Lien Services

The Regulatory and Economic Resources Department's Lien Section is responsible for the recovery of fines and fees expended due to the enforcement of the Miami-Dade County Code.

The philosophy of the County is to recover enforcement costs from the property owners with violations. The goal of our section is to encourage properties with violations to achieve compliance.

Violations Research Services

The Lien Section provides enforcement research services of real property within unincorporated Miami-Dade County that is limited to the following information:

  • Unsafe Structures violations
  • Work Without Permit violations
  • Expired Permit violations
  • Minimum Housing violations
  • Neighborhood violations
  • Liens recorded for above violations
  • Contractor Licenses Liens
  • Liens recorded on behalf of the Miami-Dade Fire Rescue Department (Fire code violations) up to October 2012
  • Liens recorded on behalf of the Miami-Dade Police Department (Burglar Alarm violations) up to October 2012
  • Environmental Resources Management enforcement violations
  • Violations of Passenger Transportation regulations (PTRD)

Fee: $250 per property
Payment must accompany the application in the form of a check made payable to Miami-Dade County, or you may pay online. The process number will be provided contacting the Lien Section by emailing LSPIC@miamidade.gov.

Process time: 10-20 business days

Copies of lien files cost 15 cents per page (20 cents if double-sided)

Pay-Off / Estoppel Letter

A pay-off letter is issued when a settlement amount is required in writing to conduct sales transactions and settlements. The request must be done in writing and the information on the requestor, contact information and folio is to be provided.

Fee: $75 to be paid up front.
Payment must accompany the application in the form of a check made payable to Miami-Dade County, or you may pay online. The process number will be provided contacting the Lien Section by emailing LSPIC@miamidade.gov.

Process time: Up to 72 hours

Special Releases

During the sale or purchase of properties, title searches reveal liens placed on properties owned by the same individual attached to properties that have no violations, making it virtually impossible for the purchaser to obtain a mortgage through a financial institution.

In such cases, the Lien Section offers a "Special Release" form that clears the "clean" property from the impact of the liens. This is offered only in cases where the property being released is free of violations.

Fees for this document are as follows:

  • $500 for the actual Special Release Document, plus
  • $250 for each research conducted (minimum two folios)

Process time: 10-20 business days

This fee is to be paid up front by check made payable to Miami-Dade County. Payment must be mailed to, and all correspondence sent to:

Refunds: Should the research reveal violations on the main property, thus rendering the property ineligible for the release, only the $500 of the actual document will be refunded.

Partial Releases

The same concept as the Special Release, but a Partial Release applies to condo units or townhouses where a lien placed on the Homeowners Association for common element violations impacts the title of the units within the development.

This service is only available in cases where the specific unit is free of violations/liens.

In order to consider the application for this document, the customer must present a letter from the Homeowners Association stating they are not able to provide any documentation to release them from the liens, and a copy of the recorded resolution document stating the unit's percentage of responsibility.

Fees for this document are as follows:

  • $500 for the actual Partial Release Document, plus
  • $250 for each research conducted (minimum two folios), plus
  • The prorated amount of the unit's responsibility in the Homeowners Association lien.
