REPORT:
Agenda Items 2A1 and 2A2, Legislative File Numbers 201454 and 201455, respectively, were considered simultaneously.
Mayor Carlos Gimenez asked the Board to sustain his veto for Agenda Items 2A1 and 2A2, relating to Ordinance Number 20-65, establishing an Independent Review Panel (IRP). He explained he veto the ordinance due to the subpoena provision for elected officials and County employees and explained the reasons for the veto.
Mayor Gimenez thanked Commissioner Jordan for introducing a revised ordinance to remove the subpoena provision to prohibit elected officials and County employees from being subpoena and eliminate the injection of politics. He advised he supported the revised version of the ordinance included in todays (07/21) agenda.
Mayor Gimenez noted he still believed the voters should have the ability to vote on the decision as to whether an IRP should be established.
Commissioner Jordan explained the revised ordinance relating to implementing an IRP and noted it was still a law enforcement process that would involve police officers.
Commissioner Jordan noted the Charter amendment was unrelated to detailing subpoena powers. She clarified the language of the Charter amendment and its intent. She asked for the members of the Board support to override the Mayors vetos.
Commissioner Levine Cava advised she supported Commissioner Jordan on the issue of allowing the voters to have the final say.
First Assistant County Attorney Bonzon-Keenan clarified the motion was to adopt the ordinance and become effective notwithstanding the veto of the Mayor. Therefore, it was a motion to override the veto.
It was moved by Commissioner Jordan that the Board of County Commissioners override Agenda Item 2A2, Legislative File Number 201455, relating to the Independent Review Panel (IRP). This motion was seconded by Commissioner Levine Cava; and upon being put to a roll call vote, the motion to override the Mayors veto failed by a vote of 7-6 (Vice Chairwoman Sosa and Commissioners Bovo, Diaz, Heyman, Martinez, and Souto voted no).
It was moved by Commissioner Jordan that the Board of County Commissioners override Agenda Item 2A1, Legislative File Number 201454, relating to the Charter amendment. This motion was seconded by Commissioner Levine Cava; and upon being put to a roll call vote, the motion to override the Mayors veto failed by a vote of 7-5 (Vice Chairwoman Sosa and Commissioners Bovo, Diaz, Martinez, and Souto voted no). (Commissioner Suarez was absent)
Commissioner Jordan asked Chairwoman Edmonson to schedule a special meeting of the Board for July 30, 2020, to consider Agenda Items 2A1 and 2A2, Legislative File Numbers 201454 and 201455, respectively, if Agenda Item 4I, Legislative File Number 201390, were to pass today (07/21) on first reading in order to be able to vote on the resolution and consider the ordinance on second reading.
Chairwoman Edmonson noted the requested special meeting of the Board required seven (7) signatures to approve the meeting.
Due to the Board's Rules of Procedure two-third (2/3) vote requirement, the motion to override the Mayor's veto failed; and the Mayor's veto was sustained.

ANNUAL JOINT MEETING OF THE PUBLIC HEALTH TRUST AND BOARD OF COUNTY COMMISSIONERS
|
Presented
|
| |
REPORT:
At approximately 12:18 p.m., Chairwoman Edmonson recessed the Board of County Commissioners meeting without a motion to consider the Annual Joint Meeting of the Public Health Trust (PHT) and the Board of County Commissioners, Agenda Item 6B1.
First Assistant County Attorney Geri Bonzon-Keenan read into the record the title of the foregoing item.
Dr. Walter T. Richardson, Vice Chairman, Public Health Trust (PHT) Board of Trustees, presented PHTs annual report and advised Mr. Carlos Migoya would provide an overview of the future vision for Jackson Memorial Hospital (JMH).
Mr. Carlos Migoya, President and Chief Executive Officer (CEO), Jackson Health System (JHS), presented a PowerPoint presentation on the future vision for JMH; and he reviewed the proposed capital projects and plans, including the unfunded capital needs. He advised JMH was facing financial challenges due to COVID-19; but the hospital employees would not be laid off.
Pursuant to Commissioner Levine Cavas question regarding how the County could further assist, Mr. Migoya explained their efforts to secure financial assistance from the state and federal governments.
Commissioner Moss congratulated Dr. Richardson and Mr. Migoya for their leadership.
Vice Chairwoman Sosa noted the Board of County Commissioners had approved at todays (07/21) meeting a resolution supporting JMHs request for additional funds from the state and federal emergency funds.
Pursuant to Vice Chairwomans Sosa question relating to the proposed construction of a building within County Commission District 6 with GOB funds, Mr. Migoya advised he was still working on that project; but the building would be constructed before the end of her office term.
Mr. Migoya commented the Trust would soon be presenting before the Board of County Commissioners a legislative item relating to a $9.4 million capital project to make every room at JMH a smart room in order to be able to improve communications with the patients. He also noted another legislative item would be presented before the Board for $4.4 million to finalize the project relating to the Intensive Care Unit (ICU) beds.
Commissioner Diaz commended Dr. Richardson and Mr. Migoya for their leadership, and he also commended the work performed by the hospitals workforce.
Upon conclusion of the Annual Joint Meeting of the Public Health Trust (PHT) and the Board of County Commissioners, the Boards meeting reconvened at approximately 12:49 p.m.

REPORT:
Pursuant to Vice Chairwoman Sosas question, Mr. Juan Kuryla, Port Director, Miami Port, responded it was anticipated the final development and construction document relating to the negotiations with Virgin Trains on the construction of a commuter/passenger train facility at the Port would be presented before the Tourism and the Ports Committee meeting scheduled for September 10, 2020.
Vice Chairwoman Sosa asked Mr. Juan Kuryla to either prepare a status report or an item for the Tourism and the Ports Committee meeting of September 10, 2020, providing an update on the negotiations with Virgin Trains relating to the construction of a commuter/passenger train facility and the construction of passenger stations on the northeast alignment of the Port. She asked that the negotiations to construct the commuter/passenger train facility at the Port be expedited.
Commissioner Higgins asked Mr. Kuryla to ensure the Countys cultural organizations, particularly the Adrianne Arscht Center for the Performing Arts, were accommodated.
Hearing no other comments or objections, the members of the Board proceeded to take a vote on the foregoing resolution as presented.

REPORT:
Vice Chairwoman Sosa asked to be listed as a co-sponsor.
Pursuant to Commissioner Jordans questions, Assistant County Attorney Oren Rosenthal explained the provisions of Miami-Dade Countys Home Rule Charter as it related to having non-partisan elections and the foregoing resolutions history.
Pursuant to Mayor Gimenezs question relating to the length of time it would take to have non-partisan elections, Assistant County Attorney Rosenthal advised the question would not have to be returned to the voters; and it was the voters decision to determine whether non-partisan elections should be held. He stated it would be included in the Countys Charter as soon as state law changed.
Mayor Gimenez recommended the State Legislature be urged to allow Home Rule Charter Counties to have non-partisan elections.
Commissioner Jordan requested a legislative item be prepared urging the State Legislature to allow Home Rule Charter Counties to hold non-partisan elections.
Vice Chairwoman Sosa asked Commissioner Jordan to work with Commissioner Bovo on the development of the proposed legislative item.
Commissioner Jordan advised she would like Commissioner Bovo to co-prime sponsor the proposed legislation with her. She also extended an invitation to Vice Chairwoman Sosa to co-prime the proposed legislative item.
Hearing no other comments or objections, the members of the Board proceeded to take a vote on the foregoing resolution as presented.
