  REPORT: Chairman Diaz convened the Board of County Commissioners (Board/BCC) meeting at 9:30 a.m.; followed by a moment of prayer led by Vice Chairman Gilbert, III.  
1B ROLL CALL  
  REPORT: Prior to the roll call, Clerk of the Board Assistant Director, Linda Cave announced that Commissioner Souto would be participating by Communication Media Technology (Zoom) pursuant to Resolution No. R-1160-20 (See memorandum re: participation by Communication Media Technology for the March 2, 2021 BCC/Special BCC Meeting, Special Situation, Medical, due to COVID-19).

Chairman Diaz noted that there were a number of speakers waiting to address the Board on an item where the public hearing was already done in Committee, therefore he would not be reopening the floor for additional public comments.

The following Board members were present at roll call: Commissioners Cohen Higgins, Garcia, Hardemon, Heyman, Martinez, McGhee, Monestime, Sosa, Vice Chairman Gilbert and Chairman Diaz. Commissioners Souto and Regalado participated via Communication Media Technology (Zoom).

In addition to the members of the Board, the following staff members were also present: Office of the Mayor, Chief Operations Officer, Jimmy Morales; County Attorney Geri Bonzon-Keenan; Assistant County Attorneys Monica Rizo and Michael Valdes, Dennis Kerbel and Abbie Schwaderer-Raurell, Clerk of the Board Assistant Director Linda Cave and Deputy Clerk Sandra Petithomme. Miami-Dade County Mayor Daniella Levine Cava was also in attendance.

  REPORT: County Attorney Geri Bonzon-Keenan announced in accordance with Rule 6.06 of the Board�s Rules of Procedure, members of the public would now have the reasonable opportunity to be heard regarding non-public hearing propositions before the Commission which had not been subject to a previous opportunity to be heard. She noted that members of the public would be given an opportunity to speak on public hearing items under Section 5 of the Agenda when the item was called.

Chairman Diaz opened the reasonable opportunity for the public to be heard, and there being no persons wishing to speak, closed the reasonable opportunity to speak.
 
1H MOTION TO SET THE AGENDA AND "PULL LIST"  
  REPORT: County Attorney Geri Bonzon-Keenan stated in addition to today�s (3/2) Regular Board of County Commissioners (Board) meeting, the Board would recess its meeting and convene a Special BCC meeting for the Public Health Trust (PHT) to submit the results of the annual audit for Fiscal Year 2019-2020, prepared by the PHT�s external audit.

County Attorney Bonzon-Keenan stated in addition to Chairman Diaz�s Memorandum entitled �Changes Sheet�, Commissioner Regalado requested she be added to the pull list for Agenda Item 11A16 and released her pull of Agendas Items 2B4, 3B1, 3B2, 8F14, 8N7, 11A6, 11A8, 11A10 and 11A11; Commissioner Garcia requested he be added to the pull list for Agenda Items 8F4, 8F5, 8F6, 8F8, 8F10, 8F12, 8H2, and 11A4; Commissioner Monestime requested his name be added to the pull list for Agenda Items 8F8, 8F12, 8N1, 8N9, 8O2 and 11A3; Vice Chairman Gilbert released his pull of Agenda Item 8F8; and Commissioner Martinez requested he be added to the pull list for Agenda Item 11A15.

County Attorney Bonzon-Keenan noted that Commissioner Garcia requested he be listed as a co-sponsor for Agenda Items 1D4, 7D, 7E, 7G, 11A6, 11A9, 11A13 and 11A15; and Commissioner McGhee asked that he be listed as a co-sponsor for Agenda Items 7C, 8H1, 11A8, 11A9 and 11A13.

County Attorney Bonzon-Keenan stated the items to be considered at today�s (3/2) Board meeting would be those listed in the printed final Agenda, with the additions, deferrals, withdrawals, and scrivener�s errors noted in Chairman Diaz�s Changes Memorandum, and the aforementioned items. She added that the Commission would approve all of those items by single vote; setting the agenda, except for the Chairman�s order of the day which provided for the Board to recess at 10 a.m. to convene the Special meeting regarding the PHT and from noon to 1 p.m. for lunch; ordinances for first reading, public hearing items, ordinances for second recording, items subject to the 4-Day Rule under Section 14 and the following Pull List Items: 8A1, 8F4, 8F5, 8F6, 8F8, 8F10, 8F11, 8F12, 8F17, 8G1, 8G2, 8G3, 8G4, 8G5, 8G6, 8H2, 8N1, 8N4, 8N6, 8N8, 8N9, 8O2, 11A3, 11A4, 11A7, 11A9, 11A15, 11A16, 14A1 and 14A2.

Discussions ensued between Commissioner Heyman and County Attorney Bonzon-Keenan regarding the status of Agenda Items 11A9 and 11A11.

County Attorney Bonzon-Keenan announced that Vice Chairman Gilbert, III requested he be added to the pull list for Agenda Item 8A2.

Commissioner Hardemon noted that Agenda Item 8C1 was removed from the agenda because it lacked a sponsor. He requested he be added as the sponsor for the item and for it to be placed back on the agenda for consideration.

Commissioner Sosa advised her colleagues that she removed her sponsorship request for Agenda Item 8C1 since she was no longer the Chair for the Airports and Economic Development Committee. She explained that it was her intent for the new AEDC Chair, Keon Hardemon, to become the new sponsor.

Commissioner Monestime released his pull of Agenda Item 8O2.

Vice Chairman Gilbert, III noted he pulled Agenda Item 11A2 to proffer a floor amendment extending the period of time from 15 days to 90 days for the administration to return with the report.

County Attorney Bonzon-Keenan announced Agenda Item 11A2 should be amended as follows:
~Change the 15 days report period listed on Page 4, Section 2, which �directs the Mayor to implement the recommendation to require that procurement set asides are limited to SBEs need only two (2) bids, or report to the Board as to why such recommendation was not implemented within 90 days� to 90 days; and
~Change the 30 days report period listed on Pages 5 and 6, Section 5, which �sets forth a time frame for the County Mayor to either implement certain recommendations of the Good and Services Task Force or report to the Board as to why such recommendations was not implemented to 90 days� to 90 days.

County Attorney Bonzon-Keenan noted the Board could approve the foregoing proposed resolution as amended, with the Setting of the Agenda.

It was moved by Commissioner Martinez to approve Chairman Diaz�s Changes Memorandum for the March 2, 2021 Board of County Commissioners (BCC) Meeting with the additional changes noted by County Attorney Bonzon-Keenan and those additional requests made by Board members. This motion was seconded by Commissioner Cohen Higgins and upon being put to a vote, passed by a vote of 13-0.

Later in the meeting, it was moved by Commissioner Sosa to recess for the Public Health Trust Submission of the Annual Audit for Fiscal Year 2019-2020. This motion was seconded by Commissioner Heyman and upon being put to a vote, passed by a vote of 13-0.

Chairman Diaz announced that the Board would recess until 1:15 p.m.

Following the recess, the Board reconvened at 1:21 p.m.

2 MAYORAL ISSUES  
  REPORT: Miami-Dade County Mayor Daniella Levine Cava indicated the Board received the federal priorities packet and the commission would be voting on the federal packet at the next board meeting. She addressed the key items in the federal packet that were critical for the Board to consider. Mayor Levine Cava noted the Coronavirus Disease 2019 (COVID-19) stimulus bill, which included resources for vaccination and direct relief to the residents and businesses was sent to the House and advanced to the Senate. Additionally, she noted Miami-Dade invested billions to upgrade the water and sewer infrastructure, however additional federal and state funding was required to bring infrastructure to communities without sewer services. Mayor Levine Cava urged the Board to support the federal legislation funding and programs to help local governments prepare for sea level rise, protection for the Everglades, the Bay, and Biscayne restoration projects to prepare for storm water management.

After Mayor Levine Cava�s statement, County Attorney Geri Bonzon-Keenan informed the Commission that agenda item 8C1, which Commissioner Hardemon assumed sponsorship for, would be added to the agenda as agenda item 14A3.

It was moved by Commissioner Hardemon to accept the addition of item 14A3 to the agenda for the March 2, 2021 Board of County Commissioners (BCC) Meeting. This motion was seconded by Commissioner Heyman and upon being put to a vote, passed by a vote of 13-0.

Commissioner Heyman stated with regards to the federal packet; she indicated that she chaired the National Association of Counties (NACO) Large Urban County and noted NACO Large Urban County priorities were criminal justice reform, equity, disparity, immigration, and infrastructure. She also noted NACO added supplementary priorities, such as healthcare with additional funding to combat COVID-19.

Commissioner Sosa stated R-75-20 was a resolution requested for additional federal and state emergency funding for the Public Health Trust of Miami-Dade County.

Chairman Diaz recommended that the Commission pursue the top tier priority, because the State of Florida advised the budget was negative $3 billion.

  REPORT: County Attorney Geri Bonzon-Keenan read into the record the title of the foregoing proposed ordinance.

Commissioner Sosa indicated she was not in favor of supporting the foregoing proposed ordinance, because it was using the half penny without a public vote, and it would limit funding for infrastructure. She commented she wanted to ensure the half penny served the community for the infrastructure or transportation. Commissioner Sosa voiced concerns about whether the transportation service would be use with good intentions.

Commissioner Martinez mentioned there were limited guidelines to the transportation service and echoed Commissioner Sosa statement, regarding whether the transportation service would be use with good intentions.

Commissioner Regalado indicated the transportation service provided the same on demand service as agenda item 3B2; West Dade on demand service that served districts 10 and 11. She pointed out agenda item 3B2 passed unanimously and requested that the Commission review this agenda thoroughly. Commissioner Regalado noted the transportation service did not have an annual audit and was designated to serve smaller municipalities.

Commissioner Souto raised concerns about the half penny, and the Unincorporated Municipal Service Area (UMSA). He noted UMSA do not receive the half penny support, but the Cities did receive the half penny resources. Commissioner Souto stressed it was an unfair disadvantage to UMSA, because UMSA contributed to the half penny resource. He asked that the county attorneys clarify the taxation of the half penny usage from the cities and UMSA and announced at this time he would not support the foregoing proposed ordinance.

Commissioner Monestime stated the intent for using the Citizens Independent Transportation Trust (CITT) funds was to encourage Miami-Dade County residents to use mass transit. He noted the foregoing proposed ordinance did not meet the CITT threshold and opined the free transit maybe used inappropriately by a select few. Commissioner Monestime announced that he was not supportive of the foregoing proposed ordinance at this time.

Commissioner Heyman addressed the concerns raised by the Commissioners who did not support the ordinance. She noted this item was a part of the original Peoples� Transportation Plan (PTP) bill that voters passed for the half cent penny. Commissioner Heyman provided the Board with information of the PTP bill, and noted the bill funded two municipalities for road and transportation projects. She explained that UMSA had to include a set amount of funds and those funds would not be pulled back from UMSA. Commissioner Heyman noted any funds that were not utilized by UMSA would go to cities that were able to use the funds. She indicated there were cities that had 20 percent prorated allocations for road improvements, but the issue was the percentage paid out on transportation projects. Commissioner Heyman reported the cities with the 20 percent prorated allocations, discovered there were restrictions stating the funds had to be used within the city. She pointed out the cities did not have public transportation bus or trolley routes and noted as discovered by CITT annual audits, the prorated funds continued to accrue. Commissioner Heyman stated an alternative was created as a result of the accrued funds, to allow the cities a fair share amount in the transportation service. She emphasized those funds would be audited by CITT annually, as stated from the original PTP bill. Commissioner Heyman also thanked Commissioner Regalado for reading Item 3B2, West Dade on Demand service, an item that was passed by the Board, and echoed Commissioner Regalado�s statements regarding the similarities of this foregoing ordinance with the surtax use for Item 3B2.

Commissioner Gilbert, III indicated he supported the foregoing proposed ordinance just as he did in committee. He explained programs would be implemented by cities, but were not limited to city residents. Commissioner Gilbert, III indicated anybody in the city could use the program in the same manner as the transportation options. He noted this item embraces the fact that not all Miami-Dade County was the same and he also noted this item allowed smaller cities to use the transportation funds.

Commissioner Higgins stated she would also support the foregoing proposed ordinance. She noted the PTP funds were provided to the cities to solve their transportation and road infrastructure needs. Commissioner Higgins stated that some of the smaller cities had limited access to transportation and had to spend most of the funding on road projects. She indicated some of the cities wanted to use a portion of the half penny to access transportation for their residents who do not possess a vehicle. Commissioner Higgins referenced the Go Connect App pilot and how it worked and she believed the elected leaders in the small cities would not waste their half penny funds. She also noted the cities had the ability to modify the transportation program to their preference. Commissioner Higgins asked to be listed as co-sponsor to the foregoing proposed ordinance.

Commissioner Hardemon questioned whether the County had other programs like the on demand transportation program, and Commissioner Heyman indicated the County had the Freebee transportation program.

Discussion ensued between Commissioner Hardemon and Commissioner Higgins regarding the Freebee transportation program and the Go Connect transportation app.

Commissioner Hardemon questioned whether the transportation service was provided in the Overtown or Spring Garden areas, and Commissioner Higgins indicated the transportation service was utilized in areas without access to metro movers, buses, and trolley routes.

Commissioner Martinez asked for clarity as to how the transportation service would be funded and how the transportation user would be reimbursed.

Jennifer Moon, Chief, Office of Policy and Budgetary Affairs, indicated the municipality or the county entered into an agreement with the transportation service provider, afterwards the passenger would then contact the provider to get the service. She noted the passenger would not pay and the municipality would set limitations within a five mile radius.

Jimmy Morales, Chief Operations Officer, Office of the Mayor, explained the intent of the model was not to collect funds from the passengers. He noted the Cities was using surtax dollars to contract with Freebee or other transportation providers and then the passenger would call the on demand service, free of charge. Mr. Morales indicated the payment to Freebee or other transportation services would come from the Cities.

Assistant County Attorney Bruce Libhaber expounded on the on-demand transportation surtax funds. He explained residency requirements other than being a Dade County resident, on surtax funds were not allowed. Assistant County Attorney Libhaber indicated if it was the Miami Beach or Miami Trolley, on-demand services were not restricted to just the residents of those cities, but could be restricted to the on demand service routes.

Discussion ensued amongst Commissioner Martinez and Mr. Morales regarding the coverage of the on-demand services and whether transportation programs currently existed.

After Commissioner Monestime asked whether the on-demand program was outside the 20 percent of what was given to the municipality, Assistant County Libhaber indicated 22 to 23 percent goes to municipalities, while the dollars for the transportation service would come out of that percentage amount.

Further discussion ensued amongst Commissioner Monestime and Ms. Moon regarding the municipality use of the 22 to 23 percent funds.

Pursuant to Commissioner Sosa�s question as to whether there were County bus routes in the municipalities providing service and if so were cities charged from the half penny tax to cover the maintenance of the buses. Mr. Morales indicated the County buses provided service to the municipalities and the county does not charge the municipalities for the maintenance of the buses from the half penny tax.

Commissioner Sosa pointed out the half penny tax provided service county-wide, yet unincorporated Dade did not receive the same benefits as the cities. She stressed that the County provided most of the services, because of the funding that was distributed to the County and believed there was a level of inequity between the County and City.

After Chairman Diaz asked about the required miles for the on-demand bus service and whether there were limitations for the on-demand service; Assistant County Attorney Libhaber indicated the on-demand service allowed 5 miles within the routes and there were no limitations. He noted the ordinance did require an inter-local agreement between the City and the County outlining how the service would be implemented.

Chairman Diaz inquired whether the Commission was voting to determine if the inter-agreements between the County and Cites were properly implemented, and Assistant County Attorney Libhaber confirmed the Commission on those terms.

Commissioner Souto voiced concerns about the inequality of the transportation routes and Assistant County Attorney Libhaber reiterated the on-demand transportation offered service in a five mile radius.

Commissioner Souto inquired whether UMSA would be able to utilize the half penny transportation service and Assistant County Attorney Libhaber confirmed UMSA could utilize the half-penny transportation service.

Discussion ensued between Commissioner Regalado and Commissioner Sosa regarding the half-penny support from past commissioners.

Commissioner Heyman closed by stating the item indicated service would be no greater than five miles and she noted a study was conducted to view residents travel distance from Biscayne Park to Miami Shores, revealing there were no bus routes in those cities. She stated in some small cities there were no bus routes, therefore this item would allow cities to use their own surtax dollars for transportation projects.

  REPORT: County Attorney Geri Bonzon-Keenan read into the record the title of the foregoing proposed ordinance and noted that co-prime sponsor, Commissioner Higgins, proffered the following amendments:

~ Amend Subsection 33C-11A (Pages 30 and 31) to specify that the purpose and intent of the Government Center Subzone to include, like the purpose and intent of the Brickell Subzone, that development in this subzone should also include public service infrastructure needs;

~ Amend Subsection 33C-15A (Pages 34 and 35) to specify that the purpose and intent of the Metromover Subzone to include that new development should address the public service and public infrastructure needs of the area; and

~ Amend Subsection 33C-15D which sets forth the procedures and development standards of the subzone to require additional staff analysis of development impacts on public services and facilities beyond minimum concurrency and subdivision regulation standards, and to provide that approval may be conditioned on such additional improvements as may be appropriate to address the impacts of the new development on the Rapid Transit System and properties or public facilities or infrastructures surrounding the proposed development area.

Responding to Commissioner McGhee�s question, Assistant County Attorney Dennis Kerbel advised that the Rapid Transit System (RTS) referenced in the foregoing item did not include the South-Dade Corridor located between Florida City and Dadeland, therefore the area would not benefit from the Rapid Transit Zone (RTZ) designation.

Commissioner McGhee asked whether the foregoing proposed ordinance could be amended to include language which would extend the zoning and land-use benefits to the residents of South-Dade.

Assistant County Attorney Kerbel stated that while the foregoing proposed ordinance could not be amended as requested by Commissioner McGhee, there was a pending request to expand the RTZ to include all the existing lines and Strategic Miami Area Rapid Transit (SMART) Corridors.

Commissioner McGhee requested clarification as to whether the creation of the RTZ included private properties and if the foregoing proposed ordinance contained language to protect private property owners against eminent domain issues. He also asked whether the inclusion of private properties into the RTZ made it easier of the County to develop more public transportation into the area.

Assistant County Attorney Kerbel explained the foregoing ordinance considered private properties and provided property owners additional development rights but did not address eminent domain issues. He noted that the inclusion of private properties into the RTZ would facilitate transit oriented development at the intensity and density levels set forth by the Board of County Commissioners (BCC/Board) in the existing RTZ policies.

Commissioner McGhee questioned whether the foregoing proposed ordinance contained language which would prevent the acquisition of private land to expand the metro-mover and/or other rapid transit development projects.

Assistant County Attorney Kerbel stated the new language provided additional clarifying policies regarding vested rights. He reiterated the foregoing item did not address eminent domain issues.
Commissioner Higgins reviewed the intent of the foregoing proposed ordinance.

Commissioner Regalado indicated her support for the foregoing item but expressed concerns regarding the timeliness and scope of the proposed floor amendments.

Commissioner Hardemon asked whether the foregoing proposed ordinance included an affordable housing requirement or component, and requested additional information regarding zones which mandate affordable housing requirements.

Mr. Nathan Kogon, Assistant Director, Development Services, Department of Regulatory and Economic Resources (RER), explained the foregoing item was similar to the Government Center and Brickell Subzones, therefore it did not mandate affordable housing development requirements. He pointed out that the proposed amendments allowed the Board to consider affordable housing as a special exception application. Mr. Kogon identified Douglas Station and Coconut Grove as two RTZs which required workforce housing.

Commissioner Hardemon observed that both the Douglas Station and Coconut Grove RTZ served communities of color. He contended that not all areas located along transit oriented corridors wanted intense development and voiced his concerns that the foregoing proposed ordinance did not include an affordable housing component. Commissioner Hardemon expressed apprehension about the creation of increased overpriced development which would exclude a large segment of the population.

Commissioner McGhee stated he could not support the foregoing item or proposed amendments in light of the exclusion of the South-Dade area.

Commissioner Higgins acknowledged the frustrations expressed by Commissioner McGhee and explained the intent of the proposed amendments.

Commissioner Regalado concurred with the comments and concerns voiced by her colleagues, Commissioners McGhee and Hardemon. She stated a more comprehensive and inclusive item was needed to remedy disparity related to RTZs and suggested Commissioner Higgins consider bifurcating the metro-mover component.

Commissioner Regalado requested the foregoing proposed ordinance be deferred until a more comprehensive legislation could be presented to the Board for consideration.

Discussion ensued among Chairman Diaz, Commissioner Higgins and County Attorney Bonzon-Keenan regarding the motion before the Board.

County Attorney Bonzon-Keenan explained that the motion to defer took precedence over the previous motion to adopt the foregoing legislation. She noted the inclusion of the South-Dade area was beyond the scope of the foregoing item, therefore an entirely new item would have to be drafted and re-noticed to the public.

Chairman Diaz requested clarification as to the intent of the foregoing ordinance and asked whether it would provide the administration the ability to access and expand areas surrounding existing RTZs.

Assistant County Attorney Kerbel explained the foregoing item sought to �clean up� the Fixed-Guideway Rapid Transit System and make it compliant with the Board�s RTZ policies. He noted the foregoing proposed ordinance also added the metro-mover subzone and adjacent properties identified on the map into the RTZ. Assistant County Attorney Kerbel clarified that the text changes would apply to any area included in the RTZ.

Commissioner Sosa indicated her opposition to deferring the item.

Chairman Diaz stated that he would also prefer for the item to be considered today (3/2).

Vice Chairman Gilbert, III acknowledged the concerns voiced by Commissioner Hardemon regarding the absence of an affordable housing component in the foregoing ordinance and advised his colleagues that he was currently working on legislation to expand the RTZ which would build on the foregoing item. He stated that he would support a deferral if there were not enough votes to adopt the foregoing item.

Commissioner Monestime indicated he would not support deferring the item despite his concerns.

Commissioner Martinez voiced his support for the foregoing item as amended.

Commissioner Regalado reiterated that a more comprehensive item should be brought before the Board for consideration and acknowledged that the foregoing proposed item could not be amended to include the South-Dade area.

Miami-Dade County Mayor Daniella Levine Cava commented on the importance of the Board understanding the impact of deferring the item.

Upon being put to a vote, the motion to defer failed by a vote of 3-10; (Commissioners Higgins, Martinez, Monestime, Sosa, Souto, Cohen Higgins, Garcia, Heyman, Gilbert, Diaz voted �no�).

Commissioner Hardemon requested all references to Commission District 3 be deleted from the foregoing item.

Commissioner Higgins explained that Commission District 3 could not be excluded from the foregoing ordinance given the intent of the item as it relates to the metro-mover system and SMART plan.

Commissioner Hardemon expressed his disappointment in Commissioner Higgins� decision not to exclude Commission District 3 from the item.

Recognizing Commissioner Hardemon�s reservations, Chairman Diaz asked whether the prospective areas for expansion in Commission District 3 could be excluded while maintaining the metro-mover component.

Commissioner Higgins explained there were important areas affecting the �right of way� which would impact the SMART corridor if not included in the metro-mover zone.

Commissioner Higgins asked which parcels of property located in Commission District 3 presented an issue.

Commissioner Hardemon stated he objected to the inclusion of all areas located within his Commission District, including the Miami-Dade County School Board Administration Building. He reiterated the scope of the proposed amendments was substantial and impactful and needed to be thoroughly reviewed. Commissioner Hardemon commented on the need for balance and equity in advancing the item while protecting the needs of his community.

Commissioner Higgins stated her primary concern was maintaining access to properties which would allow the expansion of the metro-mover system to create the Miami Beach connection. She stated she would not object to removal of properties located west of South East (SE) 2nd Avenue.

Commissioner Hardemon insisted on the removal of all properties located within Commission District 3.

Commissioner Higgins requested the foregoing ordinance be deferred to the March 16, 2021 BCC meeting.

  REPORT: County Attorney Geri Bonzon Keenan read into the record the proposed amendment offered by Commissioner Heyman as follows:

-To Section 1 of the ordinance on typewritten page 7, subsection 4 of the proposed new Code provision, section 2-8.2.6.1, would be amended to add that they Buy American iron and steel requirements of the ordinance shall not apply if inclusion of iron and steel products produced in the United States will increase the cost of the project by more than 20 percent.

Thus, subsection 4 of section 2-8.2.6.1 of the Code will provide:

(4) Exceptions: The requirement set forth in subsection 3 shall not apply if,

(a) Iron and steel products are not produced in the United States in sufficient and reasonably available quantities or of a satisfactory quality: or

(b) Inclusion of iron and steel products produced in the United States will increase the cost of the project by more than 20 percent: or

(c) Upon a written recommendation of the County Mayor approved by a majority vote of the Board members present, compliance with the procurement and contracting requirements on subsection 3 are not consistent with the best interests of the public.

Commissioner Regalado indicated the foregoing proposed ordinance created a section in the agenda when there was a State of Emergency. She stated it would provide the Board an opportunity to include the section when a state of emergency was issued, therefore providing the Commission with a section to discuss those items.

Commissioner Higgins expressed concern about the ordinance; noting at the height of the Coronavirus Disease 2019 (Covid-19) pandemic the Commission had taken emergency action in a number of Covid19 related items. She pointed out once a discussion item related to the state of emergency was added to the agenda, it would consume the regular work of the County business. Commissioner Higgins indicated the Commission was able to manage COVID-19 by holding separate meetings dedicated specifically to the COVID-19 emergencies and opined including every emergency item into the agenda would interrupt County business. Commissioner Higgins stated she would not support the foregoing proposed resolution.

Commissioner Sosa stated adding a section for state of emergencies would affect the Board of County Commission (BCC) meeting hours and she noted Chairman Diaz met weekly with Mayor Levine Cava and other County Officials to discuss COVID-19 related emergency matters.

Commissioner Heyman asked if the Board added a state of emergency section on the agenda would the public have to speak on the item; and County Attorney Geri Bonzon-Keenan confirmed that the public would speak on the item.

Chairman Diaz assured Commissioner Regalado that anything related to an emergency would be added to the meeting for discussion.

Discussion ensued amongst Commissioner Regalado and County Attorney Geri Bonzon-Keenan regarding the speakers being added to the meeting.

Commissioner Regalado asked for the item to be withdrawn.

  REPORT: Commissioner Garcia questioned why there was an increase in monitoring ankle bracelets for those individuals on the pre-trial diversion program.

Mr. Daniel Junior, Director, Miami-Dade Corrections and Rehabilitation, stated there was an increase of offenders being transitioned to the monitor to release program as an alternative to incarceration. He noted the height of the Coronavirus Disease 2019 (COVID-19) pandemic encouraged the Corrections Department and Criminal Justice stakeholders to reduce the jail population.

In regards to Commissioner Garcia�s question about the stats for the re-arrest of offenders on pretrial, Mr. Junior indicated he did not have those stats at this time. He noted the department was able to maintain the population of arrest at around 1300 inmates and he also stated the department recognized incarceration exacerbated the lives of residents, as some were deemed to be no threat to the community.

Mr. Junior confirmed that 30 days was reasonable to present the outcome of the request. He also explained the reason relating to in-house laundry, due to the lack of space, resources, and machinery. Mr. Junior noted for the next five to six years the department would identify a space to bring back the in-house laundry.

Commissioner Garcia concurred with Commissioner Heyman to bring back the in-house laundry system and he also cautioned about the rejection of bids with moving towards the vetting process.

  REPORT: Chairman Diaz inquired why $2 million was needed at this time for outside counsel, although the eviction process was on hold. He also asked if evictions applied to the public housing and the private homeowners and opined this item showed preference to one part of our community.

Mr. Michael Liu, Executive Director, Public Housing and Community Development (PHCD) advised action was being taken in some regards to lease violations, but not actually evicting anyone from public housing, because PHCD was also affected by the moratorium per the Center for Disease Control (CDC) guidelines. He added the department has a right to enforce the obligations of the public housing residents regarding their lease agreements and noted they have been encouraged to do so by the United States Secretary of Housing and Urban Development. Mr. Liu commented counsel was needed to deal with cases concerning violation of leases, criminal actions, unauthorized orders and issues related to non-payment of rent.

Miami-Dade County Mayor Daniella Levine Cava announced a clarification memo was issued and pointed out that squatters have never been protected, they were being ejected along with anyone who does not have legal authority and those individuals not affected by Coronavirus Disease 2019 (COVID-19). She announced this mandate applied to commercial leases as well.

Chairman Diaz noted this community was suffering and he advised a group of bankers have been assembled to provide a presentation to the Board regarding to what expect as a result of this pandemic and noted he would be introducing legislation to address this matter.

Commissioner Regalado reported all of the public housing residents impacted by COVID-19 would be protected under the current federal eviction moratorium protection until June 2021. She pointed out that some residents did not fall into this category and therefore the eviction process should continue as required. Commissioner Regalado urged the department to substantiate the submitted paperwork relating to evictions and suggested adding additional language to the writ of possession and expressed concern with advocating issues currently in process.

In response to Commissioner Garcia�s question relating to the process for evicting squatters, Mayor Levine Cava stated there was a specific unit that has been trained and instructed to eject anyone without legal authority to be on the premises.

Mr. J.D. Patterson, Chief Public Safety Officer, Office of the Mayor, announced the special unit was trained to identify squatters and he advised 1,200 cases were under review and any potential squatter situations would be handled accordingly.

Commissioner Garcia asked the administration to provide a squatter report to the Board and Chairman Diaz mentioned the administration was asked to provide a report listing the breakdown of squatters and writ of possessions as well as a report from the courts providing similar information.

Commissioner Martinez informed the Board only an affidavit was needed to evict squatters and stated this information should be relayed to homeowners. He expressed concern with the item stating evictions were happening in public housing due to non-payment of rent; considering a moratorium was in effect for the private sector.

Mr. Liu reported court cases were being filed for violation of leases, but announced the department has not served any of the writs received nor have they filed for a writ after a decision has been made by the courts.

Commissioner Gilbert, III pointed out trying to obtain affidavits to conduct the eviction process for squatters was not a simple task and he stated the squatter issue infringes on the quality of life within the neighborhood. He mentioned the inconsistency in the core values being displayed by the administration in relation to this item.

In response to Commissioner Gilbert, III, Mr. Liu, explained the public housing eviction process was very lengthy due to the federal mandates to work with the resident prior to filing a court case for non-payment of rent.

Further discussion ensued between Mr. Liu and Commissioner Gilbert, III regarding the public housing eviction process for non-payment of rent.

Mayor Levine Cava reported evictions were not being actualized if they were COVID-19 related. She stated the administration would review this policy to determine what lawyers were needed at this time and reiterated the moratorium was a federal mandate and those guidelines were being followed.

Commissioner Regalado clarified the federal protection in regards to writ of possessions, protects individuals who have not received a final judgement and noted once the moratorium was lifted, there would be thousands of writs that will have to be effectuated.

  REPORT: Commissioner Martinez voiced his concerns about the contract that may impact the park in his district and asked whether the County was receiving more money for the contract. He pointed out the contract with the Tennis Academy was at the expense of the kids taking the tennis lessons and noted previously parents was paying $65.00 for three hours, and now the parents would be paying $125.00 for the same three hour lessons. Commissioner Martinez stated many of the parents struggle to pay extra curriculum activities for their children and noted the cost for Miami Dade County residents had doubled, therefore he would not support the foregoing proposed resolution.

Pursuant to Commissioner Monestime�s question as to why this curriculum was not provided to the entire park system and only provided to select county parks; Ms. Christina Cotto, Parks Recreation and Open Spaces (PROS) Department indicated not all parks with tennis courts have the availability and volume for a tennis center operation facility.

Commissioner Monestime questioned how parks would address the limited access to programs at specific parks within his district and Ms. Cotter indicated there were staff in the parks providing tennis lessons and other programs.

Commissioner Hardemon indicated he played sports in the park systems and reported a fee was required to join the sports programs. He added many parents could not afford to satisfy those fees and he also raised concerns about the private sector utilizing public facilities. Commissioner Hardemon asked that Ms. Cotter provide the Board with information regarding the tennis program.

Ms. Cotter provided the Board with an overview of the Canas Tennis Academy program.

Commissioner Cohen-Higgins inquired whether a child who was a resident in the community have access to the tennis court while the program was in progress; and Ms. Cotter indicated if there was an after school program, there were tennis courts reserved for the after school program.

Commissioner Gilbert, III voiced concerns about the cost of the tennis program and pointed out in order to acquire lower cost for the program, the parks must be willing to subsidize the program. He inquired about other available options, if the foregoing proposed resolution did not pass.

Ms. Cotter indicated if the item did not pass, she did not know what direction the Board would take, but noted PROS may resolicit or renegotiate the program. She commented the item needed to pass today, because PROS had been operating under expired agreements with the previous vendors since 2018.

Chairman Diaz raised concerns about the residents having limited access to utilize the courts in the park because of private entities. He announced after hearing the concerns raised by the Commission, he asked that the item be deferred to no date certain.

  REPORT: Commissioner Garcia requested clarification regarding the intent of the foregoing item and the status of the bid.

Ms. Christina Salinas-Cotter, Assistant Director, Miami-Dade Parks, Recreation and Open Spaces (PROS), noted the foregoing resolution involved an unsolicited proposal to the County and she reviewed the legislative requirements and timeline for considering and evaluating unsolicited proposals.

Responding to Commissioner Garcia�s question as to why a Request for Proposal (RFP) could not be issued for the subject property, Ms. Salinas-Cotter explained that the proposal included an outdoor restaurant element which would require the conversion of a community room to the kitchen. She noted that the community room was constructed with Building Better Communities General Obligation Bond (BBCGOB) funds and served the community as an open and accessible public space. Ms. Salinas-Cotter reported that staff�s analysis of the proposal determined the conversion was not in the public�s best interest and did not align with the County�s commitment to the community. She also added that the subject property lacked adequate parking facilities to support an outdoor restaurant. Ms. Salinas-Cotter further explained that the proposal also sought to adopt a private management approach of the marina which deviated from the County�s current management approach. She added there was also a potential risk the County would have to repay funds from the Florida Inland Navigation District (FIND) and Florida Boating Improvement Plan (FBIB) grants received over the last 20 years. Ms. Salinas-Cotter noted many of the capital improvements suggested by the proposer were already contemplated in the County�s five-year Capital Plan for Pelican Harbor with several projects in the planning and design phase.

Commissioner Garcia requested the foregoing proposed resolution be deferred.

Commissioner Sosa read portions of staff�s findings into the record and suggested staff meet with Commissioner Hardemon, District Commissioner for the area.

Commissioner Heyman noted Fire Station 21 was located on the subject property until a new station could be built in the City of North Dade Village, therefore the Fire Department should also have input on the proposal.

Commissioner Hardemon voiced his support for the item and spoke about the unsolicited proposal process. He welcomed staff�s input on how the Pelican Harbor facilities could be improved and better serve the community.

Miami-Dade Mayor Daniella Levine Cava noted unsolicited proposals were submitted and vetted by the administration.

Mr. Jimmy Morales, Chief Operations Officer, Office of the Mayor, announced at the direction of Mayor Daniella Levine Cava, the County was looking into the infrastructure departments and water and sewer to restructure and bring back more in-house management of these projects.

Chairman Diaz pointed out some departments do their own projects/work, but the departments must bring in entities to assist in completing those projects promptly.

  REPORT: Commissioner Monestime voiced concerns about transferring surplus properties to international organizations and noted it was unclear how these international organizations were vetted to receive the surplus properties. He stressed that he was not speaking out against the international organizations, but noted often times some communities in Miami-Dade County lack the resources needed for support.

Commissioner Heyman explained that under the current professional rules of fire fighters, they prohibit any surplus property by manufactures date from being used domestically. She noted the only choice was to send the surplus properties out of the country to fire departments or other public service entities to use for training. Commissioner Heyman noted another option was for the County to store the surplus properties for a certain amount of time and then incinerate the property.

  REPORT: Commissioner Higgins indicated she requested an overview be conducted by the Commission before the revision of the traffic flow modification procedure manual. She noted the department was asked to meet with the Commissioners individually to allow input on the procedure manual. Commissioner Higgins indicated the intent for the foregoing proposed resolution was to make it easier for cities to implement traffic calming.

Commissioner Sosa pointed out when the streets were closed, the traffic would go to other residential neighborhoods, causing the traffic to persist. She stated the study would be beneficial to help keep the cities safe and advised when revising the transportation procedure it should be conducted in a uniformed manner.

Commissioner Regalado noted the City of Miami had taken an official stance against the foregoing proposed resolution. She advised the Commission to proceed with caution about the position taken with the municipal partners. Commissioner Regalado indicated she represents municipalities and unincorporated cities. She expressed concern that the City of Miami did not close streets without discretion. Commissioner Regalado stated the City of Miami provided their own Police and Fire Department, and she believed the commission should consider their position as a board.

Commissioner Garcia stated it was unfair if one community was able to close their street, while another community could not close their street. He noted he was not in favor of the foregoing proposed resolution because it was not impartial to the other communities.

Commissioner Gilbert, III explained that the foregoing proposed resolution was not about street closures and it did not change the process for street closures. He noted the resolution was a restatement of the current law. Commissioner Gilbert, III indicated street closures were not considered as traffic calming devices.

Commissioner Hardemon explained the process of implementing traffic devices in the City of Miami and indicated the proposed resolution would be beneficial to municipalities in implementing the traffic devices. He noted he was in favor of the foregoing proposed resolution.

Commissioner Monestime stressed that his district lacked traffic calming devices and noted staff had not been fair in addressing the matter relating to demands in his district. He stated a number of studies were conducted and denied for traffic calming devices and stressed that the resolution needed to be revisited.

Commissioner Heyman asked to be listed as cosponsor on the forgoing proposed resolution. She noted most of the cities in her district managed to get certain things done with leadership. Commissioner Heyman believed the revision would benefit the cities to get their needs done quicker.

Miami-Dade County Mayor Daniella Levine Cava indicated she would be working to revise the traffic rules. She noted the State of Florida and the federal government must work together to make the changes.

Mr. Jimmy Morales, Chief Operations Officer, Officer of the Mayor, provided the Commission with information about a transportation consultant, Mr. Gabe Kline. He noted the consultant would advise the County on sales analysis and review County issues such as prioritizing pedestrian, bicycle shared use, and restructuring the transportation department.

Discussion ensued between Mayor Levine Cava and Chairman Diaz.

Commissioner Sosa asked to be listed as co-sponsor.

  REPORT: Commissioner Regalado noted there was a proposed bill in Tallahassee that would give parents of neuro-divergent children an alternative to guardianship. She explained guardianship allowed parents to remove all the rights of neuro-divergent children and mentioned how difficult it was to return those rights once they have become of age. Commissioner Regalado indicated the intent of the foregoing proposed resolution was to allow disabled children as they grow up to have supportive decision making instead of removing their rights. She stated this resolution would help in preventing parents from baker acting the disabled young adults, due to their inability to afford a guardianship.

Chairman Diaz and Commissioners Sosa, Higgins, Monestime Cohen-Higgins, and Heyman asked to be listed as co-sponsors.

  REPORT: Commissioner Regalado stated proposed Senate Bill (SB) 90 in Tallahassee would eliminate and purge all absentee request. She indicated the purge would take place on July 1, 2021 and proposed that the bill be pushed to January 1, 2022.

Commissioners Higgins and McGhee asked the Commission to oppose the bill and strike section 2 of the bill. Commissioner Higgins stressed the elections should not be meddled with, because Miami-Dade County supervised great elections and a vote by mail program.

Commissioner Heyman indicated Florida Association of Counties and the Election of Superintendents opposed SB 90. She noted the bill was costly and would cause a chilling effect on elections, along with the elderly population and she believed the election process should not be revised.

Chairman Diaz concurred with Commissioner Heyman on not revising the election and asked Commissioners Garcia and McGhee as former state representatives what would happen to the bill.

Commissioners Garcia indicated an alternative should be offered and the bill may essentially fail.

Commissioner McGhee indicated the Board should oppose SB 90.

Commissioner Regalado agreed to strike revised section 2, urging the Florida Legislation to oppose SB 90, and similar legislation that would retroactively cancel pending vote by mail ballot request.

Miami-Dade County Mayor Daniella Levine Cava indicated she received a memorandum on the impact of the bill and noted the bill would impact 400,000 voters, causing an additional expense to the election department. She stated if the bill passed, she wanted the record to reflect the stance of Miami-Dade County.
