Cone of Silence
It is the policy of Miami-Dade County that a "Cone of Silence" be established on all County competitive selection processes including:
- Request for Proposals (RFPs)
- Requests for Qualifications (RFQs)
- Bids for the provision of goods and services
The Cone of Silence prohibits any communication regarding a particular RFP, RFQ or bid solicitation after they have been advertised. This Cone of Silence is designed to protect the professional integrity of the procurement process by shielding it from undue influences prior to the recommendation of contract award.
It establishes a disciplinary and penalty process for those who violate the Cone of Silence.
The Cone of Silence is terminated at the time when the County mayor issues a written recommendation to the Board of County Commissioners, or at the time when the issuing department issues its written recommendation to the mayor when the award is within the mayor's delegated authority.
Contractor Debarment
Small Business Development serves as the coordinator for contractor debarment proceedings in accordance with the Miami-Dade County Code.
The Contractor Debarment Report lists all contractors that have been debarred from participating on County projects either as a prime or a subcontractor. The report includes the names of the debarred firms and officers, the initiating County department, the grounds for debarment, and the debarment period. Contractors are removed from the report upon the expiration of the debarment period. The report is updated as needed.Goal Deficit Report

Pursuant to the ordinances, contractors that fail to achieve the measures on contracts must make up any deficits in measures on future County work. The make-up amount is equal to double the dollar value of the deficiency. These ordinances require make ups be made a condition of any new award.
Effective April 1, 2020, the Small Business Development (SBD) division will no longer publish a Goal Deficit Report. The information maintained on this report can now be found in SBD's Compliance Report. The report lists open violations and violations closed in the last three years issued by SBD for the Small Business, Wage and Workforce programs. If a firm has an open violation for not fulfilling a Small Business Enterprise (SBE) measure and is required to submit an SBE Makeup Plan as a part of any future bid or proposal, this information or requirement will appear on the Compliance Report.
