1H MOTION TO SET THE AGENDA AND "PULL LIST"  
  REPORT: County Attorney Geri Bonzon-Keenan indicated the following preliminary changes to today�s (5/2) Board of County Commissioners (BCC) agenda:

1. Commissioners Cohen Higgins and Garcia added Agenda Items 2B2 to the �Pull List;�
2. Agenda Items 7B and 7B Supplement were distributed prior to the convening of this meeting and added to the �Pull List;�
3. Commissioner Gonzalez added Agenda Items 8C2 and 11A5 to the �Pull List;�
4. Commissioner Garcia added Agenda Item 8E2 to the �Pull List;�
5. Commissioner Hardemon requested Agenda Items 8F1 and 8F1 Supplement be withdrawn;

County Attorney Bonzon-Keenan advised the items to be considered at today�s (5/2) BCC meeting would be those listed in the printed final agenda with the additions, deferrals, withdrawals, and scrivener�s errors noted in the Chairman�s memorandum entitled �Changes Sheet� dated May 2, 2023, including the aforementioned requests. She noted the Board would approve all of those items by a single vote setting the agenda except Agenda Item 2B1, ordinances for first reading, public hearings, ordinances for second reading, scrivener�s errors, Agenda Item 8P7, and the �Pull List� Agenda Items as follows: 2B2, 2B3, 8C2, 8E2, 8F1, 8G5, 11A5, 11A6.

Commissioners Cohen Higgins and Garcia released Agenda Items 8F1 and 8F1 `

It was moved by Commissioner Higgins that the Board of County Commissioners (Board) approve today�s (05/2) agenda as presented, including the aforementioned requests and changes. This motion was seconded by Commissioner Bastien; and upon being put to a vote, the motion passed by a vote of 13-0.

  REPORT: Commissioner Garcia commented the 2023 Biscayne Bay Report Card lacked information on the condition of Biscayne Bay (the Bay) and the steps the County needed to take for its protection and preservation.

Mayor Levine Cava noted that she spearheaded the annual report card legislation, and it highlighted the next steps the County needed to take to improve the health of the Bay. She pointed out that the condition of the Bay was at a very concerning point, and the public shared the same concerns. She emphasized the County needed to continue its aggressive pursuit of the positive actions and initiatives undertaken by her administration to restore the Bay�s health. She advised the three (3) initiatives implemented were the fertilizer ordinance, outreach efforts, and increased enforcement activities of construction sites polluting the waterways. She noted that the County would continue aggressively its pursuit of sewer-to-septic tank conversions.

Commissioner Cohen Higgins advised she wished to emphasize the concerns about the Bay�s condition. She asked the County Administration if they were amenable to incorporating on an ongoing basis the information contained in the 2023 Biscayne Bay Report Card relating to the Bay�s condition with the Biscayne Bay Watershed Management Advisory Board Annual Report since it further detailed the issues mentioned in the report.

Mayor Levine Cava stated Commissioner Regalado had been a key leader in the sewer-to-septic tank conversion efforts, and it was vital to continue the Bay's restoration efforts. She also pointed out that the report highlighted the need to pursue actions like the adoption of impervious area standards, implementing additional quality treatment standards, and operating permits for stormwater drainage infrastructure. She noted that she hoped the Board would act favorably on those items.

Commissioner Regalado advised she had been working on the policy side to make the sewer-to-septic tank conversions more feasible. She thanked the County Administration and its staff for working on those issues.

Commissioner Regalado commented that the fact the County cannot regulate agricultural runoff did not mean it was unmeasurable.

Commissioner Regalado asked that the County begin measuring and tracking agricultural runoff in collaboration with our university partners.

Commissioner Regalado requested that the 2023 Annual Report Card Program include data on the total number of septic tanks located in the county, including the number of new septic tank systems, and the number of septic tanks in need of inspections and decommissioning.

  REPORT: Commissioner Cohen Higgins asked Mr. Roy Coley, Director of the Miami-Dade Water and Sewer Department (WASAD), to include in the next report regarding companies that damage WASAD�s sewer pipes during construction a listing of recommended companies to undergo the debarment process.

Commissioner Higgins asked the County Administration to conduct a comprehensive analysis and to prepare and provide a report detailing whether the contractors contracted by other public works and infrastructure departments were also damaging sewer pipes during construction.

  REPORT: As requested, Assistant County Attorney Dennis Kerbel advised that Commissioner Steinberg wished to amend Agenda Item 7F to provide the following:

(1) An extension for construction activities performed by, or on behalf of, a public electrical or gas utility; (2) a fee for temporary permits issued by the County; and (3) delayed implementation of the construction equipment and machinery regulations until August 1, 2023, to give the County Administration sufficient time to program the new temporary permit in the permitting system.

In response to Commissioner Cohen Higgins� question regarding the penalty language of imprisonment for first-time offenders, Assistant County Attorney Kerbel responded that it was standard language included in all noise control ordinances.

Discussion ensued among Commissioner Cohen Higgins, Commissioner Steinberg, and Assistant County Attorney Kerbel regarding the penalty of imprisonment for first-time offenders and the State Attorney�s discretion to enforce the imprisonment penalty.

Commissioner Cohen Higgins asked Assistant County Attorney Dennis Kerbel to review the language of all noise control ordinances to identify the ordinances that contained the discretionary provision to enforce a two-month imprisonment penalty for noise violations and potentially amend all of the ordinances to remove it.

Chairman Gilbert, III, pointed out that the imprisonment penalty provision provided police officers the authority to enforce the ordinance; therefore, law enforcement should participate in the discussions.

Commissioner Regalado concurred with the comments made by Chairman Gilbert, III, and stated some level of enforcement was necessary to ensure advantage. She suggested the report include data on the number of arrests made because of the provisions of the ordinance.

Commissioner Cohen Higgins commented that law enforcement had difficulty enforcing the noise control ordinance due to the lack of a decibel level marker to determine what constituted too loud, and she was currently working on a legislative item to address this problem.

Upon conclusion of the foregoing discussion, the Board members proceeded to vote on the foregoing ordinance with the following amendments:

- to provide an extension for construction activities performed by, or on behalf of, a public electrical or gas utility;
- a fee for temporary permits issued by the County; and
- delayed implementation of the construction equipment and machinery regulations until August 1, 2023, to give the County Administration sufficient time to program the new temporary permit in the permitting system.

Later during the meeting, Commissioner Regalado moved to waive the 4-week/6-week municipal notice requirement for Agenda Item 14A1, Legislative File Number 230908; set the public hearing for the Chairman�s Policy Council and Intergovernmental Affairs Committee (CPCIAC) meeting scheduled for June 12, 2023; direct the Clerk of the Board to publish the necessary notice; and to direct the Agenda Coordinator to send the municipal notices. There was no second for the motion.

Chairman Gilbert, III, advised he supported the legislative item as written and objected to waiving the municipal notice requirement since the resolution was recently added to the agenda, and the residents and municipalities deserved more than a day�s notice.   REPORT: Chairman Gilbert, III, directed the Miami-Dade County Mayor�s Office to begin using the new funding allocation forms in place effective as of today�s (05/02) meeting to make funding allocations in order to streamline the process. He asked that the Mayor�s Office be provided with the new forms.

  REPORT: Chairman Gilbert, III, advised that he would introduce a new process to establish a day of the month to present the employee service awards and assign one commissioner on a rotational basis to make the presentations due to the increased number of presentations.

Chairman Gilbert, III, pointed out he would add additional days to accommodate the service award presentations if necessary. He noted that he would coordinate with the County Administration and staff on the structure and process.
