REPORT:
Dr. Leah Blumenfeld, Co-Chairperson, Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW), 2526 NW 93rd Street, Miami, Florida, noted she was pleased to provide the CEDAW recommendations to the Board. She noted that CEDAW reflected the international standards Miami-Dade County should be striving toward for gender equity.
Ms. Raisia Sequeira 7951 NE Bayshore Court, Miami, Florida gave an oral report detailing the Commission for Women recommendations, which included matters dealing with maternal health, housing assistance, pay equity and transparency.
Ms. Sarah Zable, 1121 NE 178th Terrace North Miami Beach, Florida, gave further detail regarding the Commission for Women�s housing assistance recommendation. She urged the Board to adopt the Tenants Bill of Rights ordinance along with increased emergency/non-emergency rental and relocation funding for tenants of condemned buildings.
Ms. Isabella Cunningham, 181 NW 97th Avenue, Miami, Florida, gave further detail regarding the third Commission for Women�s recommendation. She indicated this recommendation was intended to update the Miami-Dade County�s Human Rights Ordinance to change the definition of an employer from a person who had five (5) or more employees to those with one (1) or more employees; noting such as change would ensure that workforce members, such as domestic workers, would be fully protected.
Ms. Olivia Martin Johnson, 800 Claughton Island Drive, Miami, Florida, urged the Board to work to ensure that salary and benefits were listed on all advertised county jobs and prior salary questions were removed; she urged the Board to ensure that all county contractors follow this rule as well, in order to be considered for county contracts. Ms. Martin Johnson also urged the Board to review prior recommendations, resolutions and ordinances to assess compliance.
In closing, Dr. Blumenfeld expressed appreciation to Board members and indicated the Commission for Women�s staff were available to work with the Board and its staff to develop each of these recommendations into policies.
Mayor Levine Cava expressed appreciation to the Commission for Women for providing their annual report. She also commended the Commission for picking up the recommendations.

REPORT:
Dr. Maria Ilcheva, Assistant Director of Planning and Operations, Jorge Perez Metropolitan Center at Florida International University (FIU), gave a PowerPoint Presentation entitled Miami-Dade County Status of Women 2021. She explained the intent of the report and pointed out some of the most important issues based on the Convention on the Elimination of All Forms of Discrimination Against Women CEDAW ordinance, which were education, economic opportunity, health and safety.
Dr. Ilcheva pointed out that reviewing the data for Miami-Dade County employees, the gender pay gap persisted and the disparity continued. In terms of county contracts, she stated there was a significant improvement, with an increase of county contracts awarded to businesses owned by women. She noted the report was very detailed and stated she wished to implement some of the data-related recommendations in future reports. In closing, Dr. Ilcheva emphasized that she wished to continue working with the Board on the aforementioned issues and strive to make the lives of women and girls in Miami-Dade County as well as address all types of disparities that exist.
Mr. Yinka Majekodunmi, Commission Auditor, Office of the Commission Auditor disseminated a copy of the quarterly Directives report to Board members regarding the status of all directives given to the Administration. In an effort to improve the directives process, Mr. Majekodunmi explained that he and his staff had created a dashboard, which would allow Commissioners and their staff to have clarity regarding the status of the directives. He also explained that the report contained details regarding working with the Board on enhancing policies and how to deal with the prior Administration�s directive as well as former Commissioners� directives. Mr. Majekodunmi stated it was his intent to work with the Commission to plan a policy encompassing those directives wherein the Administration could determine whether they should prioritize those directives or the Commission could decide whether or not to continue with these directives.
Chairman Diaz commended Mr. Majekodunmi and his staff regarding the dashboard, noting it was a great tool used to enhance the process of receiving information regarding directives. He pointed out this information was valuable and the timing of preparing these reports needed to improve. Chairman Diaz indicated he would look into this and send a memo regarding this matter.
Commissioner Regalado suggested that perhaps a process could be adopted wherein the commission would review the directives and decide which ones should be kept; prioritize and ultimately take action on them, and keep the remainder of the directives for informational purposes. She expressed concern regarding wasting resources with prior Administration and Commissioner�s directives if no one was interested in taking action on them.
Commissioner Sosa noted upon reviewing her pending directives, they were important and needed to be acted on; she suggested reviewing all directives and prioritize the most important directives.
Miami-Dade County Mayor Danielle Levine Cava noted the Administration had closed out approximately 400 reports since her tenure began. She pointed out it would be helpful to receive prioritization of directives from the commission, noting her intent to get the reports out in a timely manner and remove the focus from those directives that were no longer relevant or of interest.

Chairman Diaz opened the Reasonable Opportunity to be Heard; the following persons appeared before the Board:
Ms. Loreal Arscott, Chairwoman, Miami-Dade County Independent Civilian Panel (ICP), 18135 NW 18th Avenue, Miami Gardens, Florida spoke in support of agenda item 6A1 and urged the Board to approve the appointment of Ms. Nicole Bartman as the Executive Director of the ICP.
Mr. Brad Brown, Secretary, National Association for the Advancement of Colored People (NAACP), South Dade Branch, 11266 SW 166 Terrace Miami, Florida appeared before the board and spoke in support of agenda Item 6A1, the appointment of Ms. Nicole Bartman as the Director of the ICP.
Mr. Kenneth Kilpatrick, 5167 NW 29th Avenue, Miami, Florida, spoke in support of Agenda Item 6A1, the appointment of Ms. Nicole Bartman as the Director of the ICP.

REPORT:
County Attorney Geri Bonzon-Keenan advised the Board of the following preliminary changes to today�s (3/15) agenda:
Commissioner Monestime requested to add his name to the Pull List on Agenda Item 8H1.
Chairman Diaz requested to defer Agenda Item 11A1 to the April 5, 2022, BCC meeting.
Commissioners Garcia and Sosa requested to add Agenda Item 11A4 to the Pull List.
Commissioner Garcia requested to add Agenda Items 11A6, 11A13 and 11A14 to the Pull List.
Commissioner Monestime requested to add Agenda Item 15B1 to the Pull List.
Commissioner Garcia requested to Co-sponsor Agenda Items 11A3 and 11A9.
County Attorney Bonzon Keenan advised that the items to be considered at today�s (3/15) meeting would be those listed on the printed final agenda with additions, deferrals, withdrawals and scriveners� errors noted in the Chairman�s Memorandum entitled �Changes Sheet� dated March 3, 2022, including the aforementioned requests. She noted the Board would approve all of those items by a single vote setting the agenda except Agenda Item 2B1, the Mayor�s appointment of the Director of the Seaport Department, Ordinances for First Reading, Public Hearings, Agenda Item 6A1 consideration and approval of the Independent Review Panel (ICP) appointment of Ms. Nicolle Barton as the Executive Director, Agenda Item 6A2 and 6A2 Supplement the selection of members to the Miami-Dade County Women�s Hall of Fame, Ordinances set for second reading and the following Pull list items: 6A2,6A2 Supplement, 8G1, 8H1, 11A2, 11A4, 11A6, 11A8, 11A12, 11A13, 11A14 and 15B1.
It was moved by Commissioner Sosa that the Board adopt today�s (3/15) agenda with the aforementioned changes, as noted by the County Attorney. This motion was seconded by Commissioner Heyman and upon being put to a vote, passed by a vote of 13-0.

Miami-Dade County Mayor Daniella Levine Cava introduced Ms. Hydi Webb as the new Port Director and spoke regarding Ms. Webb�s extensive career with cruise and cargo management at Miami-Dade County�s Seaport. Mayor Levine Cava noted she received numerous letters urging the appointment of Ms. Webb as the director of the Seaport.
Ms. Hydi Webb appeared before the Board and expressed appreciation to the Board and Mayor Levine Cava. She stated she was honored to be appointed as the first female director of Miami-Dade County�s Seaport. Ms. Webb spoke regarding her 30-year tenure with the Seaport.

REPORT:
County Attorney Geri Bonzon Keenan read the foregoing proposed ordinance into the record.
Commissioner Monestime noted he wished to waive committee review the foregoing ordinance and schedule the public hearing for to the next Board of County Commissioners (BCC) meeting.
County Attorney Geri Bonzon Keenan noted Commissioner Monestime wished to suspend the Board�s rules and procedures requiring committee review of Agenda Item 4B (Legislative File No, 220483) to allow the public hearing and second reading for this item may be held at the April 5, 2022 Board of County Commissioners meeting and to amend Agenda Item 15B1 (Legislative File No. 220417) accordingly.
The foregoing proposed ordinance was adopted on first reading and scheduled for a public hearing before the Board of County Commissioners to be held on Tuesday, April 5, 2022 at 9:30 a.m.

Commissioner Regalado asked the County Attorney to advise the Board of the changes that had impact on the foregoing resolution.
Assistant County Attorney Oren Rosenthal explained that a prior Supreme Court case had resolved an issue regarding the Sherriff�s ability to move funds from one budget position to another. In the aforementioned Supreme Court�s case it was found that the statutes prohibited the Sherriff from doing so. He explained, an Act was passed during this Legislative session that undid that ruling and allowed the Sherriff to move budgeted items and funds within their budget.
Commissioner Regalado opined that this portion should be left for negotiation with the Sherriff�s Office because statutorily they can move within line items, whatever was approved they can move or appeal for more funds. She noted she was not in support of the foregoing resolution.
Hearing no further questions or comments, the Board proceeded to vote on the foregoing resolution as presented.
The foregoing resolution contained a scrivener's error which was corrected as follows:

Commissioner Martinez indicated that, although Ms. Nicole Barton had an outstanding background and resume, he was not in support of appointing her to the Independent Civilian Panel (ICP). He pointed out that he had not been afforded an opportunity to meet the candidate and opined that the issues that Law Enforcement and the community faced in Miami-Dade County were different from those of Missouri. He expressed his concern regarding not appointing a local person to this position, noting Miami-Dade County had excellent people who were familiar with the community, who had worked with Miami-Dade County Police Department (MDPD) and who were capable of leading the ICP.
Ms. Nicolle Barton appeared before the Board and spoke regarding her extensive career and accomplishments in Law enforcement. She pointed out that she had served as the first Executive Director of the Civilian Oversite Board for the City of St. Louis in Missouri and that during her tenure she assisted in the writing the policies and procedures, an operational manual and worked with a Board of volunteers to write bylaws. Ms. Barton noted she worked closely with Internal Affairs to oversee allegations of misconduct. Ms. Barton stated she currently worked as the consent decree coordinator for the City of Ferguson, Missouri where she worked closely with the Department of Justice, the Federal Monitor Team, as well as, the City of Ferguson�s Chief of Police to develop and implement multiple policies and procedures for the department and training. Ms. Barton gave further detail regarding her career in Law Enforcement and expressed appreciation to the Board for nominating her.

County Attorney Geri Bonzon Keenan read the foregoing proposed ordinance into the record.
Commissioner McGhee made the following amendment to the foregoing proposed ordinance:
~in sections 1 and 2 on typewritten pages 6 and 7, reduce the time period from 180 days to 90 days during which a Commissioner who first made a Legislative Request or Existing Legislative Request has to approve and submit an ordinance or resolution for placement on an agenda before the County Attorney is authorized to prepare the same or substantially similar ordinance or resolution for any other Commissioner.
~Replace all references to the 180-day period and 180 days in the item with 90-day period and 90 days.
~In section 1, add language to authorize the Commissioner who first made the Legislative Request or Existing Legislative Request to extend the 90-day approval period by written notification to the County Attorney for an additional 30 days.
~In section 2 on typewritten page 8, conform the extension of approval period for Existing Legislative Requests with Legislative Requests and reduce the extension of approval period for Existing Legislative Requests from 90 days to 30 days.
~In section 2 on typewritten pages 8 and 9, replace all references to �180-day or 270-day period, as applicable� with �90-day period, as may be extended�.
~In sections 1 and 2, add language to authorize the Commissioner who first made the Legislative Request or Existing Legislative Request to obtain additional extensions of approval period, prior to its expiration, by motion at any regular, CDMP, or zoning meeting, or any special meeting called for such purpose. The presiding officer at such meeting shall recognize the Commissioner to make the motion to extend the time. Such motion shall not be: (i) subject to the 4-day rule, as provided in rule 5.05(c); (ii) deferred to a future meeting; (iii) require committee review; or (iv) be subject or a motion to reconsider, except in the same meeting.
~In sections 1 and 2 on typewritten pages 7 and 9, respectively, add �urging the Florida Legislature to take state action� to the categories of ordinances and resolutions that the county attorney is authorized to prepare for a Commissioner irrespective of whatever any other Commissioner has requested the same or substantially similar ordinance or resolution.
~In sections 1 and 2, add organizational numbering and subheadings to paragraphs.
~Make technical and conforming changes.
Commissioner Sosa urged the Board members to be mindful of issues brought forward that may have a countywide significance and may negatively affect an individual district.
Responding to Commissioner Garcia�s request to place the items on a dashboard to allow more transparency, Commissioner McGhee indicated he agreed and would use a dashboard.
Discussion ensued regarding the proffered amendment reducing the pendency period to 90 days wherein several members of the Board expressed 180 would be better timeframe for pending items given that some issues may require extensive research and/or input.
Commissioner Higgins noted she was in support of the foregoing ordinance, however 90 days was extremely short for complicated technical items, which could lead to motions for extensions; she indicated she felt more comfortable with 180 days.
Commissioner Monestime concurred with Commissioner Higgins� comments, noting in an effort to prevent perpetual or permanent holds on items 180 days were applicable.
Commissioner Cohen Higgins also expressed her concern regarding 90 days and noted rushing legislation to the Board was a disservice to the community. She pointed out 180 days was more appropriate and urged Commissioner McGhee to consider 180 days, with the option to request extensions on large extensive Ordinances.
Commissioner Heyman stated the number of days an issue should remain pending should be calculated with insight from the County Attorney�s Office or Department Directors according to what was being requested and the complexity of what had to be delivered.
Commissioner Regalado clarified that this amendment does not include the reports, she suggested to have the Office of Policy and Budgetary Affairs and the Commission Auditor to assist with resources. She pointed out there were ways to get information expeditiously rather than just relying on staff.
Hearing no futher questions or comments, the Board proceeded to vote on the foregoing proposed ordinance, as amended.

REPORT:
Commissioner Regalado suggested following amending the foregoing proposed ordinance:
-on page 9 section (b) to change "must provide 60 written fair notice to the tenant" to "must provide a minimum of 60 days".
Commissioner Garcia noted that the properties being affected most by increased assessments were non-homestead properties which were being used as rentals, and the increases were passed on to the renters. He opined it was incumbent upon the commission and the administration to find the tools to try to cap the increases and assessments of non-homestead properties to ensure some rent relief.
Chairman Diaz expressed his concern regarding fair notice of payment/eviction to tenants, noting notification had been abusive and this was unacceptable.
Commissioner Higgins pointed out that fair notice was the right thing to do as all landlords were not doing the right thing and this legislation was being proposed to ensure compliance. She indicated that later in today�s (3/15) meeting, she would be making an allocation to Legal Services of Miami to hire additional attorneys to assist residents of District 5 with legal representation.
Replying to Commissioner Martinez� inquiry Assistant County Attorney Terrence Smith explained that if the tenant did not pay rent and the landlord attempted to proceed with an eviction without notification, the tenant would be able to use that the landlord did not meet the condition as a defense; the tenant can move to dismiss the case. There was no penalty other than the court dismissing the case and having the landlord reissue the notice.
Commissioner Sosa noted she was in favor of the foregoing ordinance, this legislation allowed the process to move forward properly.
Commissioner Hardemon noted the notice requirement of this legislation was exceptional, however more notice should be given prior to raising a tenants rent. He indicated he felt compelled to vote against this legislation as it would not provide as much relief as was intended.
Commissioner Regalado expressed her concern regarding possible unintended consequences for month- to-month tenancies. She noted many of the protections put in place and changes to the market would bring an end to many month-to-month tenancies.
Chairman Diaz and Commissioner Monestime asked to be listed as Co-sponsors to the foregoing ordinance.
Hearing no further questions or comments the Board proceeded to vote on the foregoing ordinance as amended.

Chairman Diaz expressed his concern regarding having a bail out waiver; however, he indicated that the County Attorney had clarified that a bail out waiver was included.
Commissioner Monestime expressed his concern regarding the bid waiver and noted he was not in support of the bid waiver.
It was moved by Commissioner Sosa to adopt the foregoing resolution. This motion was seconded by Commissioner Heyman and upon being put to a vote, passed by a vote of 12-1 (Commissioner Monestime voted: No).
Following Chairman Diaz� indicating he had concerns regarding the bid waiver and whether or not the county could withdraw from the contract at any time, Commissioner Heyman withdrew her second to the aforementioned motion.
It was moved by Commissioner Heyman to reconsider the foregoing resolution. This motion was seconded by Commissioner Sosa and upon being put to a vote, passed by a vote of 13-0.
Mr. Jimmy Morales, Chief Operations Officer, Office of the Mayor, responded to Chairman Diaz� concerns, confirming that the contract did have a termination for convenience clause, which allowed the county to terminate the contract at any time.

REPORT:
Commissioner Sosa made the following amendment to the forgoing proposed resolution:
~to urge President Joseph R. Biden Jr. and the United States Congress to keep sanctions against Russia in place until Russia recognizes Ukrainian sovereignty.
Chairman Diaz and Commissioners Sosa requested to be added as Co-sponsors of the foregoing resolution.
Commissioner Heyman noted she was a Co-sponsor of the foregoing resolution as she stood with the people of the Ukraine however, she opined that the suggested amendment would prove ineffective while President Vladimir Putin remained in office.
Commissioner Heyman suggested that the United States never do business with Russia again. She pointed out she wished to be removed as a Co-sponsor of the foregoing resolution.
Commissioner Garcia spoke regarding communism and residing under a dictatorship. He opined that the world order was in jeopardy due to the unprovoked war in the Ukraine where civilians were being attacked and killed daily. He stated the effects of Russia�s actions will ripple across the world if President Putin was not stopped. Commissioner Garcia noted this administration had to do everything in its power to put an end to this war and urged the Board to stand in solidarity with the Ukrainian people and freedom.
Miami-Dade County Mayor Danielle Levine Cava indicated she was in the process of reviewing contracts to determine whether any were connected to or benefiting Russia.
Commissioner Souto asked the County Attorney to look into ways to expand the forgoing proposal to keep other countries from doing business with Russia and to refrain from doing business with countries that were assisting Russia.
Hearing no further comments, the Board proceeded to vote on the foregoing resolution as amended.
