REPORT:
Mayor Carlos Gimenez spoke regarding the Christopher Columbus High School�s winning football team. He noted the team member�s hard work, dedication, talent and sportsmanship enabled them to excel against all odds in the final championship game, ultimately winning the 2019 Class 8A title; this title has brought honor and prestige to Christopher Columbus High School at the local state and national level.
In honor of the team, and in memory of the late Ari Arteaga, Mayor Gimenez presented a proclamation. He noted Mr. Arteaga was a former team mate who had passed away in a tragic car accident.

REPORT:
Ms. Rita Bareto-Craig, Chairwoman, Florida Commission on the Status of Women, noted each year the Commission recognized men and women throughout the State of Florida who did an exemplary job impacting the lives of women as well as those that served as positive role models.
Ms. Bareto-Craig spoke about Ms. Sharon Kendrick-Johnson�s volunteer/community service and pointed out that she was the current Chairwoman of the Miami Commission for Women, an active volunteer throughout Miami-Dade County and a member of the legal community for 25 years.
Ms. Bareto-Craig presented Ms. Kendrick-Johnson with the Spirit of Community Award; she noted Ms. Kendrick-Johnson was an amazing role model for future generations.

Chairwoman Edmonson noted that Miami-Dade County ranked first in sex trafficking in Florida, which in turn ranked third in the nation. She spoke of the Commission�s efforts to put an end to sex trafficking in Miami-Dade County.

Chairwoman Edmonson gave a brief history of the Zeta Phi Beta Sorority which was founded in 1920 at Howard University, noting it was her pleasure to recognize the Zeta Phi Beta Chapters of Miami, Miami Gardens, Florida City, Florida Memorial University, University of Miami, Johnson & Wales University and Homestead. She said this sorority had a rich legacy and expressed appreciation to the members and leaders of the sorority for their dedication to the community and the nation.
Chairwoman Edmonson presented a proclamation to the members of Zeta Phi Beta Sorority.

CITIZEN'S PRESENTATION TITLED : MIAMI SUNSET SENIOR HIGH SCHOOL PRESENTATION REGARDING E-CIGARETTES FOR PROJECT CITIZEN

REPORT:
Law class students from Miami Sunset Senior High school appeared before the Board and spoke regarding Project Citizen. Ms. Emily Miranda expressed appreciation to Chairwoman Edmonson and the Board for allowing them the opportunity to address the Board the Project Citizen competition.
Ms. Yinneset Fernandez indicated Project Citizen was a project-based program created by the Center for Civic Education; which teaches students about public policy by leading them through the process of researching a problem and developing a proposal for the government to address the problem. Ms. Fernandez indicated the project her class chose was vaping. Ms. Miranda gave further information regarding teens having easy access to electronic cigarettes (e-cigarettes) and vape pens, ultimately becoming addicted to nicotine which caused many health problems and left children and families in despair. Ms. Fernandez noted one solution the class came up with was to apply taxes when purchasing e-cigarettes, this would deter or make people less inclined to purchase e-cigarettes and the tax money could be used to fund preventative campaigns and centers for rehabilitation. Ms. Miranda indicated other solutions and MS. Fernandez concluded that vaping had become a large problem and they hoped to make a difference and accomplish these regulations.
Commissioner Levine Cava noted the commission�s hands were tied due to State of Florida preemption and she encouraged the students to communicate with the State of Florida Legislators regarding this matter.
Vice Chairwoman Sosa suggested the students use social media, radio and other outlets to make the community aware of their efforts, and she encouraged them to continue bringing their concerns and solutions to the community.
Responding to Commissioner Higgins� inquiry regarding e-cigarette billboard advertisements, County Attorney Price-Williams indicated she was unsure whether the County was preempted from banning such advertisements, however she would research the matter further as to advertisements near schools.

REPORT:
Chairwoman Edmonson opened the Reasonable Opportunity to Be Heard.
The following persons appeared before the Board:
Ms. Sharon Kendrick Johnson, Chairwoman, Commission on Women appeared before the Board and spoke in support of agenda Item 4A. She suggested that Miami-Dade County use its procurement process to reach the private sector to assist employees with sick and family leave. Ms. Kendrick-Johnson said requiring County vendors to require paid leave would make a difference in the lives of many working women and their families.
Mr. Xavier Pressley 16005 SW 107th Court Miami, Florida noted he was assaulted at a Trump rally and the police officers did nothing to stop the assault from occurring.
Ms. Anaruth Solache 6776 NW 187th Terrace Hialeah, Florida on behalf of Catalyst Miami, spoke regarding Agenda Item 4A and urged the Board to support this ordinance.
Ms. Jackalyn Stratchan 73 W. Flagler Street Miami, Florida spoke in support of Agenda Item 4A; she urged the Board to support the ordinance.
Ms. Jeanette Smith 13727 SW 152nd Street Miami, Florida, representing South Florida Interfaith Workers, spoke in support of Agenda Item 4A and urged the Board to support the ordinance.
Ms. Deborah Dionne 1660 NE 135th Street North Miami, Florida, spoke in support of Agenda Item 4A.
Mr. Roosevelt Derameau 1313 NW 13th Street Miami, Florida spoke in support of Agenda Item 4A.
Ms. Wendi Walsh 871 NW 167th Street Miami, Florida, Principle Officer of United Care spoke in support of Agenda Item 4A.
Mr. Samuel J. Dubbin 1200 Anastasia Avenue Miami, Florida spoke regarding Agenda Items 11A5 and 11A6, he urged the Board to support these resolutions which urged Congress to enact the Trauma-Informed modernization of eldercare for Holocaust survivors.
Mr. David Schecter 3 Grove Isle Drive Miami, Florida noted he was a Holocaust survivor and a founder of the Holocaust Memorial on Miami Beach; he expressed appreciation to the Board for supporting Agenda Items 11A5 and 11A6.
Mr. David Mermelstein, President of Holocaust Survivors Miami-Dade 9121 SW 66th Terrace Miami, Florida noted he was grateful for support the Commission has given the Holocaust survivors community and spoke in support of Agenda Items 11A5 and 11A6.
Madame Renita Holmes noted she was exempt from providing her address because she had been a victim of crimes due to placing her address on the record. Madame Holmes spoke regarding Agenda Item 8K1. She expressed her concern regarding amending public housing plans repeatedly and noted citizens had not been involved in this process when making these amendments.
Ms. Arlette Adams 2301 NW 50th Street Miami, Florida expressed her concern noting for months members of the community had sought the opportunity to engage in the United States Housing and Urban Development�s (HUD) Rental Assistance Demonstration (RAD) conversion process for Annie Coleman #14. Ms. Adams pointed out she had reason to believe that public housing maybe actively implementing the RAD conversion of Annie Coleman #14 without any resident participation, engagement or any disclosure of the conversion plans. She said today the Board was being asked to approve the significant amendments to the annual Public Housing Authority (PHA) plan for Fiscal Year 2019-2020; 82 units were subject to transfer. Ms. Adams pointed out Annie Coleman residents raised concerns regarding the transfer of assistance and the lack of any RAD resident participation. She expressed concern that there would be a loss of housing in the Brownsville community as a result of this transfer of assistance to public housing units already promise to the community. There should have been public dialogue regarding the possible permanent elimination of these 82 units. Ms. Adams noted the community wanted definitive answers regarding the future of Annie Coleman #14 and demanded that Public Housing and Community Development recognized and complied with the community�s right to be engaged in the RAD conversion process.
Mr. Fred Frost 10961 SW 155th Place Miami, Florida representing Communications Workers Union of America spoke in support of Agenda Item 4A and urged the Board to support this ordinance.
Chairwoman Edmonson closed the reasonable opportunity to be heard.

County Attorney Abigail Price-Williams advised the Board of the following preliminary changes to today�s agenda:
-Agenda Item 2B3, the Mayoral Appointment of the Miami-Dade Police Department Director was added to the Pull List
-Commissioner Diaz requested to add his name to the Pull List on Agenda Item 3B7;
-Commissioner Diaz requested to add Agenda 8F2 to the Pull List;
-Commissioner Suarez requested to add his name to the Pull List on Agenda Item 8F4;
-Commissioners Bovo and Diaz requested to add their names to the Pull List on Agenda Item 8F5;
-Agenda Item 8F5 contained a scrivener�s error in the memorandum�s title and the body of the resolution; the Mayor�s Memorandum was correct regarding the expenditure authority, the title and the body should conform to the title of the Mayor�s Memorandum to read that the correct expenditure authority is up to $21,854,645,000 for a total amount of up to $38,372,505,000;

The Board will approve all of those items by a single vote setting the agenda except for Agenda Item 2B3 the Mayor�s Appointment of the Miami-Dade County Police Department Director, Ordinances for First Readings, Public Hearings, Ordinances for Second Reading, Agenda Item 6A1 the vote on the appointment of Geri Bonzon-Keenan as the successor of the County Attorney; the following Discussion Items: 6B1, 6B2 and the following Pull List items:

It was moved by Vice Chairwoman Sosa that the Board adopt the agenda with the aforementioned changes, as noted by the County Attorney. This motion was seconded by Commissioner Moss and upon being put to a vote, passed by a vote of 13-0.

REPORT:
Mayor Gimenez appointed Officer Alfredo Ramirez as the Director of the Miami-Dade Police Department. Mayor Gimenez noted Director Ramirez had risen through the ranks of the Miami-Dade Police Department serving in a variety of roles in his career that has spanned nearly two and a half decades. He stated for the past two years he worked as the Deputy Director, and supervised departmental, investigative and police services. Director Ramirez also led the Miami-Dade Public Safety Training Institute and the Division of Psychological Services and Strategic Planning. Mayor Gimenez pointed out that Director Ramirez has received a variety of awards for his work and has completed many training programs. In closing, Mayor Gimenez stated that with his strong background Director Ramirez will be an outstanding leader of the Miami-Dade Police Department.
Following a few brief words from Director Ramirez, the Board proceeded to vote on the appointment.

REPORT:
Commissioner Jordan suggested amending the foregoing resolution; she asked that the Confidential Project Route work with organizations to hire a more racial and ethnic diverse workforce including supervisory and management positions.
Commissioner Diaz expressed his concern regarding confidential projects; he inquired what the limitations were regarding making adjustments to these types of projects in his District.
Assistant County Attorney Shannon Summerset explained to Commissioner Diaz, with these types of confidential projects, the entities are kept confidential; however, if the Commissioner was aware of the particular entity because they acknowledged themselves and worked with the commissioner, that would not be a violation of the law.

REPORT:
Commissioner Jordan expressed her concern regarding this project having a 10% goal that was not met; she noted this the firm had been given the opportunity to meet the goal but was unable to accomplish that. Commissioner Jordan inquired why this process was so difficult.
Gary Hartfield, Director, Small Business Development (SBD) explained that SBD applied measures to projects based on the availability of firms. He noted SBDs review of the particular project, the availability of the firms were there; there was not enough work for the firm to meet the goal. SBD and Aviation discussed this issue and one of the firms were excused from that goal and they only had an opportunity to get .79% of the goal. He indicated the other firms met their goals. Mr. Hartfield explained further and stated that DPC General Contractors were in compliance and Beacon Environmental was not in compliance.
Commissioner Martinez requested the Airport and Seaport Directors provide him with a list containing every item over $65,000.

REPORT:
Chairwoman Edmonson spoke regarding the tenure of County Attorney Abigail Price-Williams and her decision to retire after approximately 35 years of service to Miami-Dade County, 30 of which in the County Attorney�s Office.
Chairwoman Edmonson indicated that traditionally, the Board selected the First Assistant County Attorney to succeed the County Attorney and Geri Bonzon-Keenan was selected to serve as County Attorney upon Ms. Price-Williams� departure. She indicated Ms. Bonzon Keenan had been a County Attorney for 25 years and served as First Assistant County Attorney for the last 5 years. In closing Chairwoman Edmonson spoke further regarding Ms. Bonzon-Keenen�s tenure as First Assistant County Attorney. She noted with her extensive experience and many years of service to the County, she was confident Ms. Bonzon-Keenan would be an outstanding County Attorney.
Chairwoman Edmonson relinquished the Chair to Vice Chairwoman Sosa.
Ms. Price-Williams expressed appreciation to the Board for allowing her to serve as County Attorney. She noted that when the Board accepts First Assistant County Attorney as County Attorney it was an honor to the work and dedication the staff in the County Attorney�s office committed to daily. Ms. Price-Williams spoke regarding her friendship and work relationship with Ms. Bonzon-Keenan and pointed out that she will continue to serve the Board and the community with honor.
Ms. Bonzon-Keenan expressed appreciation to the Board for being given the privilege to serve as the next County Attorney. She noted she was grateful to those that encouraged her and taught her along the way. Ms. Bonzon-Keenan pointed out that she had served under four County Attorneys, each one taught her invaluable lessons and she pledged to build upon their legacies. She extended her deepest thanks and appreciation to Ms. Price-Williams for being her mentor, supporter and friend. In closing Ms. Bonzon-Keenan expressed appreciation to the County Attorney staff as well as County Employees.
Following comments from Board members, the Board proceeded to vote on the appointment.
Following the vote on the appointment; it was moved by Commissioner Edmonson to allow the new County Attorney the same County Attorney's compensation package as the outgoing County Attorney. This motion was seconded by Vice Chairwoman Sosa and upon being put to a vote, passed by a vote of 12-0 (Commissioner Heyman was absent).

REPORT:
Chairwoman Edmonson relinquished the Chair to Vice Chairwoman Sosa.
In response to Commissioner Levine Cava�s inquiry regarding setting up standard criteria for nominees to be appointed, Commissioner Edmonson explained that commissioners could set their own criteria for the person they wished to appoint to the Advisory Board. She noted most were appointing people from their own districts. Commissioner Edmonson asked that each commissioner make appointments as soon as possible.
Commissioner Edmonson made a motion directing the Administration to prepare solicitation for a Re-districting expert to accomplish the goals set forth in Resolution R-511-04 and for solicitation to be presented to the Board for approval at the February 19, 2020 BCC meeting; during that meeting the Board could direct any changes to the solicitation and set a date for the Board to interview and select the re-districting expert. This motion was seconded by Commissioner Diaz and upon being put to a vote, passed by a vote of 12-0 (Commissioner Heyman was absent).
With regard to the Advisory Board, Commissioner Edmonson made a motion directing the County Attorney to draft an Ordinance to create the Citizen�s Advisory Board as described in resolution R-511-04; this Ordinance will come before the Board for first reading at the next board meeting (February 4, 2020). This motion was seconded by Vice Chairwoman Sosa and upon being put to a vote, passed by a vote of 12-0 (Commissioner Heyman was absent).

REPORT:
First Assistant County Attorney Geri Bonzon-Keenan read the foregoing ordinance into the record.
In an effort to make adjustments to the ordinance; Commissioner Jordan indicated she wished to defer the foregoing ordinance to the first Board of County Commissioners (BCC) meeting in March (3/3).
Commissioner Diaz asked that Mr. Al Dotson be allowed to come forward and apprise the Board as to why the proposed ordinance should not be deferred.
Mr. Al Dotson, Attorney, 1450 Brickell Avenue, Miami, Florida appeared before the Board and noted this ordinance had been through multiple hearings regarding racing at the Hard Rock Stadium; one of these hearings led to the modification of the Miami-Dade County Code that expressly authorized racing on the Stadium�s property. Mr. Dotson explained that a referendum had taken place in Miami Gardens as well as public hearings in the Miami-Dade County Commission Chambers and in the Miami Gardens Council Chambers. He stated this commission had unequivocally indicated that they wanted Formula 1 racing to be held in Miami-Dade County; he felt this ordinance was an attempt to undo what had previously been voted on and this sent mixed messages to Formula 1 and the organizers of the race. Mr. Dotson pointed out that Formula 1 met with the community and had responded to all of the issues they conveyed, including moving the race off of 199th Street. He noted in response to the claims that the race would cause noise pollution and health issues, Formula 1 had provided evidence that the issues regarding noise and health issues were scientifically unfounded; with regards to the time of the race disrupting school, the time of the race had been changed. Mr. Dotson said further delay was absolutely unnecessary. He urged the Commission move forward with this ordinance today.
Vice Chairwoman Sosa noted that she was concerned with schools being disrupted however, that issue was addressed, the Board needed to move forward and make a decision.
Commissioner Martinez inquired why deferring this ordinance would be an issue for Formula 1.
Responding to Commissioner Martinez� inquiry Mr. Dotson stated deferring the proposal today would be an issue for Formula 1, because Formula 1 needed to decide whethor or not to seek a different location to hold their event. Mr. Dotson said the race was scheduled for May 2021.
Commissioner Martinez indicated he was not in support of the deferral because the time needed for Hard Rock Stadium and Formula 1 to prepare for the event and deferring this ordinance could cause investments to be lost.
Commissioner Jordan noted she would change the deferral request to February 4, 2020.
Mr. Dotson objected to deferring the item to the February 4th BCC meeting due to the investments that have been made.
Discussion ensued between Commissioner Jordan, Mayor Gimenez and Mr. Dotson regarding whether the race would take place on the Stadium grounds or on 199th Street. Mayor Gimenez explained that the race would take place on the Stadium grounds in the same place where they hold the tennis tournament and the Jazz in the Gardens events.
Responding to Chairwoman Edmonson�s inquiry regarding whether Mr. Dotson, Formula 1 and Hard Rock Stadium representatives had met with the community to inform them that they had addressed all of their concerns; Mr. Dotson explained that during the last meeting between members of the community, Formula 1 and Hard Rock Stadium representatives, the members of the community conveyed that they did not want to have any more meetings because they did not want the race in their neighborhood.
Commissioner Jordan noted that three weeks ago she announced that a Formula 1 meeting would be held at Miami Carol City High School, the Dolphins attended the meeting with over 100 people, most of which were employees. She noted she allowed them all to speak as well as members of the community. Commissioner Jordan pointed out, at that meeting the plans could have been shared with everyone attending the meeting. She said with the Dolphins representatives in attendance had the chance to disclose whatever concessions they were making to the community. Commissioner Jordan indicated that the community discovered the item was changed on yesterday from the newspaper. Commissioner Jordan expressed concerned that most of the speakers that came with the Dolphins had prepared statements and none of them, with the exception of one, resided in or near the Miami Gardens community. She suggested the race be taken to another community that welcomed it because it was not wanted in Miami Gardens; and also pointed out that Homestead Raceway was interested in hosting the race and even scheduled a meeting, everyone showed up except the Dolphins.
Commissioner Moss noted that Homestead still was interested in hosting Formula 1 racing at the Homestead Raceway. With regard to Commissioner Jordan�s request for a deferral of this ordinance, he inquired how the City of Miami Gardens' elected leaders felt about the proposed changes.
Commissioner Jordan replied by stating that the City of Miami Gardens� leaders had just learned of the changes yesterday from the newspaper; she noted they apprised the media of the changes first and had not presented anything to the community.
Commissioner Moss indicated that that he was unsure how deferring this ordinance for two weeks would make a difference. He noted that initially he voted to bring Formula 1 to the City of Miami, not Miami Gardens. He indicated that he was in support of the deferral.
Discussion ensued between Commissioner Bovo and Mr. Dotson regarding other cities that wanted to host Formula 1 racing. Mr. Dotson advised that he was unable to disclose any other suitors of the race; Mr. Dotson said Formula 1 was concerned regarding the ongoing negotiations and the community not wanting the race in their community.
Mayor Gimenez noted Las Vegas was the other city that wanted to host Formula 1 racing.
Commissioner Monestime expressed his concern regarding the relationship between the Dolphins and the City of Miami Gardens. He noted he was in support of the deferral.
Mr. Dotson stated respect was important and Formula 1 did respect the community so much that the first meetings regarding hosting the race was in July of 2018; and the Formula 1 representatives had responded and adjusted to the communities every request, even changed the time of the race due to schools in the area.
Discussion ensued between Mayor Gimenez and Board members regarding the community not wanting to meet with Formula 1 again and not wanting the race in their community.
Chairwoman Edmonson asked Mr. Dotson to meet with the community during the 2-week deferral and apprise them of the changes.
Mayor Gimenez pointed out significant investments needed to made to prepare the infrastructure for the race at the stadium and asked Chairwoman Edmonson to commit to making this ordinance the first item of business on the February 4th BCC agenda. He also asked Mr. Dotson to commit to having the Dolphins and Formula 1 to meet with the community.
Mr. Dotson said he would be happy to attempt to meet with the community again. He explained it would take approximately 18 months for staff to be hired to work at this event and start construction and asked that the ordinance not be changed.
Responding to Commissioner Martinez� inquiry, Mr. Dotson indicated the race was approximately two to three hours and reiterated it took approximately 18 months to prepare and construct in preparation of the race.
Commissioner Martinez noted the intent of this ordinance was to remove auto racing completely and suggested that the ordinance be rescinded.
Vice Chairwoman Sosa requested the County Attorney provide to her a complete analysis this proposal.

He noted a discussion had already taken place regarding curtailing pools with renewals and continuance of contracts. REPORT:
Assistant County Attorney Oren Rosenthal noted the foregoing proposed resolution contained a scrivener�s error; the item was drafted for a 3-year term that�s being approved now, and the 3-year term needed to be inserted. Attorney Rosenthal also noted the requested amendment was to change the $47 million amount, which was a 5-year calculation, to the 3-year calculation within the title, the body of the resolution and in the memorandum that the 3-year being requested was $28.2 million.
Commissioner Higgins noted this was a large technical contract and only one company had placed a bid; she asked for clarification regarding the 3-year term of the contract and whether any progress would be made on the legacy technology and begin to move toward competitive processes within the three-year timeframe.
Angel Petisco, Director, Information Technology Department (ITD) replied to Commissioner Higgins� inquiry noting that the three years was requested after reviewing the Legacy components the county utilized, a three-year plan was created to exit from the current Legacy programs. He further explained that this resolution also asked for two, 1-year options, which he would have to come back to the Board for approval.
Commissioner Higgins expressed her concern regarding the destruction of sidewalks in her District with the installation of 5G towers. She noted State Legislation had taken away the Commission�s authority regarding sidewalks and the 5G rollout. She inquired whether AT&T had begun to install the more aesthetically placing 5G poles on Biscayne Boulevard.
In response to Commissioner Higgins� concerns Ms. Thais Asper Keane, Legislative Affairs, AT&T, 600 NW 79TH Avenue Miami, Florida explained that AT&T was committed to changing the 5G poles along Biscayne Boulevard, however AT&T would work in collaboration with the County and Florida Department of Transportation (FDOT) as well as any other stake holding entity involved in the permitting process in order to reapply for the permits to switch out the poles.
Due to the $47 million 3-year extension, Commissioner Suarez noted that he was not in support of the foregoing proposed resolution.
Regarding Commissioner Suarez� comment, Mr. Petisco noted there was a scrivener�s error within the resolution; the $47 million was not for a three-year period, the $47 million was for the three-year period, plus the two options to renew totaling $47 million.
Assistant County Attorney Oren Rosenthal noted the foregoing resolution contained a scrivener�s error; the item was drafted for a 3 year term that was being approved now, the three year term needed to be inserted. Assistant County Attorney Rosenthal also noted the requested amendment was to change the amount $47 million, which was a five year calculation, to the three year calculation within the title, the body of the resolution and in the memorandum that the three year being requested is $28.2 million.
A discussion ensued between Vice Chairwoman Sosa and Mr. Petisco regarding the bid for this contract the contracts terms and AT&T being the only company that responded to the Request for Proposal.
Commissioner Moss expressed his concern regarding 5G poles being installed and inquired whether other companies that were installing 5G poles was making the same commitment as AT&T to installing aesthetically pleasing poles along the corridors.
Mr. Petisco replied to Commissioner Moss� inquiry noting that AT&T was one of many other companies were installing 5G poles in Miami-Dade County; he indicated that ITD has been working on permitting with those companies for over a year, to make sure too many poles were not installed in one area. Mr. Petisco explained there were distance limitations as well as visual aspect requirements that had to be followed.

Replying to Commissioner Bovo�s inquiry, Deputy Mayor Ed Marquez indicated that each collective bargaining unit had allowances for tools that employees use on the job, therefore it was reasonable that if the tools are stolen from their work truck that the County reimburse them for replacement. Deputy Marquez noted he would review the Water & Sewer contract to provide further information regarding reimbursing employees for tools.
Commissioner Bovo said this resolution was questionable and requested to defer to the February 4th Board of County Commissioners meeting.

REPORT:
Commissioner Levine Cava explained the intent of the foregoing proposed resolution, noting the implementation plan was not user friendly and needed to be easier for the public to follow. She further noted that she was concerned because she had not received any information regarding what happened with the funds for the Campbell Drive project in her district. Commissioner Levine Cava noted the Campbell Drive project was a part of the original People�s Transportation Plan (PTP) project. She indicated that she learned that although $6.7 million had been programmed for the project, it had been reduced to $3.4 million. Commissioner Levine Cava pointed out that she was unable to get answers from anyone regarding this reduction or where the funding went. She noted that she was not in support of this resolution.
Commissioner Martinez noted he was not in support of this resolution.
Commissioner Bovo suggested bifurcating the Northeast, North and Flagler Corridor portion of this resolution, because he was in support of this portion. He indicated that if the item could not be bifurcated he would vote no on the entire resolution.
Responding to Vice Chairwoman Sosa�s inquiry regarding the use of PTP funds, Assistant County Attorney Bruce Libhaber replied that new projects were listed in the foregoing proposed resolution that were not included in the original PTP. He explained that the process to add projects to the PTP was to go through the five-year plan, which goes to Citizens Independent Transportation Trust (CITT) and then to this Board.
Mr. Javier Betancourt, Executive Director, CITT, appeared before the Board and noted that this five-year plan did go before the CITT last year, therefore it was before this Board properly. Of the new projects suggested or requested by the Department of Transportation and Public Works (DTPW), Mr. Betancourt said the bulk of the projects were in the original PTP and are related to transit corridors or the expansion of bus service and park and rides. He noted that the Lehman Yard Perimeter Security Fence project was not in the original PTP.
Responding Commissioner Bovo�s inquiry Assistant County Attorney Libhaber explained that the Lehman Yard Perimeter Security Fence project could be bifurcated from the proposed resolution, noting that the Board could accept or reject any of the projects listed in the proposal.
Commissioner Bovo noted he wanted to bifurcate the Lehman Yard Perimeter Security Fence project from the resolution.
Vice Chairwoman Sosa expressed her concerns regarding reverse lanes, which was previously approved, however to her dismay this project was not included in the proposal. She said installing a dedicated lane without a reverse lane to alleviate congestion was problematic to the traffic issue.
Assistant County Attorney Libhaber clarified that the vote would be to approve each project except the following: Lehman Yard Perimeter Security Fence, Northeast Corridor-West Aventura Station, and the Northeast Corridor planning and project development.
Commissioner Bovo requested to bifurcate and vote on the corridors first.
It was moved by Commissioner Bovo to bifurcate and include the Northeast Corridor, North Corridor and Flagler Corridor in the five-year plan. This motion was seconded by Vice Chairwoman Sosa.
Responding to Commissioner Martinez� inquiry regarding whether the five-year plan was published online with the agenda, Mr. Betancourt indicated that these items were given to the Agenda Coordinator who publishes the agenda; this information was also published on the CITT website.
Assistant County Attorney Libhaber clarified that the five-year plan was published online with today�s (1/22) agenda.
It was moved by Commissioner Levine Cava to bifurcate the North and the Flagler Corridor from the foregoing resolution. This motion was seconded by Commissioner Bovo and upon being put to a vote, passed by a vote of 11-1 (Commissioner Martinez voted No; Commissioner Heyman was absent)
It was moved by Vice Chairwoman Sosa to bifurcate the Northeast Corridor portion of this resolution. This motion was seconded by Commissioner Bovo and upon being put to a vote, passed by a vote of 10-2 (Commissioner Heyman was absent; Commissioners Martinez and Levine Cava voted No).
It was moved by Commissioner Moss to approve Lehman security fence. This motion failed due to lack of a second.
Responding to Vice Chairwoman Edmonson�s inquiry regarding what happens to this item since it did not get a second on the motion, Assistant County Attorney Libhaber explained this was deemed as a rejection of the CITT recommendation and that this portion of the item goes back to the CITT who could forward a reconsidered recommendation back to the Board of County Commissioners.
It was moved by Commissioner Moss to defer the balance of the plan. This motion was seconded by Commissioner Higgins and upon being put to a vote, passed by a vote of 11-0 (Commissioners Heyman and Souto were absent)
Commissioner Moss suggested having a presentation at the next meeting to highlight the significant items within the plan.
It was moved by Commissioner Sosa that the Board bifurcate certain projects from the FY 2020-25 Five-Year Implementation Plan Update and amend this item as follows:
1. Planning and Project Development for Northeast, North and Flagler Corridors were approved.
2. Northeast Corridor West Aventura Station was approved.
3. Lehman Yard Perimeter Security Fence project was rejected and sent back to the CITT for reconsideration at the February 27, 2020 Trust meeting.
4. The remaining projects in the Plan were deferred to the February 4, 2020 BCC meeting.
