  REPORT: Chairman Diaz introduced the G. Holmes Braddock Navy JROTC to perform a close-order drill demonstration and presenting of the colors.

  REPORT: Chairman Diaz opened the hearing for the reasonable opportunity to be heard; and the following persons appeared before the Board:

Ms. Laura Reynolds, 6820 SW 64th Court, Miami, Florida representing the Hold the Light Coalition and the Urban Area Expansion Task Force, spoke regarding Agenda Item 7B. She noted she was in support of the item and noted the Urban Expansion Areas were set 30 year ago, before the lands vulnerability to sea level rise was known. Ms. Reynolds suggested the Board review Agenda Item 3A which was a proposal for a new Urban Expansion Area, and a more appropriate place to develop. She also asked the Board to consider looking for areas that were near infrastructure and higher in elevation when expanding urban areas.

Mr. Jose Gonzalez, representing the Builders Association of South Florida, 700 NW 1ST Avenue Miami, Florida spoke in support of Agenda Items 4A, 7B, 11A1 and 14A3.

Ms. Annie Lord, Executive Director, Miami Homes for All, spoke in support of Agenda Item 4B.

Mr. Joe Bober 10680 NW 25th Street Doral, Florida spoke in support of Agenda Items 9A2 and 9A3.
Mr. Leroy Jones, 120 NW 24th Avenue, Miami, Florida asked the Board to consider filing lawsuits against social media companies regarding their display of guns and violence to youth and the negative impact it had on them.

Seeing no one else come forward to speak, Chairman Diaz closed the reasonable opportunity to be heard.
 
1H MOTION TO SET THE AGENDA AND "PULL LIST"  
  REPORT: County Attorney Geri Bonzon-Keenan advised the Board of the following preliminary changes to today�s (11/2) agenda:

Commissioners Hardemon and Cohen Higgins requested to add Agenda Item 2B2 to the Pull LIst.

Vice Chairman Gilbert, III, and Commissioner Higgins requested to add Agenda Item 11A8 to the Pull List.

Commissioner Regalado released Agenda Item 8L2.

Commissioners Cohen Higgins and Regalado requested to co-sponsor Agenda Item 8L2.

Commissioners Cohen Higgins and Souto requested to co-sponsor Agenda Items 9A2 and 9A3.

Commissioner Cohen Higgins requested to co-sponsor Agenda Items 9A4 and 9A5.

County Attorney Bonzon-Keenan advised the items to be considered at today�s (11/2) meeting would be those listed on the printed final agenda with additions, deferrals, withdrawals and scriveners errors noted in the Chairman�s memorandum entitled �Changes Sheet� dated November 2, 2021, including the aforementioned requests. The Board will approve all of those items by a single vote setting the agenda except for Ordinances for First Readings, Public Hearings, Ordinances set for second reading, Agenda Items 8F4, 8F7 and 8F9 Commercial Service Airport contracts, which must be voted on separately and were not on the Pull List, Agenda Items subject to the 4-Day Rule and; the following Pull List items:
2B2 8F1, 8F5, 8F8, 8F10, 8F12, 11A1, 11A4, 11A8, 11A19, 11A21, 17A1, 14A1, 14A2 and14A3.

It was moved by Commissioner Sosa that the Board adopt the agenda with the aforementioned changes, as noted by the County Attorney. This motion was seconded by Commissioner Cohen Higgins, and upon being put to a vote, passed by a vote of 12-0 (Commissioner Monestime was absent).

  REPORT: Commissioner Hardemon made a motion to accept the Mayor�s report recommending Mr. William Diggs as Executive Director of the Miami-Dade Economic Advocacy Trust (MDEAT). Additionally, Commissioner Hardemon directed the County Mayor or the Mayor�s designee, subject to the Board�s final approval, to negotiate Mr. Diggs� salary including the fringe and executive benefits, which such salaries shall be commensurate with the salaries of the Directors who have similar duties and responsibilities as the director of the Trust, to include. Future salary and cost of living increases, and provide a report to the Board that describes the outcome of the initial negotiations and recommendations concerning future Board actions, including any adjustments to the current county pay plan and to place the report on the next Board of County Commissioners (BCC) agenda without committee review in accordance with Ordinance No. 14-65.

Vice Chairman Gilbert, III, seconded Commissioner Hardemon�s motion, and discussion ensued between Board members regarding allowing all or any candidates present at today�s (11/2) meeting to address the Board.

Commissioner Cohen Higgins stated it was the Board�s decision as to who would serve as the Trust�s new Director and she respected the Administration�s recommendation. However, she noted, it was at the will of the Board of County Commissioner�s Chairman to allow the three candidates to address the Board in their efforts to serve as the next Director.

Commissioner Sosa inquired whether approving Commissioner Hardemon�s motion would approve the recommendation of Mr. Diggs or the nominees� ranking.

Responding to Commissioner Sosa�s inquiry, Assistant County Attorney Terrence Smith explained that approving Commissioner Hardemon�s motion would be approving the Mayor�s recommendation.

Commissioner Sosa pointed out that she was not prepared to approve candidates that she was unfamiliar with, and noted she had not had a chance to interview these candidates. She expressed her concern with the process and opined that the Board should have the opportunity to ratify the recommendation of the Administration with proper knowledge of the candidates. Commissioner Sosa requested more time to interview the candidates.

Commissioner Garcia noted the candidates were aware of the process and had the opportunity to reach out to Board members. He indicated he was comfortable moving forward with the Mayor�s recommendation.

Commissioner Martinez noted that Ms. Traci Pollock contacted his staff for a meeting, and although he was unable to meet with her, he was impressed by the phone conversation he had with her. Commissioner Martinez noted this was a very important position and if Board members felt uncomfortable accepting the Mayor�s recommendation, they had the right to interview the candidates. He stated that he was unwilling to accept the foregoing motion without hearing from all three candidates.

Vice Chairman Gilbert, III, indicated he wished to vote on Commissioner Hardemon�s motion, and then hear the candidates.

Commissioner Hardemon explained that MDEAT made the recommendation to the Mayor and the Mayor made the recommendation to the Board; MDEAT was extremely familiar with all of the candidates and had conducted interviews with them all to make their recommendation. Commissioner Hardemon pointed out that as the Chairman of the Airports and Economic Development Committee, this matter fell under his purview and MDEAT needed a new Executive Director for quite some time now, therefore further delay was unacceptable.

Chairman Diaz indicated he was moving forward with allowing the candidates to speak, and then the Board would consider Commissioner Hardemon�s motion and vote.

Later during the meeting, the following candidates considered for the MDEAT Executive Director position appeared before the Board:

Mr. William Diggs, 848 Brickell Key Drive, Miami, Florida provided a brief history of his previous experience as the President/CEO of the Miami-Dade Chamber of Commerce, the Mourning Family Foundation, the President/CEO of the Broward Health Foundation, the founder of 100 Black Men of South Florida, the founder of the Beta Psi 1923 Foundation and other entities. Mr. Diggs stated he had done economic development work all his life, and built The Young Professionals Network and Business Council. He gave further details regarding his economic development experience and noted he was proud to be the candidate recommended by MDEAT and the Mayor.

Ms. Traci Pollock, 16901 NW 20th Avenue, Miami Gardens, Florida noted she had worked tirelessly for the Metro Miami Action Plan (MMAP) Trust for many years and currently employed with the Miami Economic Advocacy Trust (MDEAT). Ms. Pollock indicated she worked throughout the years to align MDEAT with its core mission and that many new initiatives had been implemented due to her efforts. She stated this was an opportunity to see her hard work come to fruition in the establishment of a new Office of Research and Policy; to recommit the MDEAT organization back to the community and connect with other organizations to continue the work that began with the original Miami Action Plan Trust. Ms. Pollock went on to provide further history of her experience as an employee of MDEAT. She noted she was familiar with MDEAT processes including the budget, Teen Court and various MDEAT programs. Ms. Pollock pointed out she worked on many capital improvement projects, various business mitigation projects and economic development projects. She noted she was ready to serve in the capacity that she had prepared for over the years. In closing, Ms. Pollock stated she had support from the former Executive Director who had endorsed her as the next Executive Director.

Commissioner McGhee noted that he was in support of the recommendation of Mr. Diggs� nomination.

Vice Chairman Gilbert, III, expressed appreciation to Ms. Pollock for the work she did within the MDEAT organization, however, he noted he was in support of Mr. Bill Diggs� nomination because he was the perfect candidate to empower people to build wealth in the community and move the organization forward.

Commissioner Hardemon stated he looked forward to the work MDEAT would do for the community and was in support of Mr. Diggs.

Commissioner Heyman said ultimately the Board had to vote on the recommendation; and pointed out the Board usually made the recommendations, not the Mayor. She expressed her concern with the Mayor making the recommendation rather than the Board.

Responding to Commissioner Heyman�s concerns, Assistant County Attorney Smith explained Section 2-505 of the Miami-Dade County Code provides that initially the Board of Trustees of the Miami Dade Economic Advocacy Trust will interview the candidates, and then submit a recommendation to the Mayor, and the Mayor will forward a name to the Board. He advised the Board was responsible for ratifying the Board of Trustees and the Mayor�s recommendation.

Commissioner Martinez noted he was impressed with Ms. Pollack�s resume and he preferred to promote from within. He stated Ms. Pollock had invested her time and should be promoted because the knowledge and wisdom she gained from working within the organization was valuable. Commissioner Martinez added that he would support the recommended candidate but expressed great concern with losing the institutional knowledge that Ms. Pollock had gained during her tenure with the organization.

Chief Operations Officer Jimmy Morales, Office of the Mayor, noted the Administration acted within the Code.

It was moved by Commissioner Hardemon to accept the Mayors recommendation. This motion was seconded by Vice Chairman Gilbert, III, and upon being put to a vote, passed by a vote of 12-0 (Commissioner Monestime was absent).

Responding to Commissioner Heyman�s inquiry regarding the need for the substitute item that was presented to the Board by the County Infrastructure, Operations and Innovations Committee, Assistant County Attorney Oren Rosenthal explained that the substitute narrowed the item so it only applied to Board initiated applications related to the Urban Expansion Area. He indicated it did not apply to applications regarding the Urban Development Boundary (UDB) itself.

Commissioner Higgins expressed concern regarding changing the UDB, particularly because of the difficult time achieving quorum at Zoning and Comprehensive Development Master Plan (CDMP) meetings. She noted she was not in support of the foregoing resolution.

Commissioner Regalado indicated that the change was important, due to the title, because there had been confusion within the community due to the title. She concurred with Commissioner Higgins� comments regarding not achieving quorum at Zoning and Comprehensive Development Master Plan (CDMP) meetings.

Chairman Diaz asked to bifurcate the foregoing ordinance and asked the Attorney to read an amendment into the record.

Assistant County Attorney Christopher Wahl read the following amendment into the record:

-In section 2 of the ordinance, to add a new subsection 5-4 (b) 1.1 (v) to clarify that it constitutes animal cruelty to otherwise participate in any way in animal fighting.

Commissioner Martinez noted he was in support of the foregoing ordinance, however, he requested clarification regarding the equipment used for animal fighting; and whether a person would be charged for possessing equipment that could be used for animal fighting. With regard to Commissioner Martinez� inquiry, Attorney Wahl explained that a person could not be charged for possessing equipment that could be used for animal fighting, there had to be evidence that the person was using the equipment for animal fighting.

Replying to Commissioner Martinez� concern, Chairwoman Cohen Higgins explained that the ordinance included language that indicated �equipment used in the act of or with the intended purpose of�. She noted people were using cars to put animals in the trunk to fight to their death; and this practice was called �trunking�.

Commissioner Regalado noted this legislation brought the county in line with the Florida Statute regarding animal abuse, as it created clear delineations of what constitutes animal cruelty. She pointed out peacocks and peafowl were covered by this legislation as well.

Commissioner Martinez noted that although there were incentives for hiring locally, people were still saying they were unable to find jobs. He stated he wanted to ensure that when these incentives were given to companies for hiring local people, and those who were not local, would not be allowed to work remotely/work from home. Commissioner Martinez inquired who was responsible for following up and making sure jobs were filled with local people.

Responding to Commissioner Martinez, George Andrews, Senior Advisor, Office of the Mayor, indicated that it was the responsibility of Regulatory and Economic Resources (RER) to audit the records of the companies to verify that they complied with hiring locally.

Commissioner Higgins clarified that this legislation was discussed extensively during the Airports and Economic Development Committee meeting and amendments were added to clarify that remote jobs must be new jobs and employees must work remotely within Miami-Dade County.

  REPORT: Commissioner Regalado noted there was a 90-day period to terminate the proposed lease agreement, and she asked staff to provide guidance regarding how these leases could be impacted upon the creation of the constitutional officer and whether language should be added.

Assistant County Attorney Oren Rosenthal explained that the item had a termination for convenience provision within it. He noted if there was a need due to transfer of authority because of the constitutional offices in 2025 that would affect the lease that was contemplated herein that could be terminated for convenience with the appropriate notice.

Commissioner Regalado her expressed concern, noting she was unsure if 90 days was sufficient and suggested Assistant County Attorney Rosenthal create boilerplate language and contract around it.

Commissioner Cohen Higgins noted she was supportive of the foregoing resolution. She indicated that she contacted the Police Department to inquire about how much space was needed for over 100 employees. Commissioner Cohen Higgins inquired whether an analysis had been done to determine how much square feet was being rented out, if the entire space was being utilized and whether or not there was a work from home model to reduce the footprint and reduce the number of vehicles on the road.

Deputy Mayor Edward Marquez explained that the Administration was working on a tele-commuting plan for all departments; once more detailed information was received about each department�s operational needs, the Internal Services Department (ISD) would work on the plan to maximize the footprint and their effectiveness for each department.

  REPORT: Chairman Diaz advised Board members that the Department of Regulatory and Economic Resources Management (RER) had issues with the process and suggested adding a consultant. He asked Assistant County Attorney Abbie Schwaderer to explain and clarify the amendment.

Assistant County Attorney Schwaderer noted she was not aware of DERM offering an amendment to the foregoing resolution.

Mr. Lee Hefty, Assistant Director, RER, noted he was unsure if the item needed to be amended, however, the department would need the assistance of consultants who were experienced with filing mitigation and bank permit applications in order to make this successful. He opined that staff could work with the item as presented, but the report would indicate they need the assistance of professionals that knew how to file those types of applications.

Chairman Diaz noted he did not wish any delay to occur and asked that the language be added as an amendment.

Assistant County Attorney Abbie Schwaderer-Raurell noted the following amendment:

-in Section 2, to add "the County Mayor or Mayor�s designee may use a consultant subject to applicable rules related to procurement".

Assistant County Attorney Oren Rosenthal noted the following amendment:

-In section 2, increase the time to complete the inventory of County properties from 30 to 90 days.

-In section 3, direct the County Mayor or County Mayor�s designee to develop and include guidelines for the construction and aesthetics of 5G wireless infrastructure on County property.

-In section 4, increase the time to prepare the report from 120 to 180 days; require that the report include recommended guidelines for construction and aesthetics of 5G wireless infrastructure; and require that the recommended proof-of-concept trial in District 1 and any future use or lease of County properties for 5G wireless services be conditioned upon the provision of 5G wireless service from such locations.

-Add a section 5, to include recommendations to the Board in the report addressing ways the County can leverage the use or lease of County property to expand the rollout of �dark fiber� in the County to allow for future high speed internet services in Miami-Dade County.
