinez recalled an example of an unnamed individual who habitually harassed police officers at various locations in the County as they arrested suspects.

Commissioner Heyman commented that, based on her study of section 1 of the item, individuals would only be charged after being warned by police officers and had demonstrated the intention to provoke or harass the police officers.

Commissioner Hardemon gave a physical demonstration of the actual thirty-foot distance noted in the item to support his observation that the distance was too far between a witness and a police officer. He opined that the legislation impeded the rights of witnesses and could lead to police officers abusing the thirty-foot distance rule.
Commissioner Gilbert, III, advised he was unsupportive of the item; and individuals charged with a misdemeanor would have permanent arrest records that would hinder them throughout their lives and careers.

Commissioner Sosa supported the thirty-foot distance rule and noted police officers could be quickly approached and threatened at closer distances. She added that the item was a tool to protect police officers.

Chairman Diaz agreed with Commissioner Sosa�s statement.

Commissioner Cohen Higgins reminded the Board that the State House Bill 11 failed to pass through the State of Florida Legislature and advised she was unsupportive of the item.

Commissioners Monestime, Regalado, and McGhee expressed their objections to the item.

Assistant County Attorney Javier Zapata clarified that the State House Bill 11 was refiled for the 2022 State of Florida Legislative Session.

Commissioner McGhee said the item�s distance rule prevented witnesses from taking high-quality images, which mattered during trials.

  REPORT: Commissioner Martinez stated the paid sick leave provided by the County for its vaccinated employees who were infected with the coronavirus disease 2019 (COVID-19) lasted through December 2023. He pointed out the item included language clarifying that the paid leave would not cause any direct increase in the County�s expenditures above the adopted budget level. He said the County had not approved a budget for 2023 and opined the sick leave was an additional expenditure. Commissioner Martinez requested clarification regarding the fiscal impact of the item and questioned whether the item allocated an additional eighty hours of sick leave to the employees� existing sick leave balance.

Miami-Dade County Chief Financial Officer Edward Marquez reviewed the intent of the foregoing item.

Mr. Jorge Fernandez, Deputy Director of the Miami-Dade Office of Management and Budget (OMB), explained that the proposed sick leave was not yet budgeted for 2023. He noted the item created a separate leave category which was intended to be used by vaccinated County employees for COVID-19-related events instead of regular sick leave.

Chairman Diaz proffered an amendment to remove all references to vaccination status as a determinant for County employees� eligibility to receive COVID-19 sick leave.

Assistant County Attorney Marlon Moffett advised the proposed amendment would amend the following whereas clauses to read as follows:

1. on typed page 3, sixth whereas clause: �Whereas, this Board desires to fill the gap created by the Families First Coronavirus Response Act�s (FFCRA) now-expired paid sick leave provisions by offering paid sick leave through December 31, 2023 to County employees who are unable to work, work from home, or telework because they are infected with or experiencing symptoms of COVID-19; need to isolate or quarantine due to COVID-19; must care for someone who is sick or needs to isolate or quarantine; or must care for a child whose school or place of care is closed or whose child care provider is unavailable for reasons related to COVID-19;�

2. on typed page 4, seventh whereas clause: �Whereas, providing COVID-19 paid sick leave to these County employees will allow the County to keep its employees on the payroll while they are dealing with the impacts of COVID-19, and ensure that employees are not forced to choose between their paychecks and the public health measures needed to combat the virus and maintain a safe and healthy workplace;�

3. on typed page 4, the first paragraph of section 1: �Directs the County Mayor or County Mayor�s designee to implement COVID-19 paid sick leave through December 31, 2023, in the manner provided in this section for non-bargaining County employees and for all other County employees within collective bargaining units, provided that written consent of the applicable collective bargaining agents is obtained to provide this benefit to bargaining unit employees.�

The next sentence following the first sentence of section 1 would be deleted and language would be added to say: �This paid sick leave shall only apply to eligible County employees who are unable to work, work from home through remote access or other means, or telework due to a need for leave for any of the following reasons.�

Chairman Diaz explained he did not want the item to discriminate against people who were unable to be vaccinated against COVID-19.

Commissioner Gilbert, III, accepted the proffered amendment and commented that the item allowed County employees to work from home while they recovered from the disease.

Assistant County Attorney Moffett confirmed the amendment removed all references to the County employees� vaccination status as a determinant for their eligibility to receive paid sick leave related to COVID-19.

Commissioner Martinez said the paid sick leave created a new pay status and questioned its fiscal impact on the County budget.

Mr. Fernandez countered the leave did not have an immediate fiscal impact.

Ms. Arleene Cuellar, Director of the Miami-Dade County Human Resources Department, noted the sick leave being provided had an eighty-hour cap and expired by December 31, 2023.

Ms. Jennifer Moon, Chief of the Office of Policy and Budgetary Affairs (OPBA), affirmed the sick leave would not have an annual budgetary impact because employees were paid for 2,080 hours. She further explained employees would not be paid additional money because they were sick, and it would not cause additional employees� salaries to be added to the County�s budget. Ms. Moon also said that the leave could only be used if an employee had COVID-19, and it would not cause higher pay outs to employees when they retired.

Commissioner Gilbert, III elaborated on the intent of the proposed resolution. He explained the FFCRA provided aid to employees afflicted with COVID-19, but it expired on December 31, 2020. He reported that several vaccinated employees became sick with COVID-19 while at work and had to use their personal sick leave; and it caused sick leave to be depleted. He noted that employees were also forced to take additional time off in order to care for family members afflicted with the disease. He said the item alleviated this dilemma by providing paid sick leave through December 31, 2023, to County employees with the disease, or if they had to care for sick family members who had COVID-19.

Miami-Dade County Mayor Daniella Levine Cava expressed her support for the item and commented on the importance of providing support to the County workforce as the pandemic continued.

Commissioner Regalado said the County should evaluate the financial impact that employees affected by COVID-19 would have in the next fiscal year budget.

Ms. Cuellar explained details about the FFCRA to Commissioner Garcia, who voiced concerns that the final cost of the FFCRA was unknown; and the proposed resolution lacked a budget analysis.
Mayor Levine Cava said the County Administration would provide information about how the County billed the federal government in relation to the FFCRA.

Commissioner Gilbert, III, said he received assurances from OMB and OPBA staff members that the item would not have a budgetary impact for the County.

Ms. Cuellar reported that employees did not necessarily have to provide verification of a positive COVID-19 test result to qualify for the sick leave and reviewed its eligibility requirements.

Commissioner Heyman expressed concerns about the amendment because it took away the incentive for County employees to get vaccinated.

Commissioner Higgins agreed with Commissioner Heyman and opined the item would incur financial costs. She supported the item, but suggested the County Administration create an accurate modeling spreadsheet to predict the item�s long-term financial costs.

Mayor Levine Cava acknowledged the Board�s concerns and would provide the requested information.

Commissioner Sosa would not support the item with the proffered amendment. She opined employees should be encouraged to get vaccinated and the amendments took away the incentive to do so. She added the amendment also gave a conflicting message to the County residents regarding vaccinations.

Chairman Diaz reiterated that he proposed the amendment because unvaccinated employees were penalized and discriminated against in the original item.

Commissioner Gilbert, III, explained why the item was needed and expressed that the County employees needed support during the pandemic.

It was moved by Commissioner Gilbert, III that the foregoing porposed resolution be adopted as amended. This motion was seconded by Chairman Diaz, and upon being put to a vote, passed by a vote of 11-4 (Commissioners Regalado, Sosa, Garcia and Heyman voted no, and Commissioner Souto was absent).

  REPORT: Assistant County Attorney Abbie Schwaderer Raurell stated that the Board of County Commissioners could appoint three County Commissioners to the State�s Biscayne Bay Commission and one County Commissioner to the County�s Biscayne Bay Watershed Management Advisory Board.

Assistant County Attorney Schwaderer Raurell read that Chairman Jose �Pepe� Diaz moved to appoint Commissioners Rebeca Sosa, Jean Monestime and Danielle Cohen Higgins to the Biscayne Bay Commission and that Commissioner Cohen Higgins was appointed to the Biscayne Bay Watershed Management Advisory Board.

Assistant County Attorney Schwaderer Raurell advised that the Chairman could make a direct appointment to the Biscayne Bay Watershed Management Advisory Board without a vote by the Board. She read that Chairman Diaz appointed Commissioner Monestime to the Biscayne Bay Watershed Management Advisory Board and Commissioner Sosa would serve as a member of the same board.

The Board members discussed the cancellation of the meetings due to a lack of quorum and the appropriate dates to reschedule the meetings.

Commissioner Regalado moved to cancel the meetings and have all CDMP and Zoning items carried over to the November 17, 2021, CDMP and Zoning meetings. This motion was seconded by Commissioner Sosa; and upon being put to a vote, passed by a vote of 11-0 (Commissioners Martinez and Souto were absent).
