When will I know my hearing date?
You will receive a letter advising you of your scheduled hearing date. Nearby property owners within the required radius will also be notified.
Who is notified about my zoning request?
Homeowners and property owners within the required notification radius are informed of district boundary changes and other zoning relief requests. Registered Homeowners Associations (HOAs) in unincorporated Miami-Dade County also receive notice by registering to receive information regarding zoning hearing requests within their boundaries.
What happens at the hearing?
The Chair opens the meeting and explains the rules. When your item is called, you or your attorney (if you choose to hire one) may present your request. Supporters and objectors may also speak. The board will review the evidence, ask questions and vote to approve, deny or approve with conditions.
What happens after the hearing?
A Resolution is prepared outlining the board’s decision, including any approved requests and imposed conditions.
What must I do if my request is approved?
You must comply with all conditions listed in the Resolution before using the property as approved. If an Agreement or Covenant was offered, it must be recorded by the Zoning Legal Section, you may contact them at [email protected].
What if the hearing involved illegal or proposed construction?
You must obtain required building permits, complete inspections, and secure a Certificate of Use and Occupancy or Certificate of Completion.
What is the Zoning Agenda Coordinator’s Office (ZACO)?
ZACO schedules and advertises hearings before the Community Zoning Appeals Board (CZAB) or Board of County Commissioners (BCC), prepares meeting agendas, publishes legal ads, distributes hearing materials and posts notice signs on the subject property.
Is a boundary survey required?
Yes. A boundary survey is required for public hearing applications and for permits when property is contiguous to a municipal boundary. The survey must show municipal boundary lines and be updated within one year of application.
How can a Homeowners Association (HOA) register for notifications?
HOAs in unincorporated Miami-Dade County may register at no cost to receive zoning hearing notifications by submitting a registration form to the Zoning Hearing Section.
